The plans indicate that an 18' x 17' addition was added to the residence prior to 1975.. Based on the information submitted, this Department has no objection to this addition. Vice Chairman member Arlene Green.... ... ......Secretary The matter having duly come on to be heard before a duly convened meeting of the Board on the 18th day of Oct. 1990, and the facts, matters and evidence produced by the applicant, the Zoning Inspec- tor and interested parties having been duly heard, received and considered and due deliberation having been had, the following are the FINDINGS OF FACT: An on -site inspection has been made by members of the Zoning Board of Appeals. The subject premises are located in the R -1 district with the following setback requirements: Front - 75'; Sides - 30', and Rear - 50'; at 44 Austin Street, which is a private road, in a filed subdivision known as Floradan Estates. A review of the records indicates that the previous owner had applied for a variance which was denied. The previous owner built this addition without the benefit of a Variance or Building Permit. Since there was no bank involved in the purchase, the present owners were unaware at the time of purchase that this addition was illegal. They now wish to refinance through a bank and have applied to the-Zoning Board of Appeals in order to legalize the addition. The applicants have satisfied the Board that the expansion of livable space more than 20% as required by Section 66 -23 b of the Town Code is justified and the criteria for an Area Variance have been met. A practical difficulty exists and such difficulty cannot be obviated by a method other than a variance. There will not be a substantial change in the character of the reighbprhood:,., "This • _action will_ .riot - be, detrimental -.to- the.. adjoining _ properties. The character of the neighborhood will be preserved: 'This'is'the °- ­- minimum variance that will provide relief. A short EAF has been submitted as per SEQRA requirements and a negative declaration is in order since it appears that -there will be no major impact on the environment. THEREFORE, based upon the above findings of fact, it is hereby ORDERED, that the application or appeal be and the same is hereby GRANTED, subject to: 1) The applicant shall obtain a Building Permit and Certificate of Occupancy for this existing addition within 60 days from the signing of this Decision and Order by the Town Clerk. 2) Failure to comply with the above condition, this Decision and Order will become Null and Void. The decision of the Building and Zoning Inspector is hereby reversed.
