And, your statement, "...problem occurs ... in early spring when•water tables would be at a high level ", clearly insults or underestimates my intelligence. In my 30 years in Lake Peekskill, I have come to accept the seasonal spring conditions of the heavy winter snows. It does not date back to April, 1987. What you fail to understand is that prior to Carunna's improvement systems, a water condition existed ONLY on my lots 26 and,27. however, the Caruana's septic work has "flooded my lots 29 and 28. Lot 29 is side -by -side with the curtain drain located on Crxuana's property . You made an erroneous conclusion since your respolse did not make any referral to to the August 13,1990 minutes of the P: connects the curtain drain to the pipe that basin is "perforated" instead of "solid" as it overlook this important statement of fact, which r for my water problem? For the past five years an on- going- water - problem has been created when my neighbors, Mr. Joseph Caruanals home was built and a sewage system was first repaired, enlarged and finally a new system installed,, Though this matter has been brought to your attention during the prior gears, no solution was offered by your office, permitting the condition t® carry on. In my N years of residence in Lake Peekskill,, my property was AiEM damaged by such a water condition... „until the new neighbor was given the, right of -way for a "Second- Floor- Addition" - permit #89 -722. Its been ray contention and supported by the enclosed correspondence, minutes of the 'Manning Board, €2/13/90 and letter 8/13/90 by Joel Greenberg why I have had this excessive water problem an my property. Hollow Brook Road (T) Putnam Valley TM # 104 -1 -48,3 Dear Mr. Abile: Receipt of your letters concerning the above captioned project dated August 28, 1991 and October 5, 1991 are hereby acknowledged. Your questions in your October 5, 1991 letter will be answered in the order they were written. 1) The first septic system was installed prior to this Department's existance. Therefore, . this.. Dep rtmen c,ould...not have issued a permit. The second septic system was approved and permitted by the Town of Putnam Valley. At this time, this department was not involved in repairs to septic systems or additions to existing structures. The third septic system was approved by this Department along with the addition to the existing house. At this time, this Department was involved with repairs to the septic systems and additions to existing structures. 2) An inspection was conducted by this Department of the uncovered third septic system. This is standard procedure for this Department. Please be aware that this Department issued a Construction Permit for a septic system. All other aspects of the project, including modifications made to the existing water course are the responsibility of the Town of Putnam Valley. Presently, the Town of Putnam Valley has put a Stop Work Order on the project. Therefore, this matter presently lies in the hands of the Town of Putnam Valley. Joel Greenberg's letter of August 13,1990, report to: Putnam Valley Planning Board. 2. P.V. Planning Board minutes, page 2, dated August 13,1990 3. 1-br memo dated August 14,1990 The two photos show the perforated pipe,' resting on a cider block and not connected into the culvert. However, the workers had made a "hole" under the culvert to "catch- the - water" coming off the cider block. Pray tell how was the flow of water controlled from the cider block into the open exposed culvert? Somewhere, sim somehow, someone did not do their homework. Now you can understand why I feel like a "ping -pong -ball" between the Town and County health departments. I only wish to resolve a situation, created by the contruction of an improper septic system and not by "a propblem that occurs in early spring when water tables are at a high level ". Joel Greenberg explained that the public hearing of August 6, 1990 was adjourned in order to give Mr. Caruana and his engineer, William Zeiler, time to provide additional information regarding what was intalled on his property at the time the new septic system was put into place and how the proposed curtain drain was connected, if at all (see exhibit la). The P.C. Health Department appears not to have any record of site inspections made to verify the installation of the septic system and this explains why- the applicant did not receive a certificate of compliance. Mr. Caruana denied knowing anything about this; he stated that he had complied with everything. 1" It appears that the curtain drain might not bX ® connected as it should be and the work area will f - have,....to9_,.:be- - exposed --to determine ;eK- actl-y' =whst, J s Joel - Greenberg asked if the` old se'wajee' system has been removed or just abandoned and Mr. Caruana said that he did whatever he was supposed to do. The pipe which connects the curtain drain to the pipe that carries the storm water to the .catch basin, is perforated instead of solid as it should have' been and this may account- for the r. water problem on Mr. Abilo's property. Discussion then ensued regarding the best way to resolve the situation. Highway Superintendent Ragens noted that the pipe at 24" is no longer sufficient to handle all.the water collected from the property since there is not absorption or evaporation and there is no longer an .open water collection area.
