Copies of this information is attached hereto. 2) The combination of required depth of deep test holes for galley systems and the presence of the above ground pool have been an impediment to providing more representative testing. 3) In our design, we have taken credit for galley end areas as same do have openings and will allow for absorption of effluent by surrounding soil ( As does the full circumference of a circular seepage pit). Other factors considered for this action are the limited total area available for sewage disposal and the need to request an additional variance for a two bedroom proposal. The south side of Juliano's lot drops approximately 3 feet to Scripter, Thornton's property. This is a low lying area with standing water at the time of inspection. The basis of same is failure to provide adequate spacing between the proposed systems and from surrounding existing systems, as more specifically stated in Mr. Rarell's letter of August 1, 1989. After occupancy, and as predicted and expected, we and our neighbors have experienced excessive water run -off as well as the occasional smell (odor) of .septic directly downgrade from the Juliano septic area on Plot TM 55 -2 -2. Fresent rules are configured to insure that new systems will not give rise to a nuisance due to an odor or unsightly appearance. This situation has worsened over the years and pre_r.erty damage has been apparent. We are deeply concerned that the water table may become contaminated. Any additional septic drainage to the already unacceptable situation will undoubtedly increase the risk to our health and impact our financial well being. Juliano supplied us for this 12/18/89 meeting has avoided all the negative aspects of the well and sewage variance requests. However, it is obvious that requests for variances in several regulations are being requested. It is very important to note that the proposed new sei:tic system for another 3 bedroom home TM 55 -2 -3 is immediately side -by -side to the existing non - conforming septic system on lot TM 55 -2 -2. Both the existing and proposed systems are immediately upgrade to our existing well and neither conforms to the Sanitary Health Code for the County and bath -systems would ?,e owned by the same Juliano family. Per the attached sketch, there are at.least three violations of the existing code: . 1) The proposed (Galley System) is less than the required 150' minimum restrictive distance from the proposed Juliano well (only 1001); 2) the proposed (Galley.or any other system) is less than the required 200' minimum restrictive distance from the existing downgrade Scripter well (only 100'); 3) The. proposed (Galley System) is less than the required 150' minimum restrictive distance from the Thornton well (about 110'). To do otherwise would place the existing downgrade residents at a severe unwarranted health risk and could jeopardize present property values. These have resulted in damage and risk to our family and neighbors health. Any further hardship arguments should take into consideration the already granted benefits. 4) We note that the natural condition of the land in the area is unsuitable for a normal sewage system. Careful consideration should be given to the poor quality of soil, very small area, high water table, run -off from high elevation north of Juliano property, Perk test discrepancies (Juliano first home), overall land contour of area, etc: 5) Existing system has expansion area capacity only at expense of further encroachment on existing Scripter well which is downgrade and in direct line of drainage, This is an important factor when considering placement of a second system on the same substandard lot. The cumulative effect of the proposed new system can further aggregate to the already non - conforming system that is in direct line of drainage to Scripter °s well. 6) The existing and proposed Juliano sewage systems can be expected to "feed directly down" into the ground water and work into our wells. We believe this is the primary reason for health regulations in protection of everyone, 7) We understand that "% downgrade slope" from well to septic is an important consideration but more important is the "direct line of drainage" that has much more significance. There is no doubt that a second.upgrade sewage system, side-by-side to the existing Juliano sewage system will be .additive to the already hazardous condition and provide significant further" risk to our :health. 2) Many variances were granted to Mr. Juliano previously to permit building even though there.was'a° acre zoning requirement. After occupancy, and as predicted and expected, we and our neighbors have experienced ~excessive water run -off as well as the occasional smell (odor) of .septic directly downgrade from the Juliano septic area on plot TM 55 -2 -2. Present rules are configured to insure that new systems.will not give rise to a nuisance due to an odor or unsightly appearance. This situation has: worsened over the years and property damage has been apparent.. We are deeply concerned that the water table may become contaminated. Any additional septic drainage to the already unacceptable situation will undoubtedly .increase the risk to our health and impact our financial well being. However, it is obvious that requests for variances in several regulations are being requested. Based.'on the facts, we trelieve this Juliano proposal should be rejected. To do otherwise!--.would place the existing downgrade residents at a severe unwarranted' health risk and could jeopardize present property values. Therefore, we respectfully.request that the Putnam Cbunty Health Board summarily reject this proposal. TM 55 -2 -3 (Juliano) 1;) Building homes in substandard lots will have impact orr, property value of--an area or adjoining properties: 2) The primary question to be - resolved is whether the merged nonr= conforming lot will support .a legal sewage, - :disposal and expansion system in addition to appropriate consideration of the non - conforming existing Juliano Septic System on the adjoining non - conforming merged lot. 3) There is no hardship case,'`,'for Juliano based on the ft et that numerous zoning and septic variances were granted in 1976 for the current Juliano residence on the non- conforming lot. These have resulted inY damage and risk to our ftmily.and'neighbors health. Any further hardship arguments should take into consideration the already granted benefits. 4-) We note that the-natural condition of the land in the area is unsuitable for a normal sewage system. Careful consideration should be given to the poor quality of soil, very small area, high water table, run -off from high elevation north of Juliano property, Perk test discrepancies (Juliano first home), overall land contour of area, etc:: 5)' ]Existing system has expansion area capacity only at expense of further encroachment om� existing Scripter well which is downgrade- and'in direct line of drainage. This is an important factor when considering placement of�a sec7ond system om-the same substandard lot.
