I have received and reviewed your request for all information concerning the above
mentioned parcel.
A review of our records indicate no previous application for the construction of a well,
subsurface sewage treatment system (SSTS) or renovation/addition to the existing residences has
been received or reviewed by this department.

The application to remove the two existing structures, and replace with a 2 bedroom single
family residence was approved by this department on July 13, 2000. Please note the approval
was based on the existence and evidence of water and sewage facilities serving the two non-
conforming pre - existing structures. .
This department reviewed the application and made several visits to the site. Field
inspections indicated the location of -the existing septic system was in close proximity to the
existing well on both this property and the property adjacent to the west tax map #83.08 -1 -36.
Field inspections indicated that the subsurface sewage treatment system could be constructed
parallel to Oscawana Lake Road along the east side of the property and maximize separation
distances to all surrounding wells. Therefore this department required that the SSTS be
reconstructed as shown on permit R- 170 -00 as a condition of approval.

An area has also been reserved for the construction of a drilled well if the existing well is not
sufficient distance from the existing and proposed SSTS and of adequate quality and quantity to
serve the'
roposed residence.

Recently, a corporation, 15 Grant Place Inc. of Lake Peekskill, purchased a small piece of
abandoned, nonconforming lot (1 /3 acre) which is adjacent to my house on Breezy Park Road.
The corporation then submitted a proposal to the Putnam County Board Of Health ( PCBOH )
for the construction of a new 2- bedroom house for sale. On that small lot, the corporation
proposed to drill a new 250 ft. well; just 25 feet away from our existing well of 48 ft., and to put
in a new septic system. Despite the potential adverse impact on our existing well water, in terms
of supply and contamination which can affect our family with 4 young children, the PCBOH gave .
the quick approval in only 2 days, and without any notice to us.
As quoted from the article in the North County News (Oct.11 -17), " He (Mr. Foley, the
County Health Director) suggested that while new welts drilled in close proximity to existing
wells could sometimes jeopardize the water supply, it is also possible this new application could
improve conditions. ". It seems tome that the latter suggestion is totally inappropriate for a
County Health Director to make. it is such an unfounded and highly speculative statement. In
the same article, he states "if Lee, or any other homeowner ran low on water, they would be
forced to drill their well deeper at their own expense." This statement shows how inconsiderate
the County Health Director is to us, who are directly affected.
Also quoted from the same article, " Mr. Foley said the department looks for evidence
of prior piping and water to determine if a permit should be granted for a septic system installed
and well." When questioned, he said that regardless of current health and safety standards, "
even outhouses and pipings sticking into a pile of rocks will qualify as evidences of preexisting
septic systems." He also informed us that Putnam County is the only remaining county in New
York State that is still legally obliged to issue such permits based on the above policy.
If PCBOH continues to give _quick approvals just_based on minirrnal and vague evidences
of well and septic on any small, nonconforming lots,, we, the residents of Putnam County should

proximity of wells to septic systems would ultimately result in water contamination, as
documented in the Executive Summary of the current report of "Lake Peekskill Water Facilities
Plan ". These public facts should have encouraged the PCBOH to follow the example of other
counties in making a conscientious effort to abolish this outdated health legislature, which will .
potentially endanger the residents of Putnam County, rather than still enforcing it with speed as in
the case of the quick, 2-day approval issued to 15, Grant Place Inc.. - -- From the information gathered from the. Town Code, the abandoned property purchased
by 15 Grant Place Inc. have many nonconformities and noncompliances with the majority of the
Town Codes. Before getting the health permit and multiple variances for these noncompliances,
the corporation went ahead to pay $25,000 to purchase the property. In my opinion, under such
circumstances, how can that corporation have so much confidence in making the purchase in
advance!

Residents of a Putnam Valley street are
puzzled how a neighboring property
owner has received county Health Depart-
ment approval for a well and septic system
they fear will endanger water quality and
quantity in their area. "
Homeowners on Breezy Park Road, a
small side street off Oscawaria lake Road,
are also suspicious that the new owner, 15
Grant Place, Inc. of Lake Peekskill, re-
ceived approval within two days of sub-
mitting an application.
The .30 -acre parcel currently contains
a decayed cottage and outhouse that has
been abandoned for about 25 years.
In June, the new owner bought the land
and quickly submitted plans to build a
two-bedroom house.
Now the residents are protesting to the
Putnam Valley Zoning Board of Appeals
(ZBA) that the owner pursued the wrong
permit that allows for the drilling of wells
and inclusion of a septic system on a pre-
existing substandard parcel.
Kim Lee, who owns the adjoining lot
with her husband, said she fears the pro-

We are making a request for the hearing to be postponed because of several issues. There is a
formal protest pending, challenging the BOH approval, which was issued by Mr. Hedges of the Health
Dept. on the grounds that it is premature, nonconforming, suspicious, and highly questionable. Enclosed
herewith is the letter of protest to the Board of Health. Our present complaints are as follows:
(1) We, the neighbors on the street did not receive proper notification of the variance hearing on
both occasions. Legally, aren't we supposed to be informed of the meeting by Certified and Return mail?
Notices of the variance hearing for 8 -24 -00 were sent to The Fithians and us by regular mail, in an
envelope from a company named "All -Pro Rooter ". It had the guise of a piece of junk mail, which could
have easily been thrown away. Was it done intentionally so that we would miss the hearing?
The Eybs, on the other hand were not even informed of the meeting at all, although their
property is on the adjacent lot. On the drawing submitted to the Health Dept., showing the proposed
locations of the systems, the word "Vacant':' was written, where the Eyb's lot 129 is located,.. It appeared to -.

(2) There is no pre - existing septic: The "approximate location of existing septic" was however
indicated on the drawing. Last year, I went to the Assessors Office to look up records for that particular
information, but was told that they do not have any records. They were installed in 1938, prior to record
keeping!! However, there is an outhouse still standing on the property barely less than 30 feet away from
our well which is the extent of the evidence of a septic system.,
(3) There is no are - existing well. The existing "well" is only evidenced by a hand -dug concrete pit,
40 feet away from the proposed septic system. It is totally illegal. The proposed 250 feet deep well is
TOO CLOSE ( approximately 30 ft.) to our 48 feet deep well. Moreover, it still does not comply with the
minimum required distance of 100 feet between the two proposed well and septic systems on the property
in question. How did he get the BOH approval?
This raises another question. At the last variance hearing, Mr. -Rice said that our well will be
"monitored ". Who has the means to do this? Something like this will have to be part of his and our deed;
thereby making it perpetually enforceable. After all, the new corporate property owner (15 Grant Place;
Inc.) is just going to build and then SELL the house. We area family of sir, with four young children and
we plan be in our house for life! Will it then be the responsibility of the new buyer!to monitor our'well? .
For 13 years, our 48 ft. well has provided us with safe' and an adequate amount of water. We
should not be expected to dig a deeper well just to accommodate the demand of anew 250 ft. well,
closepro�:imit�+t = teSa( ours.Te`proposedwel'has a very g66
water table as ours and the quantity of our water will be at stake.
(4) We have valid reasons to worry that the proposed system is going to adversely impact the quality
and quantity of our well water. Like the Lake Peekskill district, our neighborhood was conceived as a
summer community in the early I900's when well and wastewater placements were NOT strictly
regulated. It is considered by the current Health Dept. as unsafe and nonconforming. We do not wish for
similar consequences to that of Lake Peekskill.
Information gathered from "The Lake Peekskill Water Facility Plan" and "The Lake Peekskill
Wastewater Facility Plan" should be enough to convince the Health Dept. that we should not be subjected
to any potential water contaminations. As identified in ES -1 and chapter l of both handbooks, the
following factors such as a small lot size, summer cottage.conversions and expansions, closeness of septics
to the well, etc. contribute to the decline in the ability of the Lake. Peekskill area to support itself
adequately. Being so densely populated, the Lake Peekskill community has a history of well problems
"as recorded by the Town and the Putnam County Department of Health ". Then "WHY" was that permit
issued_ to 15 Grant Place Inc.? Was it just based on having vague evidence of a pre- existing well and
septic system ? ?? From a legal perspective, who, or which department is going to guarantee the
QUALITY AND QUANTITY of our water? Certainly not the Health Department, according to Mr. Bruce
Foley, when we spoke on the phone on 9- 19 -00. Who will monitor our well and improve it when needed ?
Where is the contract ?
(5) Another point for concern is the tendency for that lot to retain water whenever it rains because of
water runoff from the surrounding areas of higher elevation. This would most certainly mean lingering
-effluent sewage from the septic fields before being sufficiently filtered by natural process prior to hitting
our. water table.
(6) In November 1999, I went to the Assessors Office and obtained the "Property Description Report"
on that piece of property. -As in the past, ( when Mr. Odell was the building inspector ), it was pointed out
to me that it is now zoned as R3. The definition of R3 was given by Mr. Iry Serelowitz when, acting on
the advice.of a friend, 1.inquirsd:about the. possibility. of-build ing -under the- "Grandfatitered clause ".._ He :

years. Mr. Fithian too had made similar inquiries to Mr. Odell in the past. Since the two of us were
turned down on the requests, what could be the cause for the change of mind? It is not even a year since I
spoke with the Code Enforcement Officer.
(7) As stated in the Town Code; "In residence districts, such structure shall not be enlarged or
extended" (16545.131a), "In residence districis; such. structure shall not be altered or reconstructed except
for such alteration, maintenance, aI.id'repair work as required to keep said structure in a safe condition."
_ (165 -45 B2a) .The builder's proposal is for a replacement of those two cottages with either a two-
bedroom one -story house 27' X 4Uor a raised ranch 24' X 40' with a finished basement, on that
nonconforming lot of 0.2951 acre. Mr. Rice also did not comply with Codes 165-43.A.(l) and. 165-
44.A.0 where the height is involved. The proposed livable space clearly exceeds the 20% limitation, as
stated in 165- 44.(A). (2)
(8) For 25 years, that piece of property ltas been left abandoned, covered with dense vegetation,
windows unboarded, and generally been leftas ; an"fattractive nuisance ". Nocturnal animals have been
spotted in the day time, indicative of possible illness, and there has been an increase of snakes in the area.
Nobody bought that lot although Jn the past years, "For Sale" signs had been periodically posted. Several {.
complaints had been made by phone to the Town and Health*Dept. about this matter.
We offered to buy Mr. Scanlan's property last year but he said that he would rather donate it to
get a bigger tax break. He also suggested that we could.then buy it from whomever he donates it to. I
conferred with our local BSA Troop 41 lzader. (Mr. Pat Grogan) and after consultation with his board, he
said that they would be most glad to accept that offer, and further suggested that the Boy Scouts could r
even help clear that piece of property after selling it to us. I then left Mr. Scanlan a message on his
answering machine but he did not return my call. We left it at that, and did not pursue it any further.
(9) Mr. Hedges came in the Spring of 2000, and we assumed that it was in response to our
complaints to the Health Department in the past. On that visit, he asked Mr. & Mrs. Eyb and Mr.Fithian
about the locations of their well and septic systems, as their properties are adjacent to Mr. Scanlan's
property.
It is interesting to note that shortly after that, the property was surveyed. ( Property survey
dated 6 -7 -00 ). Site 83:12 -1 -36 was sold to 15 Grant Place Inc., the very next day. A " Proposal to
Replace" was submitted to the Health Dept. dated 7- 11 -00. The permit was issued by Mr. Hedges only 2
days later. When was the actual inspection done? The "Field Activity Report" with the Health
Department letterhead was written in what appears to be the hand writing of the applicant's. It was not
dated nor signed. We would Iike to know and understand what is going on. All those copies of the
above documents were obtained upon written request from the Health Department on 9 -6 -00.
Incidentally, on the evening of the variance hearing on 8- 24 -00, Mr. Hedges was outside the
courtroom. He made this comment to one of our neighbors: "He (Mr. Rice) can build." What was that
statement trying to imply? A1t1rough he was not at the hearing, we wonder if he is always so supportive to
all the applicants?
In view of the suspicions and the goings on thus far, we request that the Town Board kindly
investigate this matter and the property in question prior to considering the application for a building
permit. What would happen if everybody who comes across small, non - conforming lots with non -
conforming structures and evidences of "pre - existing" well and septics in areas designated as low density
residential zones (R3), with a similar proposal to build? This would seemingly defeat the Purpose and
Intent_ of the zoning regulations, as stipulated in the CODE of our Town. We therefore, leave this matter
to the better judgement and jurisdiction of the Zoning Appeals Board.

I have received and reviewed -your request for all information concerning .the, above
mentioned parcel.
A review of our records indicate no previous application for the construction of a well,
subsurface. sewage treatment system (S STS) or renovation/addition to the existing residences has
been received or reviewed by this department.
The application to remove the two existing structures, and replace with a 2 bedroom single
family residence mas_approved by -this department on July 13;-2000. Please note the approval
was based on the existence and evidence of water and sewage facilities serving the two non-
conforming pre- existing structures.
This department reviewed the application and made several visits to the site. Field
inspections indicated the location of -the existing septic system was in close proximity to the
existing well on both this property and the property adjacent to the west tax map #83.08 -1 -36.
Field inspections indicated that the subsurface sewage treatment system could be constructed
parallel to Oscawana Lake Road along the east side of the property and maximize separation
distances to all surrounding wells. Therefore this department required that the SSTS be
reconstructed as shown on permit R- 170 -00 as a condition of approval.

An area has also been reserved for the construction of a drilled well if the existing well is not
sufficient distance from the existing and proposed SSTS and of adequate quality and quantity to
serve the,,proposed residence.

Dear Mr. Foley,
We hereby would like to file a formal letter of protest against the permit dated 7- 13 -00,
which was issued by Mr. Hedges to 15 Grant Place, Inc. After much consultation with friends and
neighbors, we have come to the conclusion that we do not like the way things have unfolded so far.
Careful examination of copies of the various documents obtained from the Health Dept. do not
appear to make sense. We challenge the permit that was granted as being premature,
nonconforming in many areas, suspicious and highly questionable. Therefore, we are making a
request to the Zoning Board of Appeals for the variance hearing to be postponed until the following
issues have been addressed by the Board of Health:
(1) In November 1999, I went to the Putnam Valley Assessors Office to obtain data regarding
the Septic and Well locations on that piece of property. I was told by the Assessors Office that
they did not have this information because those systems could have been installed prior to record

Officer that due to the R- 3 zoning regulation, no building is allowed, even under the "Grand
Fathered clause" because that property has been left vacant for more than two years. When Mr.
Odell was the building inspector at that time, I had inquired about the possibility of building on
that property, but the answer was "no ". Mr. Fithian, our neighbor, had also made a similar inquiry
with Mr. Odell, and he got the same response. We would like to know what has caused a change of
mind now to permit someone to be able to install a Well and Septic on this small non - conforming
property.
(2) From the drawing submitted to the Board of Health by 15 Grant Place Inc., an
"approximate location of the existing septic" was marked by what appears to be the applicant's
handwriting. Without having any record of the actual site, how is it feasible that they were able to
locate that site without having to.dig up the whole yard? The only "evidence" that still stands on
that piece of property is the old outhouse.
(3) That new corporate property owner is not building on the existing foundation. Instead, he
is proposing to build a bigger house in place of those 2 summer cottages on a new foundation. You
mentioned about "hardship claim "? It would be understandable, had his year -round residence in a
small nonconforming lot, been destroyed by an " Act of God ". This is not his case, because this
new corporate property owner is building to sell, whereas we are a family of six, with four
young children. We plan to live here for life! It would be more of a tragedy if our health were

that property bought by 15 Grant Place Inc. on 6 -8 -00. Subsequently, the proposal was submitted
by the new corporate owners on 7 -11 -00 and permit issued by Mr. Hedges only two clays later!
That is quite questionable.
(8) Having brought up all these highly questionable issues, we hope that the BOH conducts a
thorough investigation of the above property. The cottages are still standing, and I enclose
herewith some of the documents in question.

association who have been here for over 25 years.

We are making a request for the hearing to be postponed because of several issues. There is a
formal protest pending, challenging the BOH approval, which was issued by Mr. Hedges of the Health
Dept. on the grounds that it is premature, nonconforming, suspicious, and highly questionable. Enclosed
herewith is the letter of protest to the Board of Health. Our present complaints are as follows:
(1) We, the neighbors on the street did not receive proper notification of the variance hearing on
both occasions. Legally, aren't we supposed to be informed of the meeting by Certified and Return mail?
Notices of the variance hearing for 8 -24 -00 were sent to The Fithians and us by regular mail, in an
envelope from a company named "All -Pro Rooter ". It had the guise of a piece of junk mail, which could
have easily been thrown away. Was it done intentionally so that we would miss the hearing?
The Eybs, on the other hand were not even informed of the meeting at all, although their
property is on the adjacent lot. On the drawing submitted to the Health Dept., showing the proposed
locations of the systems, the word "Vacant" was written, where the Eyb's lot 129 is located. It appeared to

(2) There is no are - existing septic. The "approximate location of existing septic" was however
indicated on the drawing. Last year, I went to the Assessors Office to look up records for that particular
information, but was told that they do not have any records. They were installed in 1938, prior to record
keeping!! However, there is an outhouse still standing on the property barely less than 30 feet away from
our well which is the extent of the evidence of a septic system. .
(3) There is no pre - existing well. The existing "well" is only evidenced by a hand -dug concrete pit,
40 feet away from the proposed septic system. It is totally illegal. The proposed 250 feet deep well is
TOO CLOSE ( approximately 30 ft.) to our 48 feet deep well. Moreover, it still does not comply with the
minimum required distance of 100 feet between the two proposed well and septic systems on the property
in question. How did he get the BOH approval?
This raises another question. At the last variance hearing, Mr. Rice said that our well will be
"monitored ". Who has the means to do this? Something like this will have to be part of his and our deed,
thereby making it perpetually enforceable. After all, the new corporate property owner (15 Grant Place,
Inc.) is just going to build and then SELL the house. We are a family of six, with four young children and
we plan be in our house for life! Will it then be the responsibility of the new buyer to monitor our well?
For 13 years, our 48 ft. well has provided us with safe and an adequate amount of water. We
should not be expected to dig a deeper well just to accommodate the demand of a new 250 ft. well,

water table as ours and the quantity of our water will be at stake.
(4) We have valid reasons to worry that the proposed system is going to adversely impact the quality
and quantity of our well water. Like the Lake Peekskill district, our neighborhood was conceived as a
summer community in the early 1900's when well and wastewater placements were NOT strictly
regulated. It is considered by the current Health Dept. as unsafe and nonconforming. We do not wish for
similar consequences to that of Lake Peekskill.
Information gathered from "The Lake Peekskill Water Facility Plan" and "The Lake Peekskill
Wastewater Facility Plan" should be enough to convince the Health Dept. that we should not be subjected
to any potential water contaminations. As identified in ES -1 and chapter 1 of both handbooks, the
following factors such as a small lot size, summer cottage conversions and expansions, closeness of septics
to the well, etc. contribute to the decline in the ability of the Lake Peekskill area to support itself
adequately. Being so densely populated, the Lake Peekskill community has a history of well problems
"as recorded by the Town and the Putnam County Department of Health". Then "WHY" was that permit
issued to 15 Grant Place Inc.? Was it just based on having vague evidence of a pre - existing well and
septic system??? From a legal perspective, who, or which department is going to guarantee the
QUALITY AND QUANTITY of our water? Certainly not the Health Department, according to Mr. Bruce
Foley, when we spoke on the phone on 9- 19 -00. Who will monitor our well and improve it when needed ?
Where is the contract ?
(5) Another point for concern is the tendency for that lot to retain water whenever it rains because of
water runoff from the surrounding areas of higher elevation. This would most certainly mean lingering
effluent sewage from the septic fields before being sufficiently filtered by natural process prior to hitting
our water table.
(6) In November 1999, I went to the Assessors Office and obtained the "Property Description Report"
on that piece of property. As in the past, ( when Mr. Odell was the building inspector ), it was pointed out
to me that it is now zoned as R3. The definition of R3 was given by Mr. Iry Serelowitz when, acting on
the advice of a friend,. I inquired about the. possibility, of building under the. '.Grandfathered clause ". He..
—said that it no-tong6r tlualifies as that property liar Been "abandoned'for ovet°flie l resct be period o-f two
years. Mr. Fithian too had made similar inquiries to Mr. Odell in the past. Since the two of us were
turned down on the requests, what could be the cause for the change of mind? It is not even a year since I
spoke with the Code Enforcement Officer.
(7) As stated in the Town Code; "In residence districts, such structure shall not be enlarged or
extended" (165- 45.B1a), "In residence districts, such structure shall not be altered or reconstructed except
for such alteration, maintenance, and repair work as required to keep said structure in a safe condition."
(165 -45 B2a) . The builder's proposal is for a replacement of those two cottages with either a two-
bedroom one -story house 27'X 4', or a raised ranch 24'X 40' with a finished basement, on that
nonconforming lot of 0.2951 acre. Mr. Rice also did not comply with Codes 165- 43.A.(1) and 165 -
44.A. 1 where the height is involved. The proposed livable space clearly exceeds the 20% limitation, as
stated in 165- 44 .(A). (2)
(8) For 25 years, that piece of property has been left abandoned, covered with dense vegetation,
windows unboarded, and generally been left as an "attractive nuisance". Nocturnal animals have been
spotted in the day time, indicative of possible illness, and there has been an increase of snakes in the area.
Nobody bought that lot although in the past years, "For Sale" signs had been periodically posted. Several
complaints had been made by phone to the Town and Health Dept. about this matter.
We offered to buy Mr. Scanlan's property last year but he said that he would rather donate it to
get a bigger tax break. He also suggested that we could then buy it from whomever he donates it to. I
conferred with our local BSA Troop 41 leader (Mr. Pat Grogan) and after consultation with his board, he

even help clear that piece of property after selling it to us. I then left Mr. Scanlan a message on his
answering machine but he did not return my call. We left it at that, and did not pursue it any further.
(9) Mr. Hedges came in the Spring of 2000, and we assumed that it was in response to our
complaints to the Health Department in the past. On that visit, he asked Mr. & Mrs. Eyb and Mr.Fithian
about the locations of their well and septic systems, as their properties are adjacent to Mr. Scanlan's
property.
It is interesting to note that shortly after that, the property was surveyed. ( Property survey
dated 6 -7 -00 ). Site 83.124-36 was sold to 15 Grant Place Inc., the very next day. A " Proposal to
Replace" was submitted to the Health Dept. dated 7- 11 -00. The permit was issued by Mr. Hedges only 2
days later. When was the actual inspection done? The "Field Activity Report" with the Health
Department letterhead was written in what appears to be the hand writing of the applicant's. It was not
dated nor signed. We would like to know and understand what is going on. All those copies of the
above documents were obtained upon written request from the Health Department on 9 -6 -00.
Incidentally, on the evening of the variance hearing on 8- 24 -00, Mr. Hedges was outside the
courtroom. He made this comment to one of our neighbors: "He (Mr. Rice) can build." What was that
statement trying to imply? Although he was not at the hearing, we wonder if he is always so supportive to
all the applicants?
In view of the suspicions and the goings on thus far, we request that the Town Board kindly
investigate this matter and the property in question prior to considering the application for a building
permit. What would happen if everybody who comes across small, non - conforming lots with non-
conforming structures and evidences of "pre- existing" well and septics in areas designated as low density
residential zones (R3), with a similar proposal to build? This would seemingly defeat the Purpose and
Intent of the zoning regulations, as stipulated in the CODE of our Town. We therefore, leave this matter
to the better judgement and jurisdiction of the Zoning Appeals Board.
