The above property was once serviced by a seasonal water system owned and operated
by the Wildwood Knolls Improvement District. Due to deterioration of the District's
_
infrastructure -and _excessi - P.nrtero ional Ccsts, t'he systenn -,,,as abandoned and discontinued;. ":. -
Those whose sole water source was the seasonal system were therefore required to install
wells. The above property was among those so affected.
According to a Deed Restriction filed with the Putnam County Clerk in July, 1997, your
Department referred the owner's well permit application to the Putnam Valley Town Building
Inspector for comment. The Inspector, according to the document, recommended that no well
permit issue until a septic system "adequate for year round use" was installed (the property is
surrounded on 3 sides by Lake Oscawana, is barely % acre in size and, as shown later, is prone
to flooding). As an accommodation to the former Owner, the Inspector withdrew his objection
to the well permit provided the Owners filed a deed declaration restricting use of the property
to the seasonal period formerly serviced by the decommissioned water district. The July, 1997
Deed Restriction (titled "Easement ") does precisely that, adding that the restriction will end
"Upon. installation of a sewage disposal system adequate for year -round use, in accordance with
plans approved by the Putnam County Department of Health ". A copy of the Deed Declaration
is enclosed.

^Last year Mr. Kenneth Geraghty, writing in behalf of his mother Marion Geraghty, (a co-
owner of the property), asked the Town to release the seasonal- occupancy restriction.
Acknowledging that the property's limited size and location prohibited a "board of health
compliant system ", Mr. Geraghty nevertheless maintained that the seasonal occupancy
restriction was "unreasonable" and that his mother agreed to the restriction "under duress ". A
copy of Mr. Geraghty's May 13, 2011 letter to our Town Attorney is enclosed.
Mr. Geraghty's May 13, 2011 letter was circulated to the Putnam Valley Town Board,
the Town Engineer, and myself for review and comment: It was our unanimous view that the
seasonal occupancy restriction was appropriately imposed, and that it should remain
undisturbed until the condition for its release is met. Mr. Geraghty was so informed in an
August 5, 2011 letter from the Town Attorney, which noted that since the restriction was filed
in 1997 the State had designated Lake Oscawana as a 303 -d impaired waterbody.
Mr. Geraghty was advised to consult an engineer with a view toward exploring alternate septic
technologies.
Nothing further was heard from Mr. Geraghty until last week when, in an email to the
Town Attorney, Mr. Geraghty reported a conversation with an unnamed "engineer at the
Putnam County Health Department." According to Mr. Geraghty the engineer stated that
"Septic System codes enacted subsequent to 1930 do not apply to this property", and that "...
the Department of Health will not be able to approve a septic system for year round occupancy
hecause the property_ already has the right to year round- occupancy". A copy of Mr. Geraghty's
email is attached. Mr. Geraghty added that the Town did not have the "right" to impose the
seasonal occupancy restriction, despite the site's acknowledged inability to support a septic
system adequate for year -round occupancy. He again requested release of the restriction.
Following receipt of Mr. Geraghty's latest email we reviewed the Town Assessor's file
and found an assessment reduction petition signed and filed by Mr. Geraghty on May 25, 2004.
The Petition, along with an "Addendum" signed by Mr. Geraghty, states:

4 ... The appraiser [who had appraised the property at a higher value than that petitioned
—for by Mr. Geraghty] ... was unaware of the seasonal flooding, sewage disposal .
problems and water restriction.
5. It is estimated to cost about $10,000 to bring add [sic] sufficient landfill to cure the
flooding and install a modern sewage disposal system"
The Assessment Reduction petition, based on the above submission, was granted.*
By Mr. Geraghty's own admission, the site simply cannot support year -round occupancy .
unless the septic system is appropriately upgraded. The very same health and safety
considerations which resulted in the occupancy restriction 15 years ago remain unchanged and,
if anything, have now been fortified by Lake Oscawanas' 303 -d "impaired waterbody"
designation.
While the authority to release the Seasonal Occupancy restriction rests solely with the
Town, the tenor of Mr. Geraghty's email suggest that your Department might (or does) support
its elimination. Would you please inform us as to your Departments' position in this matter?

WHEREAS the Property Owners are not currently in position to
install an approved sewage disposal system adequate for year round
use, within the time frame needed to arrange for their own well as
a supply source for the summer season this year, and
WHEREAS the Town Building Inspector is willing to withdraw his
objection to the issuance of a well permit for these properties
provided that the Property Owners grant an appropriate perpetual
easement to the Town, in the form required. for the filing of a
deed, allowing the Town to restrict operation of said well to the
seasonal period between April 15 and Election Day each year until
such time as the Property Owners install an approved sewage
disposal system adequate for year round use.
NOW THEREFORE the Property Owners and the Town agree as
follows:
1. The Property Owners hereby agree to hay.q operation of the
well restricted to the period between April 15 and Election Day
each year ( the same as the seasonal service provided in the past by

use. To provide a means of restricting operation to the above
period, the Property owners agree to provide a Lockable Switch at
an accessable location on the electrical power line to the well.
2. The Property Owners do hereby grant a perpetual easement
to the Town to enter and reenter upon their above property for the
purpose of giving full force and effect to the agreed -to
restriction of well operation to the period between April 15 and
Election Day, including, at the Town's option, installing a padlock
on the Lockable Switch.
3. The Property' Owners also agree to notify the Town when
they receive approval from the Putnam County Department of Health
for a permit to construct a sewage disposal system adequate for
year -round use, and to provide the Town the opportunity to inspect
the system during its installation to assure that it complies with
the approved system plans.
4. The Town hereby agrees not to install its padlock on the
Lockable switch earlier than Election Day each year and further
agrees to remove said lock no later than April 15 of each following
year.
5. The Town also agrees that upon installation of a sewage
disposal system adequate for year round use, in accordance with
plans approved by the Putnam County Department of Health, the Town
will provide the Property Owners, or their heirs and assigns a
document indicating the Town's agreement to vacate this easement.

BE IT RESOLVED, that the Town Board of the Town of Putnam Valley will approve the drilling
of a well on Town and /or District property, TM #62.10 -2 -4, for the purpose of providing one (1)
resident with seasonal water, in accordance with prior water delivery schedule.
IT IS FURTHER RESOLVED, that the cost of drilling this well will be amortized to this user at
an annual rate not to exceed $585.00, which will also include annual operating costs.
Seconded by Councilman Ferrante; unanimously carried.
