Public Health Director JOHN KARELL Jr., P.E. Director I have received and reviewed the plans for the proposed addition on the above - mentioned residence. The plans indicate that the addition will be a new 16' x 13' bedroom. An existing bed- room will be converted into a dining room. The proposed addition is not considered by this Department to be an additional bedroom, or will it result in a potential increase in occupancy. A review of the survey indicates that sufficient area exists to expand or repair the sewage disposal system., should_. it-become necessarv^:in the future. Member Sol Lirtzman ...........:......Secretary The matter he.ving duly come on to be heard before a duly convened meeting of the Board on the 2nd day of March 1989, and the facts, matters and evidence produced by the applicant, the Zoning Inspector and interested parties having been duly heard, received and considered and due deliberation having been had, the following are the FINDINGS OF FACT: The subject premises are located in the R -2 district with the following setback requirements: Front - 75'; Sides - 40', and Rear - 50'; on Bell Hollow Road, which is a Town road. The applicants have satisfied the Board that the expansion of livable space for a proposed one -story addition by more than 20% as required by Section 66 -23 B of the Town Code is justified. The criteria for an Area Variance have been met. A practical difficulty exists and such difficulty cannot be obviated by a method other than a variance. There will not be a substantial change in the character of the neighborhood. This action will not be detrimental to the adjoining properties. The character of the neighborhood will be preserved. This is the minimum variance that will provide relief. A short EAF has been submitted as per SEQR requirements and a negative declaration is in order since it appears that there will be no major impact on . the environment. THEREFORE, based upon the above findings of fact, it is hereby ORDERED, that the application or appeal be and the same is hereby GRANTED, subject to: 1) Approval of the Putnam County Health Department for the septic system prior to the issuance of a Building Permit; 2) The applicant shall obtain a Building Permit within 180 days from the signing of this Decision and Order by the Town Clerk; 3) Substantial compl2ticn �irhir 12 months of 'the 'date of the issuance of the `Building Permiti 4) An "as- built" survey of the entire property must be submitted to the Building Inspector prior to the issuance of a Certificate of Occupancy; 5) A Certificate of Occupancy must be issued within two years of the date of the issuance of the building permit, otherwise this Decision and Order will become Null and Void.
