Mr. Charles Naccari of 155 -04 41st. Avenue, Flushing, N.Y. 11354
is the owner of a 50, wide by 200 deep parcel of land fronting on
Park Street. Existing on this parcel is a structure previously
constructed as a garage, but which the owner wishes to convert to
a one (1) bedroom dwelling unit.
This structure has running water from an existing on -site well
and waste facilities consisting of a 550 gallon septic tank and a
1,000 gallon leaching pit.
Reflecting the structure, existing septics and existing wells, we
are enclosing three (3) prints of "Survey of Property ", dated
December 11, .1984.
We have been unable to obtain data in regard to the existing.on-
site well, but if required, the owner could have a sample taken
from the tap and tested for bacteriological content.
Based on our inspection of the premises and surrounding areas, it
is our opinion that the existing structure could function as one
bedroom unit subject to Putnam County Health Department and local
agency approvals. For your additional information, we are
enclosing three (3) copies of the manufacturers cut sheet for the
1,000 gallon dry well.

As you know, the sewage disposal system serving the above mentioned garage was
repaired or replaced by you on or about February 16, 1990 without a permit from
this Department.
On February 20, 1990 the site was inspected by this Department, after the system
was installed and covered. At that time, you indicated that the system was
installed in the same area as the existing sewage disposal system approximately
115' from the southeast property corner.
It has come to our attention that the sewage,disposal system was in fact,

this is the case, the sewage disposal system is less than 100' to the existing
well to the east.
Based on this information, it is required that you excavate an area 120 feet from

I have received and reviewed the letter from your association dated May 12, 1992,
concerning the garage owned by Mr. Naccari on Park Street, Putnam Valley.
As you indicated, I had reviewed and responded to a similar letter from your
Association on August 18, 1990. Many items in both letters are correct.

Before it can become a single family residence, it must receive a variance from
the Town of Putnam Valley's Zoning Board of Appeals (ZBA) and approval from this
Department.
This Department has reviewed preliminary application to construct a residence and
found insufficient room available to construct a sewage disposal system capable
of meeting present code requirements for a residence.
I have reviewed the "as built' drawing of Mr. & Mrs. Eyb's parcel. The survey
indicates that Eyb's well is 74 feet from their west property line (Naccari).
The drawing submitted by Mr. Naccari indicate the sewage disposal system is 100'
from the Eyb's well.
The present structure is a garage /storage area with an individual well, a
bathroom and a sewage disposal system. As you know, the sewage disposal system
was reconstructed in early 1990. Mr. Naccari has the right to repair or replace
an existing sewage disposal system.
Unless the use of the structure changes from its original use, the sewage
disposal system must conform only to the regulations in effect at the time the
bri sr,a /stem :wns a*sPts.�:le .;: :1f.,t�s &krage;vas� built prior. to 1970 the Town _
of Putnam .Valley, at that time, had jurisdiction not only for building permits;
but also for individual sewage disposal system.
In summary, Mr. Naccari_ has the right to have a functioning sewage disposal
system for a small garage with a bathroom.
Mr. Naccari does not have the right at this time to expand the size of the
building or to change the use of.this structure without prior approval by both
the Town of Putnam Valley and the Putnam County Department of Health.

limited to the approved use.

We, the undersigned indiyidual property owners on Park
Street, Putnam Valley, being members of Park Street Property
Owner's Association are concerned about a specificproblem in
our neighborhood, which we understand is presently in your
hands. �
Several months ago some work was done in a small 50 x 200
lot, belonging to Charles Naccari, which included the
installation of a septic system, pipes, tank, drywell, etc.
This was done without permit or inspection and located
directly on one of our neighboring property lines and as
close as 60 feet to one well.

I have received and reviewed your request for approval of your existing
sewage disposal system to serve the existing structure on the above
mentioned parcel.
The structure on this parcel appears to be a garage or storage area which
you wish to convert to a residence.
The following additional information must be submitted to this Department
prior to our continued review.
1. A report, prepared by a professional engineer, stating that the existing
sewage disposal system is adequate to serve the proposed residence.
2. The report must also indicate the location and size of this system.
3. The location of the existing well.

5. The location of surrounding wells and sewage disposal system must also
be shown.
Once the above information is received, our review will continue.
Additional permits and variances may be required by the Town of Putnam
Valley.

As you know, the sewage disposal system serving the above mentioned garage was
repaired or replaced by you on or about February 16, 1990 without a permit from
this Department.
On February 20, 1990 the site was inspected by this Department, after the system
was installed and covered. At that time, you indicated that the system was
installed in the same area as the existing sewage disposal system approximately
115' from the southeast property corner.
It has come to our attention that the sewage disposal system was in fact,
installed considerably further to the north, on the east side of the pool. If
- - : this- is -the--case- _the sewage- disposal s stem is: less than 1.00' t-o- the existing 11
well to the east.
Based on this information, it is required that you excavate an area 120 feet from
the southeast property line. Any portion of the sewage disposal system found
north of this point will be required to be removed.
Please make arrangements with your excavator and this Department within the next
30 days (prior to September 12, 1992) to excavate the area indicated on the
enclosed plans.
