STASIUI , P.E.,Ph.D. . Deputy Commissioner Bureau of Water Supply, Quality and Protection March 24, 1998 The results of a dye test, performed on March 18, 1998 were positive, indicating a failed septic system at;325B:Route3- 11located in the Town of Patterson. A Notice of Violation was issued. NYCDEP is requesting that the septic tank be pumped out. Additionally, it is beneficial to the system to reduce the amount of water usage in the meantime. It is recommended that your tenants use laundromats in lieu of onsite laundry machines: Sent under separate cover are water saving fixtures that can be used in the apartments. If you or your tenants have any questions regarding installation please feel free to contact me at 914 - 742 -2068. In the meantime it is required that you contact an engineer or contractor to determine the proper method to remediate the system failure. Given the history of septic failures at this site it is necessary to remediate the site as soon as possible. Please respond with plans for repairing the system or this violation will be referred to the New York City Law Department for further enforcement. STASIUI , P.E.,Ph.D. Deputy Commissioner Bureau of Water Supply, Quality and Protection April 15, 1998 This office has not received a.response to our March 24, 1998, letter regarding the failing septic system at 325B Route 311 located in the Town of Patterson.. A Notice of Violation was issued. April 9, 1998, an NYCDEP representative reinspected the site and found that the system is still failing and that no remedial action has ;been-.taken. Given the history of the site and the proximity,of the Great Swamp it is of significant concern. NYCDEP is requiring that the septic tank be pumped out as soon as possible. Please notify me in advance of the scheduled date for the septic tank pump -out. In the meantime, it is required that you contact an engineer or contractor to determine the proper method to remediate the system failure. Please submit plans to this office by May 1, 1998, or this violation will be referred to New York City Law Department for further enforcement. Patterson, NY 12563 TITLE: Public Health Sanitarian PH0 \'E: (914) 278 -6130 EXT. 160 DATE: March 23, 1998 OFFICIAL NOTICE OF NON- COMPLIANCE YOU ARE HEREBY NOTIFIED that non - compliance Mth Article III Section 4 of the Putnam County Sanitary Code consisting of a discharge of sewage onto the surface of the ground was found at your property, tax map -23- 6 -1 -14 by a representative of the NYC DEP on March 6, 1998. It is believed that you are responsible for correction of this condition. If you are not responsible, you are requested to notifi- immediately the inspector above indicated. Please be advised that appropriate steps must be taken immediately in order that the sewage overflow cease by arranging for the septic tank to be pumped out and maintained pumped until the proper repairs are made to the system. Approval of proposed repairs must be obtained from this Department prior to any alteration or rebuilding of existing disposal systems. An application is enclosed. Failure to pump the septic tank by March 30, 1998 and further, to correct this condition by April 6, 1998 will make you liable for additional penalties provided by law, including prosecution on a charge of committing a violation punishable by a fine or imprisonment, or both such fine and imprisonment, as prescribed by law, in addition to such other action as may be prescribed. A reinspection will be made. It is sincerely hoped that the above - mentioned further action will not be necessary and that you will cooperate by securing the correction of this condition.
