The first is a violation of Chapter 53 Section 53 -2 dated March 19, 1986, 'The Installation of - Subsurface Dtspoeal .Syatem .vi,tbout „pormit'. The, sewage disposal4 , - .:dyated, 4a :loose -near the 'south -east corner of :the -residence: "The ` back -116®6tI -. portion of the lot appears to be mostly ledge rock. Therefore no other area of this parcel is suitable for the construction of a sewage disposal system. The second violation issued on !larch 10 lChapter 64 Section 64 -2 paragraph A B C & D! deals with the construction of m individual water supply in an unimproved area. Apparently the well location teas approved by the Zoning Board, io the north west corner of the parcel_ The well was, in fact, drilled approximately 30 feet south of the approved site. The actual well is closer to two existing sewage disposal systems than the approved site would have been. However, the approved site .mould not have maintained the minimum required separ-atlon distance of 100'. These violations apparently are for mislocating an individual well in an unapproved location and the construction of a sewage disposal system without a permit. These violations are issued by the Town of Putnam Valley, and not by the Putnam County Department of Health and, therefore, must be addressed by the Town. �.� Une- possible solution would be to abandon the existing mislocated well and redrill the well in the approved location. Enclosed is a copy of a permit to construct and a permit to abandon a water well. A permit to repair or replace the sewage disposal system can be obtained from this Department, if the Town so requires. Y.*` MEMBERS PRESENT: HERBERT LEVENSON Chairman JIM GORDON Member ROBERT MAZZARISI Vice Chairman Member SOL LIRTZMAN Secretary The matter having duly come on to be heard before a duly convened meeting of the Board on the 27th day of February, 1986, and the facta, matters and evidence produced by the applicant, the Zoning Inspector and interested parties having been duly heard, received and considered and due deliberation having been had, the following are the The subject premises are located in the R-L district with the following setback requirements:` Front - 75'; Sides - 301; and Rear - 75'. The subject premises are located on Avon Road, which is a Town road, filed subdivision known as Lake Peekskill. The size of the lot is 6,420 square feet with an existing percentage.6f lot coverage, 14.2% while the code only permits 5% The existing house does not conform to the front,.rear and side yard setbacks of the R-L.zone. The applicants are requesting a complete second story and additions to the first story which would mean more than 100% expansion of the livable space, where the code only permits 20%. The Board notes that the lot coverage is almost 300% over that permitted by the Code-. ., , and the existing setback from the property lines are far below the requirements of the R-t zone. The Board concludes that expansion xpansion of this house by increasing its livable space more than 1008 is excessive and far beyond the capabilities of this particular lot. The Board also notes that the present sewage disposal system was installed without permits and very close to the well, which was not drilled in the approved location. It is the duty of the Zoning Board of Appeals to provide the minimum relief when the criteria for an area variance is met. For an area variance the major criteria that has.to be met states-.' "How substantial the variation is in relation to the code requirements.". The Board concludes that the request is excessive and the briteria for an area variance has not been met. THEREFORE, based upon the above findings of fact, it is hereby ORDERED, that the application or appeal be and the same is hereby DENIED.
