/ I PERMIT TO CONSTRUCT A WATER WELL
This permit to construct one water well as set forth above, is granted under provisions of Article 10 of the
Putnam County Sanitary Code and Subpart 5 -2 of Part 5 of the New York State Sanitary Code and provided
that within thirty (30) days of the-completion of water well construction, the applicant or their designated
representative shall: 1) Pump the well until the water is clear. 2) Disinfect the well in accordance with the
requirements of the Putnam County Health Department. 3) Submit a Well Completion Report on a form
provided by the Putnam County Health Department. During all well drilling operations, the applicant and/or
well driller shall take appropriate action to assure that any and all water and waste products from such
well drilling operations be contained on this property and in* such a manner as not to degrade or otherwise
contaminate surface or groundwater.
APPROVED, FOR CONSTRUCTION:. This approval expires two years from the date issued unless
construction of the well has been completed and inspected by the PCHD and is revocable for cause or may be
amended or modified when considered necessary by the Public Health Director. Any revision or alteration
of the approved plan requires a new permit. Well to be constructed by a water well driller certified by Putnam
County.

I ant applying for a variance tq install a well at 343 Lake Drive in lAm Peekskill. I contacted Norman
Andemn Well O illing this o*ming, and the office stated #Ad a permit has been filed with your office for
this location However, someone from W. Anderson's office will stop by your office today with another
permit request for a well.
TU reason for the request for # variance is that the distance between flue well and the septic will be .120
feet. As I itulicated to you, must of the homes along Lake Drive have less than a 40 feet distance between
the well and the septic system : I realize that these wells were one- ercist iM however, 120 feet is 3 times the
distance of nu* of the wells a0d septics in the area.
It is imperative that I receive a0proval as soon as possible. The town water will be shut off within a week.
Please expedite this request fot a variance.

though an individual water supply has not been constructed and the summer water supply
currently serving the residence is not available during the winter months.
Please be advised that occupying a residence without a source of potable water is a violation of
the Putnam County Sanitary Code Article 9.

above mentioned residence.

The following outstanding violations were observed at 343 Lake Drive on
November 25, 2002 at 3:15PM.
Basement:
1) No hangers on heat pipes
2) Stack from boiler exits contacting sheetrock covered plywood
3) Un- insulated pipes in basement with broken windows
4) Unprotected oil line running from tank to boiler
Main House:
1) No hardwired smoke detectors. One battery detector in view
2) No soffit vents on the north side
3) Substandard attachment of deck to main house and rotted deck joists
4) Insulation does not meet code
5) No electrical inspections
6) No letter from architect stating that all work is done to code
7) No approved source of potable water

I am requesting a letter firm the Putnam Valley Building Department stating that all issues
that were formerly non- compliant are now in compliance.
On November 13, 2002, the budding Wspector, Irv, inspected the above premises for
building compliance. All ,issues of non -compliance have been addressed. Please note that
this house is an appzoxu tely 50 year old seasonal residence in Lake Peekskill, Vincent
-St-George had occupied Nhis house for t rez years a until 2 years agq�)v ken he lost the
due "tv ioioarpayme$t of taxes. The issues resolved areas follows:
1. Attached please find architectural drawings • requested 11/13/02 - completed
11/30/02.
2, Metal chkwy has been extended to code as of 11/18/02.
3. Railway bas boen installed for the exterior stairs leading from the road as of
11114/02,
4. Small propane gas tank was placed outside of the house during inspection on
11/13102.
5. Fireplace had (existing hearth. Vinyl flooring was covering the hearth.
Vinyl flooring was cut back to expose the hearth on 11 /14/02.
6. Rear deck was braced with addition support beams on 11/14/02.
7. Four smoke detectors were hardwired to a dedicated panel on 11 /26/02.
8. Mark Fannie of Fanning Electric bas filed with the electrical inspector fbr
A UV certi£icstion.
9. Midge vents and soffit vents were installed on 11 /25/02.
10. The yard wasp cleaned on 11/13/02, 11/17/02,11/25/02.
11. Access to bakement was provided on 11/18/02.

On 1 1/18/02, Iran re- inspected the house and found the following items which have been
addressed:.
1. bails on back iof stair-vay raal needed to be chat. This was done at the tame of
Inspection on' 11/18/02 and Iry noted that this was dome.
2. Smoke detectbas -4- were hardwired to a dedicated panel on 11/26/02.
3. Two additional lengths of chitmey was added on 11/19/02.
4. Ridge vent b"ed on 11 /25/02 • delay was due to weather conditions.
S. Hot, water hefter was disconnected on]]/] 9/02.

On 11/25/02, John Alert mm for a re- inspection. On 12/2/02 a notice was posted on the
door of 343 bake Drive, toting that there were additional items that were not noted by

All deck joiats do not have hotted wood. To my knowledge, Iry approved
deck but regµested cross beams which wire installed on 11/14/02.
Insulation is to code.
Architect drawing is attached.
Mater - pending your signature on the easement. 'Approved by Department
of Health - pending signature on easement. Putnam Malley Highway
Department has cashed my check for $800, Nomm ,Anderson has a $4,000
deposit on the well - check cashed, and Phil Cassesse is scheduled to due the
escavation.
Any items that are found to be in non - compliance Are addressed irnumdiately or witbin a
24 hour time frame. However, I need written confiration frost the JPutu m VWley
Building departzz nt that everything is in compliance and has beam completed,
Also, please expedite the signing of the easement in order to provide water to the house.

Resolution Approving Easement Agreement
With Aileen and James MyerS at 343 Lake Drive
November 20, 2002
Resolution No 02-
WHEREAS, t*e Town Highway Department has been asked by local residents
Eileen and James Myers, for 1wumission to run a water supply pipe under Lake Drive adjacent to
343 Lake Drive, known as Tux Map. No. 83.66 -2 -70 ( "the House Property "), to their property
located diagonally across Lake Drive, known as Tax Map 83.58 -1 -16 ( "the Vacant Land "), where
they desire to install a well toy supply the House Property, and
WHEREAS, the Highway Department has inspected the proposed work and has
no objection to the granting df an Easement for the running of a water supply pipe as requested,
with certain conditions, and
WHEREAS, the Myers have offered to pay the Town the sum of $1,000 for the
Easement, and in addition, they have agreed not to develop the vacant property, and they have
agreed to certain other conditions, and
WHEREAS, the Town Board has concluded that the price and conditions as
offered are fair and reasonable, and that the Easement Area has no use to the Town, now or in the
future, now theref re
BE IT RESOLVED, the Town Board hereby approves the Easement Agreement
With Eileen and James Myers, on the terms and conditions set forth in the proposed Easement
Agreement, and the Town Supervisor is authorized to execute the Easement Agreement and
appropriate conveyancing documents necessary to effectuate such agreement.
This resolution shall be subject to a permissive referendum.

Road Easement Agreement
THIS .AGREEMENT, made orb November , 2002, by The Town of Putnam Valley, 265
Oscawana Lake Road, Putnam'Valley, New Fork 10579 (hereinafter referred to as the
Grantor ), and Eileen Myers dnd James Myers, 20 South Street, Putnam Valley, New York
10579 (hereinafter "the Granteb "), concerning certain property located at and adjacent to 343
Lake Drive, Lake Peekskill, Now York 10537 (hereinafter referred to as "the House Property ")
WITNESSETH:
WHEREAS, The Grantor is the owner in fee simple of Lake Drive, a town road lying and being
in the Town of Putnam Valley6 County of Putnam, State of New York, known and designated as
such on the official highway neap of the Town of Putnam Valley (said land in its entirety
hereinafter referred to as "the toad "); and
WHEREAS, the Grantee has tequested that the Town of )Putnam Valley (the "Town ") consent to
the Grantee's installation of a water pipe under the Road, from the House Property at 343 Lake
Drive, to the property diagonallly across the street also owned by the Grantee ( "the Vacant
Land "), for the purpose of allowing the drilling of a well on the Vacant Land, and bringing the
water to 343 Lake Drive, which work is more fully described in Schedule A attached hereto ( "the
Work' ); and
WHEREAS, the Town desire$ to consent to such work, but requires an easement to enter upon
the Grantor's Property and to !reflect the parties' agreement; and
WHEREAS, the Grantor desires to create an easement in favor of the Grantee, and burdening a
portion of the Road, for the purpose of installing and maintaining a water line under the Road
adjacent to 343 Lake Drive;
NOW, THEREFORE, the CiMntor hereby declares that the Road shall be held, sold, conveyed,
transferred and occupied su.Weet to, the following easement which is for the purposes of
installing underground water pipe.
Section I. "Easement Area" 4hall mean the area of the Road in and about which the Work is to be
performed, and such adjoinixIg areas as may be reasonably necessary to afford ingress and egress,
consisting of a strip five feet wide, provided that such Work wnAl be performed, and such
mccess shaDA only be exerei"d, upon prior written aplprovel from the Town Highway
Department.
Section 2. Declaration of go4eme ts. The Grantor hereby declares that the Road is hereby
encumbered, and shall hereafter be conveyed subject to the burdens of, an easement in, to, under
and over the Easement Area, in favor of the Grantee, sufficient to allow the Grantee to complete

the Work described in Scheddle A. In addition, the Town shall have the right alter the Work is
completed, with or without notice to the Grantee, to inspect and/or repair the Work. This
easement is granted upon the (conditions that:
(a) the Grantee carry but the Work in reasonably workmanlike fashion, and shall not
obstruct or endanger ttaffic on fake Drive,
(b) the Grantee shall dean up the job site after the Work is completed,
(e) the Grantee shall *t its sole cost and expense restore the Easement Area, and any
areas used for ingress or egress, including paving, to the satisfaction of the Town
Highway Department,
(d) the Grantee shall provide security to the Highway Department, in form and amount
determined by the Highway Superintendent, as security for damages potentially caused by
the Work,
(e) the Grantee hereby covenants and agrees not to develop or in any way build upon the
Vacant sand (other thran the drilling of a well and providing any necessary accessory shed
for same), which is ddemed merged with the House Property, whether or not such merger
can be reflected in thei assessment roll.
(i) the Grantee hereby holds harmless and agrees to indemnify the Town from any loss or
damages caused now br in the future, by reason of the Work having been performed,
including but not limited to property damages, personal injury, increased costs to perform
goad work in the Easement Area, and any other damage or loss of any nature,
(g) the Grantee shall Orovide three original sets of stamped "as built" planes to the
Highway Department, showing the exact location of the Work and indicating the
Easement Area.
(h) the Grantee shall Obtain such additional permits as may be required.
(i) The Grantee shall correct outstanding Code violations on the House Property, and
provide inspection, all to the satisfactions of the Code Enforcernent,().f�cer. This

0) The Grantee shall pay to the Town of Putnam Valley the sum of $1,000 for'this
Easement, together with $125 for all recording fees. Upon satisfaction of all conditions
to issuance of this Easement, the Town Attorney shall record this Easement Agreement
against both the Howe Property and the Vacant Land parcel.
(k) Because the Vacant land has been put into the joint names of Eileen and James, and
James is a minor, the Grantee must secure approval of a Justice of the Supreme Court
before this Easement will be issued.
Section 3. Maintenance and &Rair of Easement. After the Work is completed, and the Easement
Area is restored, it shall be the right and obligation of the Town to maintain the road surface of
the Easement Area, in the manner the Town generally maintains town roads, in its sole
discretion. Provided however, that any repairs or other work necessary to maintain the Easement
Area beyond normal and routine paving, i.e. damages or increased expense caused by Grantee or
its water line, shall be promptly repaired by Grantee at Grantee's sole cost and expense, with the
prior written approval of all plans by the Town Highway Department. In the alternative, in the
sole discretion of the Highw4y Department, any such work may be performed by the Town at the
Grantee's expense.

Section 4. Duration. The easement created by this Declaration shall run with the Iand for a period
of 50 years, and shall be deemed renewed on an annual basis thereafter unless it is revoked, and
shall bind all owners of the Douse Property and the Vacant Land, their respective successors,
heirs, executors, administrators, personal representatives and assigns. The Town shall have the
right, at any time and after 4ording the Grantee notice and an opportunity to be heard, to revoke
this easement in the event th4 Town needs the Easement Area for some other public purpose, for
example to install other infrastructure in that area.
Section 5. Hold Harmless. The Grantee has indicated an intention to drill a new well near Lake
Drive, on the Vacant Land. the Town has informed Grantee that the Town uses road salt to
maintain Lake Drive during the Winter season, and that there is a risk that such salt may
contaminate Grantee's well, due to its proximity to the road. Grantee, for themselves and their
heirs, successors and assignso. hereby indemnifies and holds harmless the Town and its agents for
any damage or loss relating tO contamination of the future well.

recorded in the Office of the Olerk of the County of Putnam, Division of Land Records, on the

Work to be Performed
1. Installation of underground'2" diameter water pipe, across Lake Drive adjacent to 343 Lake
Drive, Fake Peekskill, as sho*n on the attached tax map. Grantee has not provided a survey of
the House Property, or of the Load. A.ccordiagly, for purposes of this Easement Agreement, the
precise location is approximate. However, it is the intention of the parties that the Easement
Area shall run from the.front l#roperty line of the Vacant Land at the point where Grantee is
drilling a new well, as shown 6n the survey prepared by Badey & Watson, attached hereto, thence
directly across Lake Drive to *e opposite shoulder, thence along the shoulder of Lake Drive to
Grantee's House Property. Prior to digging, Grantee shall verify the exact locations to the
satisfaction of the Highway Department.
2. Trenching and digging necossary for water pipe installation, minimum 48 inches deep.
3. Restoration of the area, by'filling and leveling the land, and repaving similar to what was
removed.
4. The House Property is known as Tax Map 83.66 -2 -70, into which has also been merged lot
no. 83.66 -2 -72.
5. The Vacant Land consists bf Tax Map 83.58 -16 to 18, and 23 to 25, which aye merged under
Tax Map No. 83.58 -1 -16.
6. The current record owner of the House Property is Eileen Myers. The current record owners
of the Vacant Land are Eileen and James Myers. For purposes of this Easement Agreement, the
term "Grantee" is used interchangeably to refer to both.
