Mr. Levenson objected, saying the Board would not accept the topo since it was not prepared by •a licensed surveyor or engineer. Mr. Griffin, by looking at the map, stated Mr. Abend's well would be more-or less the 100' distance from Dr. Sillst- property and.was higher. Since there was confusion as to the exact location and distances from -any neighboring wells in relation to septic systems, Mr.. Levenson made a motion to send a letter to the County Board of Health and ask; them for dimensions as to how they arrived at.their approval of the sanitary layout for Dr. Sills:t in relation to all the wells in the .surrounding area. I would first like to review how the original'informa tion relative to septic locations on Abend's property was arrived at. We originally checked with the town of Putnam Valley building department records to ascertain the location of the well and sewage disposal system on Abend's property. The records did not have any fnfor_ . mation.relative.to the location. Subsequent to that, -we -made: a field inspection with Mr: Bill. Whitehill.., the. 'b6i'l'•ding inspector at that time'-an d Mr.. Whi.tehill showed' us the area he believed the sewage disposal, system to be in. The existing.well shown on the plan on the east side of Hudson View Drive is actually a well on the.property. adjacent to Mr. A.bend. This .parti- c'ular property goes all the way through to the next road-and the house is fronting on the next road to the.east. That well was apparently relatively new and the Abend•sew.age location,. as pointed out by.Mr. Whitehill,.was.used when that well was located. Since Mr. Abend is disputing the. actual location.and his information cannot be verified without digging up the system, I believe it would be:'bes.t ,to.rel'ocate Dr. Sills' well under the worse conditions'of Mr.Abend's system being located on his own property. Mr: `Rober"t'Tutoni -2 5/26/81 If part of Mr. Abend's system is located under Hudson View Drive or on Dr. Sills' property, I believe it would be illegal and he should be notified to move those parts of the system. Let's assume Mr: Abend's system is located at the northeast - corner of his property. We are adjusting Dr. Sills' well location to be 100' from that point and readjusting the sewage disposal system slightly to insure the 75 -foot separation from his own sewage disposal system.. With these changes, Dr. Sills' plan meets all of the criteria called for in the orginal approval and would meet the restrictive distance from any sewage disposal system on Mr. Abend's property. If Mr. Abend is concerned about the health of his neighbors, he should direct his efforts at''protecting the public health towards the owner of the well loca- ted adjacent to his alleged sewage disposal system. When you make a right hand turn on Sunset Rill Road entering Hudson .View Drive, you proceed one hundred feet or more up Hudson View Drive to the end of Lot .1 and then you go up a flight of stairs khich brings you to the back of my home. There, approximately twenty-five feet off the road, lies the septic tank. I would like to point out that on or about 1947 I distinctly remember as a young fellow the leaching fields to this septic system being run under the dirt road that existed at the time, onto the property opposite us which is-now owned by Mr. Bernard Sills, You.,must had :loose arrangement with'°June-- ebbor� �'~ . to acquire the land opposite the house and in effect we were placing the leaching field on what we assumed was going to be our own property. Sub- sequently the house was acquired but the particular land where the leaching field was placed was not acquired. Another leaching field was also placed .off to the right of the house in a northerly direction. It is my understanding from you that Mr. Sills' plans show my septic system to be in the front of my house which would be at the beginning of Hudson View Drive, If this is true, it is incorrect. I am kind of amused by this because some time ago I found Mr. Sills on my property inspecting the cover of a shallow well located.in the front of my property which he presumed to he my septic system. There is'also a flight of stairs leading from Hudson View Drive directly in line with this well in the front of the house, so, do not be confused by the facg that he might have but a flight of stairs on the map because there are two fUghts of stairs on Hudson View Drive leading to the house, one in the front and one in the back. I confirm that all of the aforementioned is true, and these facts are being submitted to you in order to correct what appears to be some improper !'facts" previously submitted to you on behalf of Mr. Bernard Sills. ROBERT TUTONI May 12, 1981: Indidenta,lly, I understand that Mr. and Mrs. John Smith who live directly west of Mr. Sills on Sunset Hill Road have applied for a well permit on the most easterly part of their property which would place them very close to Mr. Sills' property. I understand further that there is a hold on this application pending the outcome of the Sills case. I don't see the validity for such a hold as, in fact, their current well is giving them problems sufficient to cause them to have to drill another well and, in view of the fact that they are year round residents not relying on any summer water utility, it would seem to me that their reason for requesting such a well permit constitutes a true hardship and should be acknowledged at once. Furthermore, they are tax payers on a dwelling unit, not on a piece of land, and I would say that Mr.,Sills or anyone else would have to subordinate his position in such a situation, and I strongly object to the hold placed on.their application because this kind of precedent could effect anyone else, including the undersigned. I urge that you lift the hold for this permit because I think there is a very powerful application in favor of the Smiths, according to the existing laws, that could be applied here. I do hope the aforementioned information concerning the Smith application will cause you to investigate their matter further so that you can ascertain whether or not their application for the'well permit can be granted post haste.
