The purpose of this letter is to determine responsibility for
the cost.to correct the inadequate storm water and drainage
facilities located on and around my property at 6 Woodridge
and the Mill Ponds Homeowners Association "common" land ... and
for the failure to take into consideration the areas
susceptibility to flooding and erosion, as well as, the

BACKGROUND
Our home is one of approximately 40 homes that constitute the
Mill Ponds Development in Putnam Valley, N.Y.. This
development was conceived and executed by Aphrodite
Corporation under the leadership of.Joe and Jim Marinelli,
with the approval of the Town of Putnam Valley. The
development was unusual in that it violated normal zoning
practices and included "cluster housing" and "common
property. A little over one year ago, this area was taken
over by the Mill Ponds Homeowners Association to be managed
by an elected Board which included Mr. Joe Marinelli and is
chaired by Mr. Ivan Gavrilovic.
Our property is bounded in the back and on one side by common
property. The area on the side, is the base of a mountain
which, since we have owned the house, has been the source of
water problems. Shortly after we purchased our home, water
from a severe storm caused the hill to slide. This
necessitated some additional fill to be--brought in and
propped against the hill and the area around it had been
disturbed so it had to be raked and seeded. Mr. Marinelli
had his Company perform these services free of charge.
At this time we became aware that a trench had been recently
dug some distance up the hill running across the back of
three of the homes, including ours. This trench emptied into
a natural run -off that came down.the hill behind our house
and was carried away by a catch basin and culvert.pipe that
ran into the street drains.. We noticed that this catch basin
did not include a grate, but, did not appreciate at the time
the significance of this fact.
More recently, as I'm sure you'll recall, we had another bad
rain storm and once again this drainage system failed to
function. The pipe became plugged and water sought its own
path and carved out a notch in the hill and cascaded across
our backyard into our neighbors. (see photo enclosed) Our
landscaping was severely damaged as was that of the.houses
below us.
CURRENT SITUATION
To our dismay, we have discovered that neither the pipe,
catch basin or ditch are recorded on any maps /site plans and
no one -at Town Hall or associated with the construction of
Mill Ponds or its.management will acknowledge .their
existence ... or responsibility for repairing the situation, or
insuring against something like this occurring again.in the
future. Aphrodite Construction Company, Inc. has submitted
the enclosed estimate for $8,160.00 to the four homeowners
effected to repair the damage and add additional run -off
capacity to handle future heavy water situations. The other
homeowners have made a decision to fix their own property
damage and not share in any costs to remedy the source of the
water problem.
CONCLUSION
Someone has to be responsible for this damage... and for
making the necessary correction so this will not happen again

adjacent to my home which is on our Mill Pond Homeowners
Association "common" land. This rain storm tested the system
constructed by the Mill Ponds builder, Aphrodite Construction
Company and found it seriously lacking.
