The letters in opposition to granting approval of the sewage disposal system were read as was - All. the information. provided by Mr. Scripter, including . his request to ,appear before the Board prior to issuance: of. any approval. 4 Mr.,; Frank Thiede, P.E. 'appeared with Mr.,- ,,.3u�:ano 9 his son and future daughter -in --law. .Photos of the site . together. with techn cial discussion and information.from Mr Thiede • were presented. Following revi.ew., the .Board voted.:3 to 1' to consider. al- lowing the waivers if it were satisfactorily demonstrated that . ..the new State and County standards were maintained. The concept that Mr.. Scripter's well was endangered was not thought valid, except that;,.installation of .a 6 ft, deep clay. barrier near the rear . property., line, was. sugge,sted. to offer added diversion of groundwater:'f1.ow. Mr. Roland read from techn dial information . indicfat!n,� that slopes :of less than Sao a7re of less concert in ground water ,flow than are steeper slopes. Y. 10579 December 19, 1977 S S I find it necessary to.write again on our concerns for the health risk to my family, friends, and neighbors as well as the dollar damage already done (with more anticipated) to my property as the result of Mr. Juliano's attempt to build a dwelling on anon conforming substandard lot (TM55 -2 -2). adjoining my peoperty. The health risk concerns.have:':been well - documented with copies to your files. These wtill remain since we still have received no assur- ance that.our wells, etc. will not'become contaminated. Now we find that land contour and drainage changes have worsened the sit- uation. Direct action is required by your office and other responsible authorities to prevent and correct harm already done. These changes and results on adjoining properties are described. as follows: 1. Drains have been constructed,by Mr. Juliano to divert and drain surface and underground ;water_ from ,both the street and the Juliano ptdper"ty`so that"Tt = "duhips" directly' orito�my -property ._�., and our neighbors. As a result of this change, we have already experienced property.-damage as well as selected area flooding. This change has.made a portion of our private property unusable. This must be corrected at expense of Juliano and in accordance with Putnam Valley Zoning Board of Appeals and Town /County legislation. 2. The building perimeter foundation is also being drained to dump onto my property. This 'will add to drain water concen- tration and unless corrective action iip taken we can also expect that eventually sewage seepage will be added, as you consider that separation distance from sewage septic absorp- .tion field is only 10-feet to dwelling instead of the required 20 feet as per standards (see Separation Distance From Waase;- water Sources) . In consideration of "water_,.problem" found on Juliano property and the numerous vatiances. granted to the minimum sewage.dis- :posal.re'irements it is recommended that the County Health Board re= evaluate,the overall plan and provide further assur- ances on health safety to affected.property owners. It is quite important that all parties recognize that all costs associated with this situation be borne by the Julianos.since problems have been a direct result of an attempt to develop an in- '(for purpose) piece of land for his financial benefit. It is not reasonable or acceptable to expect adjoining"proper'ty owners, neighbors, or tax payers.to pay for his personal advantage or to suffer risks to their health. In conclusion; it is recommended that your office not issue a'Cer tificate of Construction and Compliance ..and the Town Building Inspector should not issue a`Certificate of Occupancy until all requirements are met including the Zoning Variance stipulation that all adjoining properties be left unharmed, etc.. It.is Sug- gested that a,Performance Bond (in escrow) from.Juliano be required as a means for payment of damages and'costs of correction. Drainage overland from:.the entire immediate area collects generally around the border line between lots 4 and 5-and runs toward a catch basin at the front-of the property near this-line. These two lots (4 & -5) are quite flat,and water during wet periods of time reportedly accumulates on these lots.and the subsurface soils become saturated, flooding basements. Water drainage has been a historical.and continuing prob-..; lem to Spruce Knolls homeowners and "run -off" from the implicated lot is one of the primary sources of surface and underground water. Any change i..e. land contours; tree removal, added water, change in water flow, etc. to this already borderline situation will increase these water problems. The proposed nonconforming sewage disposal system will only add.more water to .the previously men - tioned drainage and run -off problems. A serious health hazard could, be..expec- ted during the spring and rainy seasons when the soil be- comes more saturated and surface run -off is extreme. We. also note that the plan refers to a change in contour of the land to permit installation of the sewage disposal system to conform with local sanitary codes.. This plan was abandoned for some reason. Subse- quently, the Putnam County Department of Health rejected proposed:,.sew age disposal plan with sewaae disposal on east side of lot due to its nonconformance, and'late "r'they acceptea a revisea pian.' Unforiuizdciy, all of the pertinent and adverse conditions were not.properly communi cated.and an exception to some specific rules and regualtions appear to have been waived and we are appealing. Some specific areas of concern are as follows*: 1),. The minimal area required for sewage disposal systems is 2) 3) not in conformance to the Putnam County Department of Health rules and. regulations that specifically require: . "For each sewage disposal system for a private residence a minimum usable area of 5,000 square feet, or an area sufficient to provide a.50% expansion of the proposed .system, whichever is larger, will be.required on each. building lot exclusively for sewage disposal purposes." In review of the proposal we judge neither condition is satisfied and the larger condition, i.e. 5,000 square feet, is short of conformance by approximately 3,000 to 4.,000 square feet. NOTE: We do not understand the rea- son for. considering such a gross exception to these health regulations. Deep -soil test discrepancy - the County Health Depart- ment reported a 5 foot reading to ground water while the drawing refers to "no- ground water ". in their test. NOTE: The County Health Department could not explain the difference except perhaps it was a difference in L.Lme of evaiLation. - The original plan showed a nonconformance due to a sep- .aration distance of only 90.feet from our well and with a percolator test of-8-10. It appears that since it. was .impos:;ible to conform to the "old ". sanitary codes, (and even less to the new), another test was presented at the 0-5-category permitting deletion of one of the tile fields which was slightly closer to our well and. _for the purpose of accomplishing the 100 feet distance for approval which is being appealed. It is`most im- portant to note that this soil percolation test plays .a very . important part in determining the size of the septic field and as per the Putnam County Department of Health rules, "it is essential to take into very careful consideration the highest ground. water level, time of year, surface and subsurface drainage and the proximity of rock, clay.or hardpan. NOTE: Putnam County Department of Health reported that they did not audit this percolator reading and agree /suggest that it might be well to verify. In addition, we find that tl'c County Department of Health was not aware of our sever' water problems at different times of the year or our a drainage problems. oq Mi WRP.Tl ii 'rhe standards for conformance require that sewage adsorp- tion fields be 200'feet or more away from a well at lower elevation.. The following County Department of Health 'sew- age rules state, "sewage disposal systems located of nece.s -. .zta nngrgde.- it i.he'. ner p 1rain6aP,_t0. a well 4. ;g- m should.be spaced 200 feet or more away." NOTE: �Ourwell p is downgrade and in the general path of the proposed sew= age disposal. We could not obtain a clear explanation to this waiver of sanitary standards but find it has, to do with the well not being .directly and exactly in line with downgrade contour. Our actual experience has proven that water does in fact flow in the general path and on both sides.of our well. 5) The Department of Health, State of New York and Putnam County recently upgraded ,their official standards for in-- dividual household sewage systems.ef.fective June 15, 1976. One of the significant code changes 'is tYiat all tile .-fields be 24 inches wide." NOTE: The proposal uses a 36 inch wide field which is not in conformance.. We under- .. stand that one of the early proposals.was. submitted (but hot approved) prior to this date and.the,24 inch.wide .,limit was waived,. 6) The existing well that is. located upgrade is only 75 feet from the location of the proposed system fields. NOTE: This is another example of nonconformance to the regula- tion that requires a 100 feet minimum separate distance. 7) The code also requires a 20 feet separation distance from the dwelling to the adsorption field. NOTE: This deviation. In conclusion, we judge that approval of improper sewage d.ispo -. sal or granting of variances can be a risk to the health of innocent.peo_ ple•and /or reduce their life expectancy. Please note that the 8/17/76 review notes considered waiver of the 5000 square feet, but in the new proposal this, as well as the '50/ expansion area, would be waived since the expansion area is an overlap of the proposed " same area that would be used for fields. In conclusion, we .find the new proposed plan is'grossly non -con- forming to either the new or old sewage disposal codes. In order to illustrate the complete inadequacy of the small lot, we again point out the lack in conformity to the Putnam County Dept. of Health Rules and Regulations that require "a minimal.usable area for. sewage disposal system of 5,000 square feet, or an area sufficient to provide a 50% expansion of the proposed system, ..whichever.is: larger, will be required on each building lot exclusively for sewage disposal purposes. Etc." (See page 4 and 5 of regulations). The requirements also state' "sewage disposal systems located of necessity upgrade in the general path of drainage to a well should be spaced 200 feet or more away ". Attached is a sketch of blocked -out isolation areas that show the restrictive distances required in'the regulations. Improvements were made but due to the complexity and magnitude, there still-are serious concerns that any added non - conforming septic systems or building on non - conforming small lots such as the 1/3 acre lot and with a one acre zoning regulation will significantly effect the health and welfare of our community. - There has been an informal suggestion that'our existing curtain drain (see previously mentioned contour map) will intercept any seepage to our well from the proposed,-non- conforming septic.fields. Please note that this was not the functional design or intention of the curtain drain and the curtain drain is located still further downgrade from our well. Accordingly this suggestion has no practical value and there is risk of exposing other Spruce Knolls residents. (located further downgrade) to this health risk. - The concerns that we have described are not only ours but they are shared by many of our neighbors who have experienced water problems including flooding of basements during spring and fall seasons. We expect that they also will be contacting you and other responsible parties in their objection to exposure to health and the loss of property value that would result from any such gross deviation in septic disposal or zoning regulations. Regarding zoning changes, the Town of Putnam Valley was successful in upgrading to one,acre in 1972 while previously the area involved was 3/4 acre zoning. The small'lot (about 1/3 acre) being considered is grossly smaller than - either of these zoning codes that date back about 18 years. It is worth, noting that since we purchased our home (about eleven years ago) we .always considered the small lot an extension of the owner's front lawn that was separated only partially by a dead- end road and we understand that the Town has recently identified the west end of the non - existing road as a. "paper road ". Attached is a copy of our letter to the Putnam County Department of Health that describes the probability of our well being contaminated from the proposed nonconforming sewage disposal and the nonconforming small (0.35 acre) lot size which in conjunction with the downgrade location of our home can be expected to adversely effect our exist - ing-septic system and be a health hazard to'my family and friends. This letter is submitted to each of the areas of responsibility and we sincerely request that you consider the following: _ - ".rhat'a one family dwelling is being proposed to be built on a 0.35 acre lot that is significantly smaller than the Putnam Valley 1 acre minimum zoning requirement. - That the requested variance would infringe some 41 feet closer to our property line which could.-bring the waste system that much closer.to our well. - A variance of this nature 0.35 versus the 1.0 acre zon- ing ordinance will significantly reduce our property.value. and that of our neighbors. - Water drainage has been a historical and.continuing prob- lem to Spruce Knolls homeowners and ".run -off" from the implicated lot is one of the primary sources of surface and underground water. Any change i.e. land contours, tree removal,.added water, change in water flow, etc. to this already borderline situation will increase these water problems. The proposed nonconforming sewage disposal system will only add more water to the previously mentioned drainage and run -off problems. A serious health hazard could. be expec- ted during-the spring and rainy seasons when the soil be- comes more saturated and surface run- off'is,ex.treme. , We also -note that the plan refers to a change in contour of# the land to permit installation of the sewage disposal system to conform with local sanitary codes. This can.be .expected to increase the health risk. Zoning Board of Appeals Putnam valley July 21, .1976 In our review of the overall situation.we understand that the origi- nal plan was to locate the sept;ic..system on the west side and the well on the opposite side. This plan was abandoned for some reason. Subse- quently, the.Putnam County Department of Health rejected proposed sew age disposal plan with sewage disposal on east side of lot due to its nonconformance, and later they accepted a revised plan. Unfortunately, all of the pertinent and.adverse conditions were.not properly communi- cated and an exception to some specific rules and regualtions appear to have been waived.and we are appealing.. Some specific areas of concern are as follows: 1) The minimal area required. for sewage disposal systems is not in conformance to the Putnam County Department of Health rules and regulations that specifically require: "For each sewage disposal system for a private residence a minimum usable area.of 5,000 square feet, or an.area sufficient to provide a 50% expansion of the proposed system, whichever_ is larger, will be required on each building lot exclusively for sewage disposal purposes." In review of the proposal we judge neither condition is satisfied and the larger condition, i.e. 5,000 square feet, is short of conformance by approximately 3,000 to 4,000 square feet. NOTE: We do not understand the rea- son for considering such a rg oss.exception to these health regulations. 2) Deep soil test discrepancy - the County Health Depart- ment reported a 5 foot reading to ground water while the drawing refers to "no ground water ". in their test. NOTE: The County Health Department could not explain the difference except perhaps it was a difference in time of evaluation. 11.) Theme on g jonal.:-p_1a.n,r..sbnwe_d a. nuiiC ' distance of only 90 feet from our well and with a percolator test of 8 -10. It appears that since it was impossible to conform to the "old" sanitary codes, (and even less to the new), another test was presented at the 0 -5 category permitting deletion of one of the the fields which was slightly closer to our well and for the purpose of accomplishing the 100 feet distance for approval which is being appealed.. It is most im- portant to note that.this soil percolation test plays a very important part in determining the size of the septic field and as per the Putnam County Department of Health rules, "it is essential to take into very careful consideration the highest ground water level, time of year, surface and subsurface drainage and the proximity of rock, clay or hardpan." NOTE: Putnam County Department of Health reported that they did not audit this percolator reading and agree /suggest that it might be.well to verify. In addition, we find that the County Department of Health was not aware, of our.severe water problems at different times of the year or our drainage problems. Pg. 2 vv Zoning Board of Appeals July 21, 1976 Putnam Valley 4) The standards for conformance require that sewage adsorp- tion fields be 200 feet or „more away from a well at lower elevation. The following County Department of Health sew-, age rules state, "sewage disposal systems located of neces- sity upgrade in the general path of drainage to a well should be spaced 200 feet or more away.” NOTE:. Our well is downgrade and in the general path of the proposed sew- age disposal. We could not obtain a clear explanation to this waiver of sanitary standards but find it has to do with the well not being directly and exactly in line with downgrade contour. Our actual experience has proven that water does in fact flow in the general path and on both sides of our well. 5) The Department.of Health,.State of New York and Putnam County recently upgraded their official standards for in -. dividual household sewage systems effective June 15, 1976. One of the significant code changes is that "all tile fields be 24 inches wide." NOTE: The proposal uses a 36 inch wide field which is not in conformance. We under - .stand that one of the early proposals was submitted (but not approved) prior to this date and the 24 inch wide limit was waived. 6) The existing' well that is located upgrade is only 75 feet from the location of the proposed system fields. NOTE: This is another example of nonconformance to the regula- tion that requires a 100 feet minimum separate.distance: 7) The code also requires a 20 feet separation distance from the dwelling to the adsorption field. NOTE: This distance as proposed is closer to 15 feet and another deviation. y. . 'In conclusion, we judge that approval of improper sewage dispo- sal or granting of variances can be a-risk to the health of innocent peo- ple and /or reduce their life expectancy. Dye tests that I took last year clearly indicated that water flows from Maple Ave. to Spruce Knolls in two directions. First on a line from the Scripter- Thornton boundary(f rom Maple Ave.)to the Capozolli property and through a stone wall on the Lane- Thomsen property to the Oscawana Lake Road. Water flowing from a slightly hi:gher(north)direction flows directly through a stone wall on the Scripter- Foresberg prop- erty to Spruce Knolls forming a "mini - lake ". Samples of the water were tested last year as it flowed past Spruce Knolls and again as it flowed from Maple Ave. Both.samples were found to have high amounts of (©liform by the Westchester County lab at Grasslands. Aronow " Chairman Gentlemen: Please be advised that the request for a variance to erect a one family residence on the nonconforming lot TM 55 -2 -2 is unacceptable, and under'no circumstances should this variance be granted. Attached is a copy of our letter to the Putnam County Department of Health that describes the probability of our.well being contaminated from the proposed nonconforming sewage disposal and the nonconforming small (0.35 acre) lot size which in conjunction with the downgrade location of our home can be expected to adversely effect our exist- ing septic system and be.a health hazard to my family and friends. This letter is submitted.to each of the areas of responsibility and we sincerely.request that you consider the following: That• a one family dwelling is being proposed to be built _ ~ on a 0.35 acre lot that is significantly smaller than. the Putnam Valley l acre minimum zoning requirement. - That the requested variance would infringe some 41'feet closer to our property line which,could.bring the waste system that much closer to our well. - A variance of this nature 0.35 versus the 1.0 acre zon- ing ordinance will significantly reduce our property value and that of our neighbors. - Water drainage has been a historical and continuing prob- lem to Spruce Knolls homeowners and "run -off" from the implicated lot is one of the primary sources of surface and underground water. Any change i.e. land contours, tree removal, added water, change in water flow, etc. to this already borderline situation will increase these water problems. The proposed nonconforming sewage disposal'system.will only add more water to the previously mentioned drainage and. run -off problems. A serious health hazard could be.expec- ted during the spring and. rainy s_ eason's ;w_hen;_the comes more saturated and surface run -off is extreme. We also note.that the plan refers 'to a change in contour of the land to permit installation of the sewage disposal system to conform with local sanitary codes. In our review of the cr•,oral.l: situation_ we understand that the origi- nal plan was to locate the septic system on the west side and the well on the-opposite side. This plan ,was abandoned for some.reason. Subse- quently, the Putnam County Department of Health rejected proposed sew- age disposal plan with sewage disposal on east side of lot due to its nonconformance, and later they accepted a revised plan. Unfortunately; all of the pertinent and adverse conditions were not properly communi- cated and an exception to some specific rules and regualtions appear to have been waived and we are appealing. Some specific areas of concern are as follows: 1) The minimal area required for sewage disposal systems is not in conformance to the Putnam County Department of Health rules and regulations that specifically require: "For each sewage disposal system for a private residence a minimum usable area of 5,000 square feet, or an area sufficient to provide a 50% expansion of the proposed system, whichever is larger, will be required on each building lot exclusively for sewage disposal purposes." In - review of the proposal we judge neither condition is satisfied and-the larger condition, i.e. 5,000 square feet, is short of conformance by approximately 3,000 to 4;000 square feet. NOTE: We do not understand.the rea- son for considering such a rq oss exception to these health regulations. 2) Deep soil test discrepancy - the County Health Depart- ment reported a 5 foot reading to. ground water while the drawing refers to "no ground water" in their test. NOTE: The County Health Department could not explain the difference except perhaps it was a difference in time of evaluation. 3 The or_i ; na1 �'alar showed. a ri �„ o P ly_ .ta _a_de t .. = . -ir "' - - -• -� - - -^ aration distance of only 90 feet.from our well and with a percolator test of 8 -10. It appears that since it was impossible to conform to the "old sanitary codes,. (and even less to the new), another test was presented at the 0 -5 category permitting deletion of one of the tile fields which was slightly closer to our well and for the purpose of accomplishing the 100 feet distance for approval which is being appealed. It is most im- portant to note that this soil percolation test plays a very important part in.determining the size of the . septic field and as per the Putnam County Department of Health rules, "it is essential to ,take into very careful consideration the highest ground water level, - -time of, yea -r;- .surface— and -'- subsurface - " °dra° image- and-- th-e """ proximity of rock, clay or hardpan." NOTE- Putnam . County Department of Health reported that they did not audit this percolator reading and agree /suggest that it might be well to verify. In addition, we find .that the County Department of Health was not aware of our severe water problems at different times of the year or our drainage problems. Pg. 2 2 i Y Zoning Board of Appeals July 21; 1976 Putnam Valley F 4) The standards for conformance require that sewage adsorp- tion fields be 200 feet, or more away from a well at lower elevation. The following County Department of Health sew- age rules state; "sewage disposal systems located of neces- sity upgrade in the general path of drainage to a well should be spaced 200 feet or more away." NOTE.: Our well `. is downgrade and in the general path of the proposed sew- age disposal._ We.could not obtain a clear explanation to this waiver of sanitary standards but find it has to do with the well not being directly and exactly in line with downgrade contour. Our actual experience has proven that water does in fact flow in the general path and on both a sides of our well. ". 5) The Department of Health, State of New York and Putnam County recently upgraded their official standards for in- dividual household sewage systems effective June 15,. 1976. One of the significant code changes is that "all tile fields be 24 inches wide." NOTE: The proposal uses a 36 inch wide field.which is not in conformance. We under- stand that one of the early proposals was, submitted (but not approved) prior to this date and the 24 inch wide limit was waived. 6). YT He' existing` well that is located upgrade is only 75 feet from the location of the proposed system fields. NOTE: This is another example of nonconformance to the regula- tion that requires a 100 feet minimum separate distance. 7) The code also requires a 20 feet separation distance from the dwelling to.the adsorption field. NOTE: This distance as proposed is closer to 15 feet and another deviation. In conclusion, we judge that approval of improper sewage dispo= sal or granting of variances can be a risk to the health.of innocent peo= ple and /or reduce their life expectancy. In addition, we are very con- ! cerned that a dwelling built on.a very small lot next door to our property will seriously reduce the cash and aesthetic values of our property since the distance between dwellings will be greatly reduced as well as the rural -type atmosphere and privacy for which our home was originally pur- chased.and which wou appeal to future prospective purchasers. . The letters in opposition to granting approval of'the :sewage disposal system were read as was.all the information provided by Mr. Scripter, including his request to appear before the Board prior to issuance of any approval. Mr. Frank Thiede, P.E.. appeared with_Mr. Juliano, his son and future daughter -in -law. Photos of the site together with technicial discussion and information from Mr. Thiede were presented. Following review, the .Board voted 3 to 1 to consider al- lowing the waivers if it were satisfactorily demonstrated that. the new State and County standards were maintained. The concept. that Mr. Scripter's well was endangered was not.thought valid, . except that installation of a 6 ft. deep clay barrier near the'. rear property line.was suggested to offer added diversion of. groundwater flow. Mr. Roland read from technicial information indicating that slopes of less than 8% are of less concern in ground water flow than are steeper slopes. The following waivers are being considered from the sewage. 1) 75 ft. to the uphill.Juliano well 2) 80 ft. to the proposed well 3) sewage disposal system area plus 50% expansion rather than maintenance of the 5000 sq. ft. Because of disparity between recent percolation tests by Department staff and the engineer's additional jointly performed tests should be done. The sewage system should then be designed in accordance with new standards limited only by the above noted waivers. The.Board, in summary, will consider approval upon evaluation of data pending demonstration that standards are met. Aronow Chairman Gentlemen: Please be advised that the request for a variance to erect a one family residence on the nonconforming lot TM 55 -2 -2 is unacceptable., and under no circumstances should this variance be granted. Attached is a copy of our letter to the Putnam County Department of Health that describes the probability of our well being contaminated from the proposed nonconforming sewage disposal and the nonconforming small (0:35 acre) lot size which in conjunction with the downgrade location of our home can be expected to adversely effect our exist- ing septic system and be a health hazard to my family and friends. This letter is submitted to each of the areas of responsibility and we sincerely request that you consider the following: - That a one family dwelling is being proposed to be built on a 0.35 acre lot that is significantly smaller than the Putnam Valley 1 acre minimum zoning requirement. That the requested variance would infringe some- 41._feet•.- closer to-out property line which could.bring'the waste system that much closer to our well. A variance of this nature 0.35 versus the 1.0 acre zon- ing ordinance will significantly reduce our property value and that of our neighbors. (water drainage has been a historical and continuing prob= lem to Sprucu Knolls homeowners and "run -off" from the implicated lot is one of the primary soures of surface and underground water. Any change i.e. land contours, tree removal, added water, change in water flow, etc. to this already borderline situation will increase these water problems. - The proposed nonconforming sewage disposal system will only add.more water to the previously mentioned drainage and run -off problems. A serious health hazard could be expec- ted during the spring and rainy seasons when the soil be -. comes more saturated and surface run -off is extreme. We also note that the plan refers to a change in contour of the land to permit installation of the sewage disposal system to conform with local sanitary codes. Thi.s.caft be expected to increase the health risk - ,� btir review of the overall situation we understand that the origi- nal plan was to locate the septic system on the west side and the well Qn.the opposite side. This plan was abandoned for some reason.. Some specific areasof concern are as follows': 1) The minimal area required for.sewage disposal systems is not in conformance to the Putnam County Department of Health rules and. regulations that specifically require: "For each sewage disposal system for a private residence a minimum usable area of 5,000 square feet, or an area sufficient to provide a 50% expansion of the proposed. system, whichever is larger, will be required on each building lot exclusively for sewage disposal purposes." In review of the proposal we judge neither condition is 'satisfied and the larger condition, i..e. 5,000 square feet, is short of conformance by approximately 3,000 to 4,,,000 square feet. NOTE: We do not understand the rea- son for considering such a rg oss exception to these health regulations. 2) Deep soil test discrepancy - the County Health Depart- ment reported a 5 foot reading to ground water while the drawing refers to "no.(Jround water ". in their test. NOTE: The County Health Department could not explain the difference except perhaps it was a difference -in time of evaluation. 3) The original plan showed a nonconformance due to a sep- aration distance of only 90.feet.from our well and with a percolator test of 8 -10. It appears that since it was imposSible to conform to the "old ". sanitary codes, (and even less to the new), another test was presented at the 0 -5 category permitting deletion of one of the tile fields which was slightly closer to our well and for the purpose of accomplishing the 100 feet distance for approval which is being appealed. It is most im- portant to note that this soil percolation test plays a very important part in determining the size of the septic field and as per the Putnam County Department of Health rules, "it is essential to take into very careful consideration the highest ground. water level, time of year, surface and. subsurface drainage and the proximity of rock, clay or hardpan." NOTE: Putnam County Department of Health reported that they did not audit this percolator reading and agree /suggest that it might be well to verify. In addition, we find that OV. County Department of Health was not aware of our sav01:0 water problems at different times of the year or 01�r drainage problems. - e s,t-andards for conformance require that sewage adsorp- tion fields be 200 feet or more away from a well at lower elevation. The following County Department of Health 'sew- age rules state, "sewage disposal systems located of neces- sity upgrade in the general path of drainage to a well shou1d `be spaced• .20 fee :•-- - -r:. :•��� 0' t or more away -NOTE Our well is downgrade and in the general path of the proposed sew- age disposal. We could not obtain a clear explanation to this waiver of sanitary standards but find it has to do with the well not being directly and exactly in line with downgrade.contour. Our actual.experience has proven that water does in fact flow in the general path and on both sides of our well. 5) The Department of Health, State of New York and. Putnam County recently upgraded their official standards.for in- dividual household sewage systems effective June 15, 1976. One of the significant code changes is that "all tile fields be 24 inches wide." NOTE: The proposal uses a 36 inch wide field which is not in conformance.. We under - stand that one of the early proposals was submitted (but not approved) prior to this date and the 24 inch wide limit was waived.. 6) The existing well that is located upgrade is only 75 feet from the location of the proposed. system fields. NOTE: This is another example of nonconformance to the regula- tion that requires a 100 feet minimum separate distance. 7) The code also requires a 20 feet separation distance from the dwelling to the adsorption field. NOTE: This distance ;.. as,_proposed is, c):oser_ -to- •1.5= feet = and aano.the -r deviation. In conclusion, we judge that approval of improper sewage d.ispo- sal or granting of variances can be a risk to the health of innocent peo- ple and /or reduce their life expectancy.
