PERMIT TO CONSTRUCT A WATER WELL
This permit to construct one water well as set forth above is granted under the provisions
of Subpart 5 -2 of Part 5' of the New York State Sanitary Code, and provided that within
thirty (30) days of the completion of water well construction, the applicant shall:
1. Pump the well until the water is clear.
2. Disinfect the well in accordance with the requirements of the Putnam County Health
Department attached to this permit.
3. Submit a Well Completion Report on a form provided by the Putnam County Health Department.
During all well drilling operations, the applicant shall take appropriate action to assure that
any and all water or waste products from such well drilling operations be contained on this
property and in such a manner �a/} not to degrade- herwise �rta� ce or groundwater.

AGREEMENT made the 30th day of December, 1987 by and between
MANX LAUFER, residing c/o P. O. Box 149, Brewster, Nov York 10509
(hereinafter called the "Grantor ") and PETER M. NUENTENER,
residing at Minor Road, Brewster, New York 10509 (hereinafter
called the "Grantee ").
WHEREAS, the Grantor is conveying title this date to the
premises described in Schedule A, attached hereto, which premises
are also known as Parcel 2, South Street, Patterson, New York
(hereinafter "Parcel 20); and
WHEREAS, the Grantor is the owner of the adjacent premises
described on Schedule B attached hereto, which is also known as
Parcel 1, South Street, Patterson, New York (hereinafter "Parcel
1 "); and
WHEREAS, situate on Parcel 1 is a well and certain water
lines which serve both Parcel I and Parcel 2; and
WHEREAS, the Grantor desires to convey to the Grantee an
easement for the use of the well and the existing water pipes from
the well to Parcel 2 subject to certain terms and conditions] NOW,
THEREFORE, it is agreed by the parties as follows;
' 1. The Grantor grants to the Grantee an easement for the
use of the well and the water lines serving Parcel 2 situate on
Parcel 1, and for the maintenance, repair, and replacement of said

2. The Grantee hereby declares that the expense of
maintenance, repair and replacement of the well and all common
water linos shall be shared by the owners of Parcels 1 and 2

replacement of water lines serving Parcel 2 alone shall be borne
in their entirety by the owner of Parcel 2. The cost of
maintenance, repair and replacement shall include that cost
required to restore the premises of Parcel 1 to as close as
reasonably possible to the condition prevailing prior to the time
such work.
7. In the event that the owner of Parcel 2 shall fail to
pay his or her respective share within 30 days after demand, the
overdue amount is hereby declared to be a lien against his or her
property which can be enforced in the same manner as a judgment
against said owner.
e. Any overdue payments shall be assessed interest at the
highest rate allowed by law from the date such payment is due to
the date on which payment is received. In the event the Grantee
has failed to make payment when due, said Grantee shall be
assessed the cost of collection and legal fees of the Grantor.
5. This Agreement can be modified only in writing in such
form as is required to record a modification hereto in the office
of the Clerk of the County of Putnam, and signed by all of the
owners of all of the parcels hereby encumbered.
6. This easement shall run with the land in perpetuity and
shall bind the Grantor and the Grantee, their respective
successors, heirs, executors, administrators, personal
representatives and assigns.
7. Whenever the sense of this Agreement may sake it
necessary or appropriate, any single word or tars used herein

shall include the plural, and any masculine word or term used
herein shall include the feminine.
IN WITNESS WHEREOF, the Grantor and the Grantee have executed
this Easement Agreement intending that the same be recorded in the
office of'the Clerk of the County of Putnam, Division of Land
Records.
