determinations in 2012 that no approval is required by your Department. Be that as it may, I respectfully

of house additions. At this time the Department will not require a septic system to be updated to
current codes due to proposed coifstruction over 50% of the dwelling's original square footage.

matters and evidence produced by the applicant, the Zoning inspec-
tor and interested parties having been duly heard, received and
considered and due deliberation having been had, the following are the
FINDINGS OF FACT: ,
The subject premises are located in the R -2 zone with the following setback
requirements: Front - 75'; Rear - 50', and Side - 40'; on 259 SPROUT BROOK
ROAD, which is a Town road. The applicant has requested a variance from
Section 66-31 B(3) of the Town Code required for any resident that holds a
Special Permit Use and wishes to add additional living space. The applicant
proposes to create a family room out of the existing screened porch. The
applicant has satisfied the Board that the expansion of livable space by more
than 20% as limited by Section 66-31 B(3) of the Town Code is justified. The
criteria for an Area Variance have been meta A practical difficulty exists and
such .difficulty cannot be obviated by a method other than a variance. -There
will not be a substantial change in the character of the neighborhood. This
action will not be detrimental to the adjoining properties. The character of
the neighborhood will be preserved. This is the minimum variance that will
provide relief.

THEMORE, based upon the above findings of fact, it is hereby ORDERED, that
the application or appeal be and.the same is hereby GRMM, subject to the

Department of Health, Division of Environmental Health Services letter dated
June 29, 1992; and 2) TIE APPLICANT SHALL OBTAIN A BUILDING PERMLT WITHIN 180
DAYS FROM THE DATE OF THE SIGNING OF =US DECISION AND ORDER BY THE TOWN CLM,
OMERWISE THIS DECISION AND ORDER WILL BECOME NOLL AND VOID.
The decision of the Building and Zoning Inspector is hereby reversed.

I have received and reviewed the plans for the proposed addition to the above
mentioned residence.
The plans indicate that the existing screened porch (16.5' x 14.0') is to be
converted to a family room.
The survey indicates that sufficient area exists to expand or repair the sewage
disposal system, should it become necessary in the future. Therefqre, based on
the information submitted, the above mentioned addition is approved with the
following conditions:
1. The total number of bedrooms must remain at three without prior approval by

3. All plumbing fixtures must be replaced or updated with water saving devices,
i.e., low flush toilets, restrictors for shower heads and faucets, etc.
