I have received and reviewed the plans for the proposed addition to the above mentioned
residence.
The plans indicate that a 4' X 12' addition will be added to the existing kitchen. Also, a
10 X 15 addition will be added in the area of the existing deck to increase the size of the
master bedroom suite. This represents an increase of approximately 15% of existing floor
area.
Therefore, based on the information submitted, the above mentioned addition is APPROVED
with.the following conditions: -
1. The total number of bedrooms must remain at three without prior approval by this
Department.
2. The area of the existing sewage disposal system, and its expansion area, must be
Maintained.
3. All plumbing fixtures must be replaced or updated with water saving devices, i.e., low
flush toilets, restrictors for shower heads and faucets, etc.
4. No further addition.
Approval is granted for sewage disposal only. Any other permits or variances required are
the responsibility of the applicant and the jurisdiction of the Town of

The matter having duly come on to be heard before a duly convened
meeting of the Board on the 28th day of Feb. '91, and the facts,
matters and evidence produced by the applicant, the Zoning Inspec-
tor and interested parties having been duly heard, received and
considered and due deliberation having been had, the following are the.
FINDINGS OF FACT:
An on -site inspection has been made by the Zoning Board of Appeals.
The subject premises are located in the R -L district with the following
setback requirements: Front - 75'; Sides - 30'; and.$ear - 501; at 19 Point
Drive, which is a Town road, in a filed subdivision known as Lake Peekskill.
This request for lot coverage and sideline variances was originally denied on
October- 15; _991, however, the. applicant present-ed.:new. evidence `and.`Liie Bid_

feels `tIie crite "ria'for an Area Variance have been met. A practical difficulty
exists and such difficulty cannot be obviated by a method other than a
variance. There will not be a substantial change in the character of the
neighborhood. This action will not be detrimental to the adjoining
properties. The character of the neighborhood will be preserved. This is the
minimum variance that will provide relief.
A short EAF has been submitted as per SEQRA requirements and a negative
declaration is in order since it appears that there will be no major impact on
the environment.
THEREFORE, based upon the above findings of fact, it is hereby ORDERED,
that the application or appeal be and the same is hereby GRANTED, subject to
the following: 1) The applicant shall obtain an approval from the Putnam County
Department of Health, Division of'Environmental Health Services, for the septic
system prior to the issuance of a Building Permit; 2) The kitchen extension
shall not extend beyond the area -way into the `basement; and 3) The applicants
shall obtain a Building Permit within 180 days from the date of the signing of
this Decision and Order by the Town Clerk, otherwise this Decision and Order
will become Null and Void.
The decision of the Building and Zoning Inspector is hereby reversed.
