At the time of inspection the sewage disposal system was found to be still failing. Let me remind you that this consitutes a violation of Article III Section 3 of the Putnam County Sanitary Code. You were advised of this violation on May 7, 1987 by this Department. Althought considerable exploration has been done to this point-by- Mathew Noviello; P.E. and Associates, and by John Romeo, P.E., no re- pairs have been made at this point and the violation still exists. The construction compliance issued for your residence clearly states that "Any person occupying premises served by the above system (s) shall promptly take such action as may be necessary to secure the correction of any unsanitary conditions resulting from such usage..." The engineering reports submitted by Noviello and Romeo concur on several areas. Therefore, I see no reason why repairs cannot begin within a reasonable time period. February 26, 1988 The following is a brief summary of the event relating to the failed septic system located on the Wint Property 188 Bell Hollow Road, Putnam Valley. In July of 1984 a septic system designed by Mr. John Romeo and installed by Mr. Austin Stellato was put into place on the above named property. the spring of 1985 that system was failing and we reported leaching to t Putnam County Board of Health. Upon request, a health official was sent out to inspect. He determined that indeed there was a. severe problem. T official who conducted the inspection was Mr. Bob Tutoni. Mr. Tutoni al was the official who signed off on all of the initial approvals for the septic system. Mr. Tutoni is presently serving a jail term of three yea for taking bribes. In the spring .of. _ 1985, .. _ Mr. Tutoni order Mr. Romeo_ and. Mr.. Stellato -to.. ir 3:S �sd3 tional -° "pits °e -;:o - render °'the -original termed it. Mr. Romeo and Mr. Stellato were both under a guarantee for t years on the septic system and therefore the repairs were made at no expense to us. There was a question as to whether the solution that Mr. Tutoni suggeste was a longterm workable solution, or merely a band-aid approach. As it turned out it was indeed a "band -aid" approach and Mr. Tutoni knew it. insisted on a five year guarantee, signed by both the engineer and the excavator. Perhaps he knew that he would not be around to have to deal with the consequences of a repair plan that he knew would ultimately fai again. In May of 1987 we again reported leaching to the Board of Health An inspector was sent out to investigate, at my request. This time a violation was issued by Mr. Bill Hedges. He indicated that he knew the failure was not our fault, however, the rules dictated that he must cite our premises. At this point, frequent attempts were made to contact Mr. Romeo and Mr. Stellato. I was unable to get a response from either one them until sometime during the summer of 1987. They met on my property with an official from the Health Department. The meeting was fruitless as Mr. Stellato claimed that none -of it was his fault, and Mr. Romeo claimed that the real problem was ground water running off of my drivewa For some unknown reason, the Health Department chose to support Mr. Romeo's claim and instructed me to take measures to divert the ground water away from the septic system. At that point, I wrote a letter to t b Health Department, indicating that I would not under any circumstances take Mr. Romeo's advice on this matter, since this was the second. time ,r that his design.had failed. In addition I advised that we had spent upwards of $20,000 to divert ground water since the initial installatio of our septic system. Less ground water runs now than did when the syst was designed by Mr. Romeo. It was clear that Romeo was playing games. then had no choice, but to hire an engineer to analyze the entire situation and offer a professional opinion, together with plans for a rebuild. It was clear to me that Mr. Romeo was not willing to honor his responsibility as stated in the guarantee, and that in order to have the violation lifted, I would be required to pay for a new system' and sue Mr Romeo for damages. A lawyer from the Goodhue, Arons and Banks, in Mt Kisco was hired by us to look into the matter. Mr. Romeo and Mr. Stella were advised that we would be seeking damages for the reconstruction of our septic system. We then set our. together with our engineer to determi the real problem. To our surprise and disappointment, we were advised that the primary reason for the system failing, was the nature of the soil. It was stated that the soil was "impervious, very clayish1. Numerous soil test were performed, and it was determined that the perc rate, that it became obvious that gross negligence, and possibly fraud, was involved. Mr. Romeo had indicated on his plans preparde in 1984, th the perc rate for our soil was 11 -15 minutes. Our engineer determined that the perc rate was upwards of 120 minutes at least. Again, these tests were performed at various sites on our property and none of the to rendered figures any lower than 120 minutes. Our engineers set about the task of trying to design a system that would work in such soil. The Board of Health was notified off their initial findings and indicated willingness to cooperate. It was partly due to negligence on the Boards part that the system was so.poorly designed and executed. My engineers proposed a plan that was extensive and costly. However, th assured us that they were prepared to guarantee it fully. The plan was presented to the Health Department for review and approval and they refused to approve it.They insist that the reason is because the plan calls for 10rawsewage to be brought to the surface". This is a gross over - simplification of the plan. Basically, the plan involves layers of sand that would do the j o b of purifying, that which cannot be done by the soil. The water or effluent that would rise to the surface, would be clean water. On more than on e occasion, a Health Dept. official has noted how expensive the system i and how difficult to maintain. I am curious to know what concern it is the Health Department, as to how much I have to pay, except that they kn that ultimately John Romeo will be required to pay the cost. It was als surprising to me, that when my engineer met with health department officials to discuss the new plans, they told my engineer to revise the plan to their specification and not to worry about guaranteeing it. Therefore, the health department would have it so that I, the consumer i this case, would be left with no guarantee at all on a twice- failed system, where clearly there was wrongdoing on the part of the original engineer, excavator and health official. It is my firm belief that the Health Department is not about the business of serving the public inter here, they are.serving the interest of their local "boys ".Wiuthin the n I few days I will be scheduling a conference with all of the players involved in this matter. There will be representation by all sides. It is my hope that, we will be able to resolve this matter favorably. Howeve in reality, I fear that such will not be the case. It is my intent to seek assistance from a New York State Board of Health official. I will ask that this person come to my home to review the matter, the plans tha have been proposed and to if necessary override the County. Board of Heal on their rejection of what I believe to be a workable plan for my septic system. It is also my intent to report this matter to the New York Stat Board of Education Professional Discipline Division. Mr. Romeo °s gros negligence has cost us a great deal of money, emotional stress and time. At present, we are required to relocate for work - related reasons. Our house was on the open market for sale. We have been forced to take it o and the prospect of sale anytime in the.near future looks grim at best. It is my intent to go to whatever lengths necessary, to secure the value of my property and to see to it that this time, a truly operable system installed.. The band -aid approach that the Health Department of Putnam County.is suggesting once again, -simply is not good enough. s4 PETER C. Show diversion of surface drainage off the driveway away from the SSDS, preferrably with curbing but at least with a Swale. 2. Show reconstruction of the curtain drain first. 3. Resubmit design to eliminate that portion of the curtain drain which is below the system and the sand between the trenches and the curtain drain, i.e. show a conventional design. _ d -2- At this point, an investigation of the system was made as follows! 1. Two deep holes were dug, number 1, at the base of the SSDS was dug to a depth of 7 feet and hole number 2, outside the SSDS to the south was dug to a depth of 3 feet. Soil percolation tests were performed at the bottom bf each hole and soil characteristics were observed. The soil in hole number one is characterized as sandy silty loam with traces of clay. The percolation test, was performed roughly, but indicated a 7 minute rate. The soil in hole number 2 was also characterized as silty sand loam with more clay however, than in hole number 1 and mottled. Percolation at the bottom of this hole was poor. It is noted that hole number 2 is outside the sewage area and this soil may have been spoils from the driveway or other construction and later compacted. The soils in hole number one showed no such compaction. 3. Inspection of the area where the sewage system had been overflowing previously indicated that the overflow was not occurring at this time. A discussion ensued with all parties to discuss the results of the investigation, the next step and target dates. The following was the agreed course of action by all parties. 1. A construction sequence would be followed where one step would be performed at a time and the system observed after the work in each step completed to determine if the next step is necessary. 2_ FIRST STEP (a) Replace the curtain drain to full depth of 7 feet on three sides of the system. Also, at this time the J -Boxes will be set properly, baffles installed in distribution boxes and the seepage pits di °sconnected from the system. (b) Check at least one trench for clogging of the perforated PVC pipe with silt. If no significant silt encountered; no need to continue. If significant silt encountered, clear that Ijnc. and inspect all other lines. (c.) Regrade lover portion of the property belov the system to eliminate the lov spot. (d) Provide a svale or curbing between the drivevay and the system to prevent surface drainage from entering the system 3. .SECOND STEP (a) Remove-existing system to a depth of 4 -5 feet and replace trenches ROB fill. 4. I would. first like to give a history of the above system. It originally was designed, for Mr. Lawnicak in 1980 with the'. system designed. just below the d.rivewayin front of the house at a very.., high elervation. The area had a very high water table and. prelimary ditching indicated. that curtain drains would lower the water table. A permit was issued, for Mr. lawnicalt/ Some years later, I was informed that the property had. been sold. -and_ anew- permits were to be obtaired_o_ ._At .that, time - -I_ was; info that the se cs wanted to be installed, at a lower elevation than the original permit as the area was much flatter. I had, test holes dug and.found similar soil. This time tests were made after a driveway had. been graded and ditching made. Tests i again showed. that slow draining soils with proper curtain drains would, be necessary. System was installed at the lower elevation, but I belive that soils were compacted. during construction and, made less permiable. This system was found. to be not functioning properly one year later and, together with Mr. Tutoni, it was decided to construct two leach pits at the upper level, with the lower lever to be utilized, as an overflow. These worked. fine from July 1985 through 1987. This would. indicate that during normal rainfall periods, there would, be no problems. The late winter of 1986 and. spring of 1987 were extremely wet and many septics showed distress in Westchester and Putnam Counties. Additional I was informed, later that this area along Bell Hollow Road, has many springs develop during heavy rainstorms, and, that septics on both sid.es of the Wints had, problems because of the springs. i� r, S. The wash areas in the vicinity of the center distribution box, midway up the..slope show the amount of water being directed, down this channel- _ I therefore propose that prior to any work being done on the septics, the the drainage from the driveway, patio and, turnaroun d, areas be properly collected. within a closed drainage system and. directed .. away from the septics- I propose that a catch basin be installed. at the gutter location to collect all the water, and, this being then placed, in a pipe (min 12" CMP) along the edge of the driveway to a point past -- the leach pit locations- This pipe to be placed. on stone,(washed gravel) to collect any water that may seep out of pipe or water encountered, in ground. Dear Mr. and Mrs. Wint: your ..= req�a.e -st- we - exam-in-ed the; failed' "'seffic'system� servicing the above referenced property on September 3, 1987. In evaluating it we conducted a visual inspection of the various components of the system, performed percolation tests in the original area intended for the septic system and in the area where the system was finally installed, and ran a sieve analysis on the soils in the original area and in the final area. The results of our examination are as follows: 1. The bedroom count of the house was verified. The house has only three bedrooms and the system was designed for a three bedroom house. 2. The house was examined to see if a garbage grinder had been installed in the kitchen sink. It was found that no such device was presently part of the waste disposal system. 3. The driveway apron has been swaled and is diverting a small amount of run -off into the original proposed area. However, this run -off does not appear to be reaching the area where the system was actually installed since the flow encounters a curtain drain and a driveway before it could reach the septic area. I 4. The junction boxes between the septic tank and the leaching pits lacks a baffle. A baffle should be placed here because of the steep slope of the inlet line. 5. The junction box between the leaching pits and the fields should also have a baffle for the above outlined reason. 6. The concrete boxes in the field area were found to be Distribution Boxes, as opposed to Junction Boxes; Several of these were installed backwards. This is a minor problem and may not cause problems. An inspection of the boxes revealed a sedimentary buildup on the bottom of the boxes and the field pipes. This condition may be a result of the water stagnating in the trenches. 7. The fields and Distribution Boxes were uncovered and checked. Our inspection showed that there was sediment on the bottom of the boxes and fields. However, we could not determine if the sediment was household solids or organic growths. 8. Our examination of the trenches revealed that for at least one lateral, an insufficient amount of gravel was used. In fact, for the lateral checked no gravel layer was found beneath the perforated P. V. C. pipe .for at 1 east-- 10- :.f -ee.t- if ro —: _.- _ direction. In the other direction there was adequate crushed stone. 9. Percolation tests performed by our office showed that the quickest percolation rate for the soil at 24" below the ground's surface was 67 min. per inch. Of the four holes dug and tested, two did not empty at all during the pre -soak period. Of the two that did empty, the percolation rates for one was 6 -7 min. per inch while the other, when tested, showed no absorption capacity at all, the percolation rate being well in excess of 120 min. per inch. These two holes were on the slope, in the area originally intended for the septic system. The percolation tests in the flat area at the bottom of the slope where the system was installed yielded the following results. The water in the first hole dropped only 2 inches during the pre- soak after two hours. The actual rate was timed at that point and found to be over 180 min. per inch. At this point the top of the water was only 4 inches below the surface of the ground. 1) The `second hole in this area dropped 5 inches during the pre -soak after two hours. At that point the top of the water was only 9 inches below the surface of the ground. The rate of drop was measured at that point and found to be 56 min. per inch. The water in both these holes never dropped to the 21 inch level thereby making it impossible to run a standard percolation test on the soil in this area. However, it is obvious from the slow rates of drop during the pre -soak that percolation well in excess of 60 min. per inch would have been encountered 21 inches below the surface of the water. 10. Sieve analysis of the soil from the original proposed area and from the area where the system was installed were conducted. The results are attached and show that the soil is predominately a clayey -silt. Soils of this type usually have little absorption capacity. These comments represent the inadequacies of the system found during our inspection. However, additional information is needed before we can design a system that will work in this poor soil. It is recommended at this time that deep holes be dug in the proposed and final area so that the various soil layers can be examined. Romeo, PaE., Howard Greygert (with his.backhoe) and I met at your property to continue our investigation into why your septic system failed. We found the following: SUMMARY The seepage pits should be plugged off and the pipe reconnected directly to the septic trenches then a new perculation test should be done in the septic trench area to see if the soil can absorb the septic water. Additional construction defects were found verified, -I=NSPECTION-:_ 1. When we arrived the septic trenches were again flooded out. . The last three junction boxes were under water by as much as one foot. However, there were several frogs swimming in the.!' water!. Normally frogs will avoid septic water and only swim in potable water. We suspected that the soil in the area of the trenches was being saturated with natural ground and rain water runoff. 2. The plans show a curtain drain along the east side of the trenches, between the trenches and the driveway. We wanted to verify the construction of the curtain drain. We excavated the curtain drain at two points to see if it was constructed properly. The first excavation was at a point about twelve feet south of the junction boxes for the trenches. The second excavation was at the north (upper) end of the curtain drain. In both places the curtain drain was approximately 3' 6" deep. The plans called for a 7' deep curtain drain. At the north end, the curtain drain pipe was a few feet higher in elevation than the septic system trenches, 1 P Or. .The P.V.C. pipe was installed upside down, with the holes up. This will tend. to result in si_lt., s.et.tleing..to the. bottom of �• °° tfie prpe an -plugging' "'i`t': ' I f fhe- "ho'res were "down" the silt would` more likely have.settled on the bottom of the trench. We left the excavation open for several hours. After about one'hour.a puddle of water had accumulated at the bottom of the first excavation. The soil on the sidewalls below the curtain drain pipe was moist. The soil above the pipe was noticably drier: After about 3 more hours the puddle appeared to be decreasin i e indicating t o e, er was eing a sor e y the soil at tha bottom of the o e. I believe the curtain drain was effectively draining the natural ground water in the. soil above the drain but that it was constructed improperly and should be reconstructed at a depth of 71 . as originally planned. 3. We suspected that runnoff water was saturating the soil in the trench area. We dug an open trench .along the north side of the septic trenches in the east west direction. Since this area is up hill from the trenches, so we made the trench deep enough to be sure we were at a level below the septic trenches. The northeast end is the highest corner of this area. We made the trench 8.' 6" deep on the northeast corner. The trench flows to the west 'and eventually comes out on the ground level near the .front (west) property line. The soil in the. side walls of this trench were not as wet as we had anticipated. After a half hour_ a small amount of water did start to trickle in, at three or four places. -However, 'due to the fact the 'trench was left open after digging, in addition to stopping ground water, it will act to block rain water flowing along the surface downhill towards the septic area. The trench should be converted into .a curtain drain with a swale.alo.ng one side. . 4. I.lifted the covers on the junction boxes on the side of the hill before and after the seepage pits. Again as in my last inspection, the lower box (after the seepage pits) had water steadily trickling out of it. The juction box before the seepage pits, again was dry. This leads to the assumption that the seepage pits may be gathering ground water rather than dispersing septic water. The.seepage pits should be disconnected from the septic system. 5. We 'were concerned about the apparant siltation that was noticed in the junction boxes in the septic trench system. In order to determine if the trenches were congested with such deposits, we excavated and inspected the south end of the first three trenches. All three.were congested. The congestion will certainly lower the effectiveness of the 0 ... �A Z.)._ , trenches and I am still considering'whether to recommend the a- ze.nche.s -..be. -. rep; l awe ed ,.:...,.:M,ost:w..trou,bl.ao,me .i,s. ._that_ .w e:_ have figured out what has caused the deposits. The iuction box immediately after the seepage pits does not have any deposits._. There may be a fracture in the pipe between the junction box immediately after the seepage pits and the first junction box in.the septic trench area The pipe should be replaced when the system is repaired. CONCLUSIONS: 1. There were excessive amounts of clean water in the septic treches. The clean water most likely came from natural runoff. 2. The curtain.drain shown on the plans between the driveway and the septic system trenches was constructed improperly. It should be corrected. The bottom of the curtain drain must be below the bottom of the septic trenches. 3e Another curtain drain and swale along the north side of the septic trench area would only help keep the natural water out of the septic area. If this area is used for in the future, a 4" perforated P.V.C. pipe should be installed in the open trench and the trench should be filled with 3/4" washed gravel. A swale should be constructed along the side of the new curtain drain. -4. The seepage pits on the hill should either be closed off and plugged up or a. curtain drain deeper than the bottom of the pits sho.uld be installed up hill from the pits. 5: The septic trenches may..- have:to_ be:'er)tirejy...rcpl_ace.d .due.::, to the siltation congestion found in the trenches. 6. The pipe from the junction box on the hill after the seepage pits to the first junction box in the septic trench area should be replaced. i7. It will be most economically efficient to reuse as much of t e existin g Y as system possible. If we have to move the system to another location much expense will be incurred to remove the trees and .stumps.. The question remains whether after the natural water is diverted from the septic area will the soil in the septic area has the ability to absorb the septic water? The seepage pits should be disconnected (see no. 4. above) and another perculation test run. If the soil still perculates over 60 minutes per inch after the seepage pits are disconnected and now that the trench to the north is dug, we will have to look for another location for the system. In addition the house was designed with the driveway on the left side of house with the curtain drain and fields directly in front of the house approximately in the area now utilized by the driveway. A few years later Mr. Heady called me and said he now was working . on the excavation and we went.over the septic installation with him. I did not hear anything for some time when I was called by the Wints who asked that I renew the septic permit for them. He toldme he had his own excavater Mr. Austin Stellato who was going to do the septics and excavation work. I never had heard of Mr. Stellato previous to.that time and knew nothing about his experience with septic installations. I met with Mr. Stellato who stated that he did not want to install the system on top because the driveway was now designed on the right side of the house but wished to utilize the lower area near Bell Hollow Road, as there was less pitch there. I told Mr. Stellato that I always tried to install systems as high as possible, because low areas always collect more water. However, if he could prove to me that the soils were simimar or better than the upper soils, I would redesign the system. I had seven foot deep holes dug with no water encountereed. 4 J.'03. ROMEO. Howver, having seen ground water when I was first on the property. with Mr. Valentini, I designed seven (7)-foot curtain drains above the septic system. After getting the redesign approved, ItDld the Wints to have the septic installer call me prior to installation so I could go over the system again. I did go over the entire installation with Mr. Stellato and asked him to call me when he was going to start the system. Soils °in this area were critical and I said I wanted the least disturbance to the area so as to limit any compaction. I was called after the system was installed. I was shown the top of the curtain drain and the outlet, which indicated water was being picked up.I located the boxes and the ends of the fields. Area had,been regraded somewhat with the southerly end raised. I checked the stone around the pipes near the boxes and found that is was in place. This was all shown on the as built plan. Approximately one year later, Mr. Tutoni called me and saidthere was trouble with the system and he wanted me to meet with him and he would tell me how to. fix it,- • I -:d:d -meet. with Mr. Tutoni_ -Mr-:° Steilat�o"--and 'was—.told`- that "`he�(lVlr:' "T "utori l) wanted two��.. leaching pits installed and he laid out the location and size of pits. I had no input into this decision and followed exactly what Mr. Tutoni wanted. Mr. Stellato installed the pits and I had to pay for the material and labor. In addition Mr. Tutoni had me sign a 5 year guarantee, which I have never had to sign before. I was notified that this would have to be done or it j would become difficult to get approvals of other systems. The system was in place in the summer (July) of 1985. Nothing was heard for the remiander of.1985, all of 1986 and the early months of 1987. We had a very wet fall in 1986, winter 1986 and spring of 1987. Many a-tc systems were having difficulty with the rains in these months. I was notified in the spring that problems had again developed. I went to the job site a number of times and finally Mr. Stellato sent some men to excavate for the pits and boxes. The boxes were not located by hand as the tie pole had been replaced and we were not able to find boxes. Finally, Mr. Stellato opened.. up the boxes without me being present. NEW YORK 10588 914-737-1056 - 3 - I was afterwards notified that Mr. Matthew Noviello had been retained as an engineering consultant by the Wintse After some discussions with Mr. Noviello,' I called him and said desired to have my own excavator go onto the job site to do some exploratory excavations, ; On October 6, lg °7, i, together with Mr. Noviello and Mr. Howard - Gragert met at the site. We had Mr. Gragert locate the.existing curtain drain in two locations. One excavation was near the roadway between the fields and near-the first junction'Box. The curtain drain was a maximum of 3'61' deep and not functioning properly. Approximately 5 feet below grade water began seeping into the excavation and began slowing filling. However, a short period afterwards, the water began percolating steadily into the soils below and water was being dispersed as rapidly as it was coming into the area. All this happening at a level, below the first field level and below the bottom of the curtain drain installed by Mr. Ste,_latoe The second excavation was quite a distance from the first field installed in the northerly trench. This again a 3' -6" curtain drain with the bottom of curtain drain above the fields installed. r We then had- Mro - Gragert : excavate" "a ' deep ' - trench dia:9'6hally" from _. the northernproperty line near the front, to intercept any possible drainage runoff from the driveway area where the driveway begins curving . After some time water began percolating into this trench and some of the sides began sliding into trench. The two junction boxes in the slope between upper and lower driveways were also opened. The upper box, from the �eptictank showed no water entering from the tank. The lower box, after the seepage pits, showed water entering from the pits. Thus, the pits wereallowing water to leave even though no water was entering. This can only mean that the pits are picking up water from the ground, which is not septic water. The boxes were all opened and examined. The trench areas between the boxes had been open for many months with water observed in this area. However, we also observed that many frogs were living and swimming around in these water pockets, adjacent to junction boxes. NEW YORK 10566 914737.1056 _ 4 _ The area beyond the last junction box was opened and the water trapped by the junction boxes and trenches was allowed to run into the area beyond the boxes, which was still the original ground and not disturbed by the septic installation. This water was observed being absorbed by the original ground until all possible water that could excape from the trenches -was eliminated. The water remained in the area and did not run over.the ground to be eliminated. All the junction boxes having been opened, silt was found settled in the bottom of the boxes. Water was running into the boxes in.a steady stream even though we hid previously observed no water in the first junction box after the septic tank. We then opened the ends of three (3) fields at the south end and found some silt in the bottom of the pipes. Mr. Noviello and I discussed the origin of the silt. At the time we formed no conclusion. On further reflection,.I believe the silts are the result of having exposed the boxes, the area ' has been kept open for many months. The cover of the boxes is not a tight fit with the box itself. Thus the rains over the many months probably washed silts into the boxes. The continuing infiltration of water then washed some of the silts into the fields. CONCLUSIONS: o ' 1. The curtain drain was not installed correctly by Mr. Stellato. �. The seepage pits appear to be- picking up ground water in the area and carrying it into the fields below. 3. The capacity of the existing fields to function properly has been diminished by the infiltration of silts. . The ground in the septic area was able to absorb water, with the observation of water percolating after digging a deep trench below the adjacent 32 ft curtain drain, and also by observing water percolating into the ground beyond the last junction box. RECOMMENDATIONS: Q Existing junction boxes should be cleaned, and an attempt made to clean out existing fields by flushing with a hose,.after ends are exposed. We first saw our home..in;.July 1983. We drove up the same driveway that is here today. At that time it had not been paved with asphalt. 2. I first spoke with Mr. Romeo in the early Spring of 1984. I asked him to meet with me and my excavator, Austin Stel- lato. On May 9, 1984 I gave Mr. Romeo a check for $75.00 which he requested as a condition to begin work on a re =� vised septic system. Mr. Romeo speaks as if Mr. Stellato wanted to change the location of the system. This is nonsense. I met with both Mr. Romeo and Mr. Stellato on the site in May 1984. I requested that Mr. Romeo ex- plore the feasibility of moving the system. He then in- structed Mr. Stellato to dig some deep holes and showed him where to make them. I was there while he did this. Mr. Stellato returned several days later and dug the holes, Mr. Romeo told me several weeks later that the perc tests were fine and that he was drawing up a new plan. Our drive- way was still where it was when we first saw the house. I simply did not want all of the trees in front of my house cut down as Mr. Romeo's original plan required., 3. Because we had a snowy winter and a wet Spring in 1984, it was not possible to start work on the septic until June 1984. It must be noted here that when Mr. Romeo did all of his tests (in May and June 1984) and evaluations from which he derived the information needed to design the new system, the area was subject to substantial groundwater. There were no ".drains, no trenches when Mr. Romeo did his tests. There was a driveway, (the same one you see today, except for blacktop and curtain drains). So, Mr. Romeo had to design the system under the very worst of circumstances. Mr. Romeo's plans, however; call for a solitary curtain drain to protect his design. All of the trenches and drains were in- stalled later. The result of these measures today is that less than 10% of the water which cascaded down our driveway direct- ly onto the septic field-in 1983 now reaches that area. In another 60 days we will take you and show you what we have done to'protect Mr. Romeo's design. None of these measures were taken at his suggestion, but because we could see that the area was subject to flooding during heavy rainfall. If surface water were the problem , Mr. Romeo should have made provisions for diversion in May of 1984. It was certainly wet enough. Yet curiously he made no such provisions.. It re- mained for our common sense and the advice of others to guide us to install over $15,000 in drains and diversionary trenches to keep that area dry. 4. Mr. Romeo speaks of "The extreme use" of machinery over the field area. We don't have a clue as to what this means. He knew our excavator was not going to install the system by hand. I doubt that my use of .a weed eater in the subsequent summers qualifies as "extreme" either. Surely soils with the characteristics which give pert rates of 11 - 15 minutes,as Mr. Romeo inscribed on our plans, are not so changeable that the instAllati6n :.of the system designed for that soil type, would cause the soil characteristics to change.so drastically. Mr. Romeo also indicates that Mr. Stellato's crew were respon- sible for compacting-the area in Spring 1987. How? They dug up the area with pick and shovel. I saw them do it. 5. Mr. Romeo states that in 1984 he showed Mr. Stellato how he wanted the system installed and that he was called after the system was installed. What Mr. Romeo fails to recall is that both Stellato and I...called him before work started and he fail T,'!. ed to keep three appointments. On two occasions'I took off from work just to meet with him, so that I could hear what he had to say. Mr. Romeo also fails to recall that I called him on a dozen occasions and was- merbally abused by his wife when I called his home number after failing to reach him at his office. Mr. Romeo fails to recall that Mr. Stellato and -more- o \ -- I• both :c-a-Iled him - before Stellato began to backfill the system and that again, he failed to keep an appointment. Mr. Romeo has consistently been discourteous where keeping appoint- ments and answering phone calls are concerned. As recently as August 14, 1987, Mr. Gabriel of your department requested that he come to an inspection of the system and he failed to show up or call to say he wasn't coming. You know, Mr. Hedges, that Mr. Romeo and my engineers concur on very little. You also know that there is certainly not enough convergence of.opinion to agree on a solution to the problem. Romeo attributes the problem primarily 4--- to groundwater, and a faulty installation. He still_ indicates that water percolation is not problematic. Noviello and Ettari attribute the problem primarily to extremely poor soil. Poor, that is for a septic in- stallation. So poor, in fact that they propose a radical solution. Their solution is not, Mr. Hedges, to pour raw sewage out onto the road, as you told Senator Galiber on February 18, 1988. That is what the present system does. You admitted to my wife later that day that your characterization was a "gross oversimplification" and therefore inaccurate. It is unfortunate that you would for two seconds confuse the issue, while at the same time you attempt to hasten us to opt for Mr. Romeo's solutions, such as they are. You know full well that our engineers have designed a system far superior to the system now in place. You know full well that they intended to stand behind their design with their guarantee. You know full well that were it not for the intervention of your predeces- sor, Robert Tutoni, we would likely be without protection today, our guaran- tee expired, our system failed. Your director, Mr. Karrell would have it, that tgbr.end up with another band -aid approach and no guarantee to back it up. Resubmit design to eliminate that portion of the curtain drain which is below the system and the sand between the trenches and the curtain drain, i.e. show a conventional design. 00 _. -2- At this point, an investigation of the system was made as follows 1. Two deep holes.were dug, number 1, at the base of the SSDS was dug to a depth of 7 feet and hole number 2, outside the SSDS to the south was dug to a depth of 3 feet. Soil percolation tests were performed at the bottom of each hole and soil characteristics were observed. The soil in hole number one is characterized as sandy silty loam with traces of clay. The percolation test, was performed roughly, but indicated a 7 minute rate_' The sail in hole number 2 was also characterized as silty sand loam with more clay however, than in hole number I and mottled. Percolation at the bottom of this hale was poor. It is noted that hole number 2 is outside the sewage area and this soil may have been spoils from the driveway or other construction and later compacted. The soils in hole number one showed no such compaction. 3. Inspection of the area where the sewage system had been overflowing previously indicated that the overflow was not occurring at this time. "Y As discussion. ensued with all parties to discuss the results of the investigation, the next step and target dates_ The following was the agreed course of action by all parties. 1. A construction sequence would be followed where one step would be performed at a time and the system observed after the work in each step completed to determine if the next step is necessary. a- 1 19 2. FIRST STEP (a) Replace the curtain drain to full depth of 7 feet on three sides of the system. Also,. at this time the J -Poxes will be set properly, baffles installed in distribution boxes and the seepage pits disconnected from the system. (b) Check at least one trench for clogging of the perforated PVC pipe with silt. If no significant silt encountered,-no need to continue. If significant silt encountered, clear that line, and inspect all other lines. (c.) Regrade lower portion of the property below the system to eliminate the low spot. (d) Provide a =wale or curbing between the driveway and the system to prevent surface drainage from entering the system 3. SECOND STEP (a) Remove existing system to a depth of 4 -5 feet and replace trenches ROA fill. 4. Final step Consider approval of alternative system with surface discharge. Mr. Romeo indicates that the soils in the area of the septic system were 01cr1tical." By this we presume that tie means that the soils were capable of being compacted during construction activity. We do not dispute . this observation, for our sieve analysis of the soil clearly shows that the soil has a very high clay content. However, from my experience, 15 minute per inch soils are generally that of a sandy loam, not clayev soils. If Mr. Romeo did obtain 15 minute per inch percolation rates than why did he feel that the soils were "critical ?" Moreover, if tin felt that the soils did have a high clay content, why was the. design of the system predicated on a 15 minute per-inch rate? Generally, when a system is designed the design should be based upon the worst condition, or the worst percolation rate. If the soils. were considered to be critical then a design rate of 40 minutes per inch would have been more apropos than a design rate of 15 minutes per inch, even if that quick of a percolation rate had been obtained. 2. Our examination of the original permit, the revised permit, 1 " and the as -built plan show that the driveway did not "ig 'T€e:r�,.�ai,t proposed- a.rea.. ..If_.I�. Romeo felt strongly that the. system should not have been µ relocated he should have refused to redesign the system since the driveway did not substantially interfere with the originally proposed position. We have been asked on several occasions to redesign our systems or systems designed by other engineers. In some cases we have been dismissed because of our refusal to do SO. We feel that Mr. Romeo should have refused to alter the permit if he felt strongly that the soils in the second area were "critical." 3. Mr. Romeo seems to indicate that he was not happy with the regrading that had occured on the site during the construction of the septic system. Moreover, Mr.. John Karell, P. E. and Mr. William Hedges of the Putnam County Department of Environmental Health have indicated their belie' that the material in which the septic system was installed may have been material excavated from the driveway. If this is so, then both Mr. Romeo and Mr. Stellato must bear responsibility for the failure of the system, Mr. Stellato for violating the provisions of the Putnam County Department of Environmental Health in filling the septic area with non Board of Health Approved Run Of Bank Fill and Mr. Romeo for approving the system. I have actually required newly constrUCted septic systems be dug up and re- installed because they were not built according to plan. In one instance, I required an excavator to bring onto a site an additional 400 cubic yards of Rua -of -Bank Fill because the septic installer did not install the original amounts according to the plan. In other cases Mr. Noviello has forced septic installers to add on additional fields or relocate laterals because the plans were not followed. Our e;camination nt'-s-. -- ey stem showed many- deficiAncie's. -`.�.n _t.he.. *sys_�t rris construction, such as reversed Distribution and Junction Boxes and the absence of gravel at various points along the laterals. Thus, while Mr. - Stellato must bear.primary responsibility for not installing' the system properly, Mr. Romeo must bear responsibility for not inspecting the system throughly. 4. Mr. Romeo indicates that on 'October, 6, 1987 tie had -a excavator dig 'a deep hole along the curtain drain which Mr. Stellato had installed, and that the curtain drain was only 3' - 6" deep. We concur with Mr. Romeo concerning this observation, which bears additional evidence that the system was not installed as'designed. However, Mr. Romeo indicates that while water was entering this deep hole it "dispersed as rapidly as it was coming into the area." This conclusion is drawn based upon an insistance that the soils in the area have good porosity and, consequently, a good percolation rate. This conclusion is not necessarily warranted, however. The proper way to determine the absorbtion capacity of the soil four feet below the ground's surface is to excavate a pit three feet deep an them to run a percolation test in the bottom of the pit. 5. Mr. Romeo indicates -that on the same day a trench was E _ 3 excavated along the top and side of the septic .system.,. He., then. •states . -: that .:_ w t-r.�._-. began to 'percolate into the trench ana that some of the sides slid in. This observation is correct. However, we wish to point out that the sides were basically stable and only slid in in relatively few areas. This was also noted by Mr. Hedges when the Department of Environmental ' Health made their field inspection in December. Sandy soils, which .generally exhibit percolation rates between 5 minutes per inch and 15 minutes per inch, have no cohesion. Thus,, cuts made in sandy soil collapse rapidly and uniformly. Clayey soils, on the other hand, have high cohesions and will maintain vertical cuts for long periods of time. This trench maintained its vertical cut for over 90% of its length for over one month, a further indication of the high clay content of the soil. 6. A great deal of attention has been paid to a widely held .belief that frogs will not live in septic waters. Mr. Romeo states that "this again proved that the water around the junction boxes had to be clean water as the fogs would riot live in septic water." This is not true. We consulted with Dr. Wayne Frair, Chairman of th King's College Biology Department (Briarcliff, N.. Y.) who informed us of that frogs can easily live in septic water. Apparently frogs and turtles are cold- blooded animals (ectotherms) while humans are warm- blooded animals (endotherms).. They also have different biologi..cal and nervous systems. Consequently, humans harbor, and are infected by, organisms which survive at temperatures in and about 98.6 degrees Fahrenheit. Frogs, on.the other hand, have lower body temperatures and would be infected by organisms different from those that infect humans. He is familiar with several incidents of turtles living in polluted septic waters and is quite .convinced that frogs_.cc.uld.. -live in septic water and :is ;g. wi.11in. . to testify -if rrecessary, Thus; the occurance of frogs in the open septic system has no significance what so ever. 7. Mr,. Romeo mentions that he had the backhoe operator dig a trench from the last junction box to grade downhill. fie noted that the water flowed out of the system and was absorbed by the ground downhill of the system. Pecolation decreases as one moves down through soil layers. Percolation tests are normally run 24 inches below the surface of the ground since this is the level at which the sewage effluent will be absorbed. The percolataion rate of the top three inches of soil has no bearing on the design of the system. Therefore, simply because the top three inches of the soil in the area can absorb water does not mean that a septic system will work in the area. Moreover, it should be pointed that much of this area is on the otter side of the property line and is not available for the repair of the system. Also, it should be noted that there may be a soil horizon occuring at this point. A soil horizon is the boundary between two different types of soil. The soil down hill of the septic system may not be the same type of soil in which the system was installed (which has been clearly shown to consist of clav). This is why a minimum of two percolation tests are required in the septic area. Lastly, it should be noted that 3 Mr. Romeo's contention that the water is not flowing over the., sur:facP,.of..ythe ground is ;gat'- true. °wine wdt`r ``i.s 'flowing for ' some distance before it is fully absorbed into the upper surface layers of the area. 8. The last point which Mr. Romeo brings up concerns the silt found in the trenches and fields. The origin of the silt is unknown, though it must have entered the system during its original construction or during its subsequent excavation. If it entered after the excavation of the system then it could not have had any effect in causing the system to fail, a position that Mr. Romeo erroneously adopts. If it entered the system during construction, then both the engineer who certified the system and the installer are at fault for not noticing it and removing it prior to placing the system ontline: Either way, considering that four percolation tests ha— e thus far failed in the septic area,. it is doubtful whether the silts in the system caused it to fail. We consider this needless speculation concerning the silts to be a method by which the isi.ie is being clouded. If the silts entered the system when it was excavated they could not have caused it to fail. If they erite.r-ed during installation then the contractor and engineer must: both bear responsibiliy if the stilts caused the system .to fail. We have examined Mr. Romeo's conclusions and find ourselves in agreement with the first two. The curtain drain was not installed to plan by Mr. Stellato, who must: briar some responsibility for the system's failure in that he failed to install the system as designed. The second conclusion, tliat the existing seepage pits are picking up ground water, as opposed to dispersing septic water into the ground, seems to be correct based upon our visual....obse.rvations. As noted, the silts are not the primary cause of failure since four percolation tests in the septic area failed completely. It is the soil of the area, not the silts in the fields, that is causing the system to fail. If the silts entered the system after excavation, then they obviously had no effect in causing the system to fail. Point number four is moot in our opinion since percolation tests in the septic area conducted after the digging of the open, curtain drain did not show a significant improvement in percolation rate. There is very little percr.:lation occuring in the area, though this does not excuse'Mr. Stellato's failure to install the system the way it was designed. Mr. Romeo has made several suggestions concerning the repair of the system. These suggestions are not as dramatic or 4 Jr. as expensive as those proposed by .our ._firm_. .Aj w v -r,, ::.tjie,,.sy:stem...._ . 0 0' 1( rsry - astalled' incorrectly, and percolation rates obtained by our firm in the existing septic area and the originally proposed septic area are far in excess of 15 minutes per inch. If the suggestions by Mr. Romeo do not correct the situation, which we feel they will not, then the system we have designed would have to be installed. however, it must be emphasized that we are of the opinion that the soils in this area are not adequate for subsurface disposal, displaying percolation rates in excess of 60 minutes per inch. Therefore, any attempt at effecting repairs has a poor chance in succeeding. If either party disagrees with our conclusion we are willing -to demonstrate in the field that the system was installed improperly and that the percolation rates are generally over 60 minutes per inch, thereby indicating partial resonsibility on the part of both parties. We would be willing to demonstrate this lack of percolation ability in both the existing septic area, the originally proposed septic area which has trees in excess of 10 inces in caliper, indicatinU that the area was never disturbed, or any other area on the property which the design engineer may choose. I have reviewed the record on the property in question and wish to bring everyone to -date on all occurrances. I orgininally became involved John Lawniczak. Approval was July 1980. in this property for Mr. & Mrs. obtained for a septic system in Prior to obtaining the septic approval, I had been on the property with Mr. Rudy Valentini, who installed the original graded driveway and did the pe_colation deep holes. At that time we found considerable drainage runoff on this property especially after.heavy.rains. °. With that in mind, I notified Mr. Lawniczak that a deep curtain drain would be required of any ground water. In addition the house the driveway on the left side of house with and fields directly in front of the house a area now utilized by the driveway. and Mr. Valentini to insure the pickup was designed with the curtain drain pproximately in the A few years later Mr. Heady called me and said he now was working on the excavation and we went over the septic installation with him. I did not hear anything for some time when I was called by the Wints who asked that I renew the septic permit for them: He toldme he had his own excavater Mr. Austin Stellato who was going to do the septics and excavation work. I never had heard of Mr. Stellato previous to.that time and knew nothing about his experience with septic installations. I met with Mr. Stellato who stated that he did not want to install the system on top because the driveway was now designed on the right side of the house but wished to utilize the lower area near Bell Hollow Road, as there was less pitch there. I told Mr. Stellate that I always tried to install systems as high as possible, because low areas always collect more water. However, if he could prove to me that the soils were simimar or better thafi the upper soils, I would redesign the system. I had seven foot deep holes dug with no water encountereed. 'E. LS JOHN S. NEW YORK 10388 914737.1056 - 2 - J The following day, I returned and made the perc holes and found that the soils were similes to the upper soils in rate of percolation. Howver, having seen ground water when I was first on the property, with Mr. Valentini, I designed seven (7)-foot curtain drains above the septic system. After getting the redesign approved, I t,ld the Wints to have the septic installer call me prior to installation so I could go over the system again. . I did go over the entire installation with Mr. Stellato and asked him to call me when he was going to start the system. Soils °in this area were critical and I said I wanted the least disturbance to the area so as to limit any compaction. I was called after the system was installed. I was shown the top of the curtain drain and the outlet, which indicated water was being picked up.I located the boxes and the ends of the fields. Area had been regraded somewhat with the southerly end raised. I checked the stone around the pipes near the boxes and found that is was in place. This was all shown on the as built plan. Approximately one year later, Mr. Tutoni called me and saidthere was trouble with the system and he wanted me to meet with him and he would tell me how to fix it. I did meet with Mr. Tutoni and Mr. Stellatco.. and was..t'olc?- ..that h- •(Mri - Tut- oni)-wanted--two - -'- "-'leaching pits installed and he laid out the location and size of pits. I had no input into this decision and followed exactly what Mr. Tutoni wanted. Mr. Stellato installed the pits and I had to pay for the material and labor. In addition Mr. Tutoni had me sign a 5 year guarantee, which I have never had to sign before. I was notified that this would have to be done or it would become difficult to get approvals of other systems. The system was in place in the summer (July) of 1985. Nothing was heard for the remiander of 1985, all of 1986 and the early months of 1987. We had a very wet fall in 1986, winter 1986 and spring of 1987. Many sic systems were having difficulty with the rains in these months. I was notified in the spring that problems had again developed. I went to.the job site a number of times and finally Mr. Stellato sent some men to excavate for the pits and boxes. The boxes were not located by hand as the tie pole had been replaced and we were not able to find boxes. Finally, Mr. Stellato opened up the boxes without me being present. Area was all churned up and soils compacted in the area. PE. LS F CONSULTING ENGINEERS & LAND SURVEYORS 1 NORTHRIDGE ROAD PEEKSKILI.. NEW YORK 10566 9.14 -737 -1056 - 3 - I was afterwards notified that Mr. Matthew Noviello had been retained as an engineering consultant by the Wints. After some discussions with Mr. Noviello.; I called him and said desired to have my own excavator go onto the job site to do some. exploratory excavations. , On October 6, 19 °7, I, together with Mr. Noviello and Mr. Howard - Gragert met at the site. We had Mr. Gragert locate the existing curtain drain in two locations. One excavation was near the roadway between the fields anod near-the first junction'Box. The curtain drain was a maximum of 316" deep and not functioning properly. Approximately 5 feet below grade water began seeping into the excavation and began slowing filling. However, a short period afterwards, the water began percolating steadily into the soils below and water was being dispersed as rapidly as it was coming into the area. All this happening at a level, below the first field level and below the bottom of the curtain drain installed by Mr. Stellato. The second excavation was quite a distance from the first field installed in the northerly trench. This again a 3' -6" curtain drain with the bottom of curtain drain above the fields installed. We then - -had - M -r."- -G:"ragert exca.'vate a"deep trench diagonally from the northernproperty line near the front, to. intercept any possible drainage runoff from the driveway area where the driveway begins curving . After some time water began percolating into this trench and some of the sides began sliding into trench. The two junction boxes in the slope between upper and lower driveways were also opened. The upper box, from the septictank showed no water entering from the tank. 'The lower box, after the seepage pits, showed water entering from'the pits. Thus, the pits wereallowing water to leave even though no water was entering. This can only mean that the pits are picking up water from the ground, which is not septic water. The boxes were all opened and examined. The trench areas between the boxes had been open for many months with water observed in this area. However, we also observed that many frogs were living and swimming around in these water pockets, adjacent to junction boxes. This again proved that the water around the junction boxes had to be clean water as the frogs would notlive in septic water. PE. LS CONSULTING ENGINEERS do LAND SURVEYORS 1 NORTHRIDGE ROAD PEEKSKILL. NEW YORK 10866 914 - 737.10.56 - 4 - The area beyond the last junction box was opened and the water trapped by the junction boxes and trenches was allowed to run into the area beyond the boxes, which was still the original ground and not disturbed by the septic installation. This water was observed being absorbed by the original ground until all possible water that could excape from the trenches-was eliminated. The water remained in the area and did not run over the ground to be eliminated. All the junction boxes having been opened, silt was found settled in the bottom of the boxes. Water was running into the boxes in.a steady stream even though we h�.d previously observed no water in the first junction box after the septic tank. We then opened the ends of three (3) fields at the south end and found some silt in the bottom of the pipes. Mr. Noviello and I discussed the origin of the silt. At the time we formed no conclusion. On further reflection, I believe the silts are the result of having, exposed the boxes, the area has been kept open for many months. The cover of the boxes is not a tight fit with the box itself. Thus the rains over the many months probably washed silts into the boxes. The continuing infiltration of water then washed some of the silts into the fields. . CONCLUSIONS: 1. The curtain drain was not installed correctly by Mr. Stellato. The seepage pits appear to be picking up ground water in 0 the area and carrying it into the fields below. 3. The capacity of the existing fields to function properly has been diminished by the infiltration of silts. The ground in the septic area was able to absorb water, with the observation of water percolating after digging a deep trench below the adjacent 32 ft curtain drain, and also by observing water percolating into the ground beyond the last junction box. RECOMMENDATIONS: Qo Existing junction boxes should be cleaned, and an attempt made to clean out existing fields by flushing with a hose, after ends are exposed. All water should be removed from the junction boxes, after &v /�/ the curtain drain has been installed, and box covers replaced �( and backfilled and allow system to function. The extreme use of machinery over the field area with.the types of soils located at the site has probably diminisfied.the capacity of the soils to work a's effeciently as originally planned. Howver, I believe that the original system should be given another opportunity to function after a proper curtain drain is installed. Another possibility would be to install a curtain drain above the seepage pits, with the bottom of curtain drain a minimum of 3 feet below bottom of seepage pits. This would permit the pits to function and eliminate outside water from infiltrating into the pits_. If--the--abbv-e' -is `d'on(;-it- should 'be -i:h ' additi ori- to'-- replacement of the curtain_ drain at the lower level with the proper curtain drain. I have hadsuggestions made that a fill section should have been designed. I never have- a client spend money needlessly, if I believe a system will function. If I had designed a fill section originally, your client would have expended a great deal more money, Which I did not think was necessary. I still believe that I had designed a proper system, and ifa more competent installer had been engaged by your client, we probably never would have had any problems in the first.place. Romeo, P.E., Howard Greygert (with his backhoe) and I met at your property, to continue our investigation into why your septic system failed. We found the following: SUMMARY The seepage pits should be plugged off and the pipe reconnected directly to the septic trenches then a new perculation test should be done in the septic trench area to see if the soil can absorb the septic water. Additional construction defects were found verified. INSPECTION -. s 1, When we arrived the septic trenches were again flooded out. The last three junction boxes were under water by as much as one foot. However, there were several frogs swimming in thee water! Normally frogs will avoid septic water and only swim in potable water. We suspected that the soil in the area of the trenches was being saturated with natural ground and rain water runoff. 2. The plans show a curtain drain along the east side of the trenches, between the trenches and the driveway. We wanted to verify the construction of the curtain drain. We excavated the curtain drain at two points to see if it was constructed properly. The first excavation was at a point about twelve feet south of the junction boxes for the trenches. The second excavation was at the north (upper) end of the curtain drain. In both places the curtain drain was approximately 3' 6° deep, The plans called for a 7' deep curtain drain. At the north end, the curtain drain pipe was a few feet higher in elevation than the septic system trenches. 1 The P.V.C. pipe was .installed upside down, with the holes ;.;,.. up. This. will tend_ to result in silt settleing to the bottom .of. the pipe and" it�.' . the holes were down the `silt would more likely have settled on the bottom of the trench. We .left the excavation < one hour a puddle of water h first excavation. The soil drain pipe'was moist. The drier. After about 3 more decreasin rn-ai-ze_L indicate 67v the soil-at-the bottom o pen for several hours. After about ad accumulated at the bottom of the on the sidewalls below the curtain soil above the pipe was noticably hours the puddle appeared to be ag a e, -e-r was Being a sor e e. I believe the curtain drain was effectively draining the natural ground water in the soil above the drain but that it was constructed improperly and should be reconstructed at a depth of 7' as originally planned. 3. We suspected that runnoff water was saturating the soil in the trench area. We dug an open trench along the north side of the septic trenches in the east west direction. Since this area is up hill from the trenches, so we made the trench deep enough to be sure we were at a level below the septic trenches. The northeast end is the highest corner of this area. We made the trench 8' 6" deep on the northeast corner. The trench flows to the west and eventually comes out on the ground level near the front (west) property line. The soil in the, side walls of this trench were not as wet as we had anticipated. After a half hour. a small amount of water did start to trickle in, at three or four places. fact the trench was left o'p' pen after digging, in addition to stopping ground water, it will act to block rain water flowing along the surface downhill towards the _ septic area. The trench should be converted into a curtain drain with a swale along one side. . 4. I lifted the covers on the junction boxes on the side of the hill before and after the seepage pits. Again as in my last inspection, the lower box (after the seepage pits) had water steadily trickling out of it. The- juction box before the seepage pits again was dry. This leads to the assumption that the seepage pits may be gathering ground water rather than dispersing septic water. The seepage pits should be disconnected from the septic system. 5. We were. concerned about the apparant siltation that was noticed in the junction boxes in the septic trench system. In order to determine if the trenches were congested with such deposits, we excavated and inspected the south end of the first three trenches. All three were congested. The congestion will certainly lower the effectiveness of the 0►. i trenches and I am still considering'whether ' t "rerich "es —be 'rep "1 "ace d. There may be a fracture in the pipe between the junction box immediately after the seepage pits and the first junction box in the septic trench area. The pipe should be replaced when the system is repaired. CONCLUSIONS:- 1, There were excessive amounts of clean water in the septic treches. The clean water most likely came from natural runoff. 2. The curtain drain shown on the plans between the driveway and the septic system trenches was constructed improperly. 'It should be corrected. The bottom of the curtain drain must be below the bottom of the septic trenches. 3. Another curtain drain and swale along the north side of the septic trench area would only help keep the natural water out of the septic area. If this area is used for in the future, a 4" perforated P.V.C. pipe should be installed in the open trench and the trench should be filled with 3/4" washed gravel. A swale should be constructed along the side of the new curtain drain. -- 4. The seepage pits on the hill should either be closed off and plugged up or a curtain drain deeper than the bottom of the pits should be installed up hill from the pits. ..._5. --- .Thh-e"septic to the siltation congestion found in the trenches. 6. The pipe from the junction box on the hill after the seepage pits to the first junction box in the septic trench area should be replaced. .x.70, It will be most economically efficient to reuse as much of t e existing system as possible. If we have to move the system to another location much expense will be incurred to remove the trees and stumps. The question remains whether after the natural water is diverted from the septic area will the soil in the septic area has the ability to absorb the septic water? The seepage pits should be disconnected (see no. 4. above) and another perculation test run. If the soil still perculates over 60 minutes per inch after the seepage pits are disconnected and now that the trench to the north is dug, we will have to look for another location for the system. Dear Mr. and Mrs. Wint: Per your request we exam.i,n.ed. the. failed septic system _. ser- vicing the-- ab�,,-ve- -Leferenced- -property om- September- 3i._T98.7': evaluating it we conducted a visual inspection of the various components of the system, performed percolation tests in the original area intended for' the septic system and in the area where the system was finally installed, and ran a sieve analysis on the soils in the original area and in the final area. The results of our examination are as follows: 1. The bedroom count of the house was verified. The house has only three bedrooms and the system was designed for a three bedroom house. 2. The house was examined to see if a garbage grinder had been installed in the kitchen sink. It was found that no such device was presently part of the waste disposal system. 3. The driveway apron has been swaled and is diverting a small amount of run -off into' the original proposed area. However, this run -off does not appear to be reaching the area where the system was actually installed since the flow encounters,a curtain drain and a driveway before it could reach the septic area. 1 4. The junction boxes between the septic tank and the leaching pits lacks a baffle. A baffle should be placed here because of the steep slope of the inlet line. 5. The junction box between the leaching pits and the fields should also have a baffle for the above outlined reason. 6. The concrete boxes in the field area were found to be Distribution Boxes, as opposed to Junction Boxes. Several of these were installed backwards. This is a minor problem and may not cause problems. An inspection of the boxes revealed a sedimentary buildup on the bottom of the boxes and the field pipes. This condition may be a result of the water stagnating in the trenches. 7. The fields and Distribution Boxes were uncovered and checked. Our inspection showed that there was sediment on the bottom of the boxes and fields. However, we could not determine if the sediment was household solids or organic growths. 8. Our examination of the trenches revealed that for at least one lateral, an insufficient amount of gravel was used. In fact, for the lateral checked no gravel layer was found beneath the perforated P. V. C. pi -pe. fo_r at jea.st. 10 feet from the stribution -Box i•nwan�e dTre "ct'ion. In the other direction there was adequate crushed stone. 9. Percolation tests performed by our office showed that the quickest percolation rate for the soil at 24" below the ground's surface was 67 min. per inch. Of the four holes dug and tested, two did not empty at all during the pre -soak period. Of the two that did empty, the percolation rates for one was 67 min. per inch while the other, when tested, showed no absorption capacity at all, the percolation rate being well in excess of 120 min. per inch. These two holes were on the slope, in the area originally intended for the septic system. The percolation tests in the flat area at the bottom of the slope where the system was installed yielded the following results. The water in the first hole dropped only 2 inches during the pre- soak after two hours. The actual rate was timed at that point and found to be over 180 min. per inch. At this point the top of the water was only 4 inches below the surface of the ground. 2_ The sec ond• hole i'n' thi`s area dropped 5 inches during the pre -soak after two hours. At that point the top of the water was only 9 inches below the surface of the ground. The rate of drop was measured at that point and found to be 56 min. per inch. The water in both these holes never dropped to the 21 inch level thereby making it impossible to run a standard percolation test on the soil in this area. However, it is obvious from the slow rates of drop during the pre -soak that percolation well in excess of 60 min. per inch would have been encountered 21 inches below the surface of the water. 10. Sieve analysis of the soil from the original proposed area and from the area where the system was installed were conducted. The results are attached and show that the soil is predominately a clayey -silt. Soils of this type usually have little absorption capacity. These comments represent the inadequacies of the system found during our inspection. However, additional information is needed before we can design a system that will work in this poor soil. It is recommended at this time that deep holes be dug in the proposed and final area so that the various soil layers can be examined. The area had a very high water table and. prelimary ditching indicated. that curtain drains would lower the water table. A permit was issued. for Mr. Lawnicak/ Some years later, I was informed that the property had been sold. and. new permits._were.._ to..be obtained.. I had test holes dug and found. similar soil. This time tests were mad.e after a driveway had. been graded and ditching made. Tests again showed, that slow draining soils with proper curtain drains would. be necessary. . System was installed. at the lower elevation, but I belive that soils were compacted during construction and made less permiable. This system was found. to be not functioning properly one year later and together with Mr. Tutoni, it was d.ecid.ed to construct two leach pits at the upper level, with the lower lever to be utilized as an overflow. These worked. fine from July 1985 through 1987. This would. indicate that during normal rainfall periods, there would be no problems. The late winter of 1986 and spring of 1987 were extremely wet and many septics showed distress in Westchester and Putnam Counties. Additional I was informed. later that this area along Bell Hollow Road. has many springs develop during heavy rainstorms, and that septics on both sides of the Wints had. problems because of the springs. At the top of the drive- way, near the junction with the pavement for the turnaround area adjacent to the garages, a gutter had, been installed to direct drive- way and turnaround. water into the septic area directly in front of thehousd. Additionally, the front of'the house had. been completely changed.. A very nice retaining wall had. been constructed and. a slate patio installed with water being directed, onto the driveway, from rainfall runoffs. All of this also was directed, into the septic area in frct of the house, and. thence along the septic pipes to the distribution boxes. Additionally, it would tend to raise the water.level in the area of the leach pits as some of the water would. be along the edge of driveway. The wash areas in the vicinity of the center distribution box, midway up the slope show the amount of water being directed down .. this _channel. �_... _..> _ ... I therefore propose that prior to any work being done on the septics, the the drainage from the driveway, patio and turnaroun d, areas be properly collected. within a closed drainage system and. directed.,-. away from the septics. I propose that a catch basin be installed. at the gutter location to collect all the water, and. this being then placed. in a pipe (min 12" C117P) along the edge of the driveway to a point past. the leach pit locations. This pipe to be placed on stone,(washed. gravel) to collect any water that may seep-out of pipe or water encountered. in ground.. We do not dispute this observation, for our sieve analysis of the soil clearly shows that the soil. has a very high clay content. However, from my experience, 15 minute per inch soils are generally that of a sandy loam, not clayey soils. 'If Mr. Romeo did obtain 15 minute per inch percolation rates than why did he feel that the soils were "critical ?" Moreover, if he felt that the soils did have, a high clay content, why was the deign of the system predicated on a 15 minute per inch rate? Generally, , when a system is designed the design should be based upon the worst condition, or the worst percolation rate. If the soils. were considered to be critical then a.design rate o` 40 minutes per inch would have beer.` more apr6j %s than a design rate of 15 minutes ,per inch, even if that quick - .."of a percolation rate had been obtained. 2. We feel that Mr. Romeo.should have reused to alter the permit if he felt st.rongly'that the soils in the second area were "critical." 3. Mr. Romeo seems to indicate that he was not happy with the regrading that had occured on the site during the construction of the septic system. Moreover, Mr.. John karell_, P. E. and Mr. William Hedges of the Putnam County Department of Environmental Health have indicated their belief that the material in which the septic system was installed may have been material excavated `from the driveway. If this is so, then both Mr. Romeo and Mr. Stellato must. bear responsibility for the failure of the. system, Mr. Stellato for violating the provisions of the `'Putnam County Departmont of Environmental. Health in filling the septic area with non Board of health Approved Run Of Bank fill and Mr. Romeo for approving the system. I have -actually required newly constructed septic systems be.dug up and re- installed because they �4ere not built according to plari,. In one instance, I required an excavator to bring onto a site an additional 400 cubic yards of Run -of -Bank Fill because the'septic installer did not install the original amounts according tp the, plan. ..In other cases Mr. Noviello has forced septic installers- to add..on additional fields or relocate laterals because the plans were not followed. Thus, while Mr. Stellato must bear primary responsibility for not installing the system properly, Mr. Romeo musi: bear responsibility for-not inspecting the system through.ly. 4. Mr. Romeo indicates that on October 6, 198.1 lie had a excavator dig a' deep hole along the curtain drain which N;r. Stellato had installed, and that the curtain drain was only 3' - 6" deep. We concur with Mr. Romeo concerning this observation, which bears additional evidence that the system was not installed as designed. However, Mr. Romeo;dndicates that while water was entering this deep hole it "dispersed as rapidly as it was coming into the area." This conclusion is drawn based upon an insistance that�'the soils in'the area have good porosity and, consequently, a good percolation rate. This conclusion is'not necessarily warranted, however, ,:, The proper way to determine the absorbtion capacity of. the soil four feet below the ground's surface is to excavate a pit three feet deep an then to .run a percolation test in the bottom of the pit. 5. This observation is correct. However, we wish to point out that the sides were basically suable and only slid in in relatively few areas. This was also noted by Mr. Hedges when the Department of Environmental Health made their field inspection in December. Sandy soils, which generally exhibit percolation rates between 5 minutes per inch and 15 minutes per inch, have no cohesion. Thus,, %ut.s made in sandy soil collapse rapidly and uniformly. Clayey coils, on the other hand, have high cohesions `and will maintain vertical cuts for long periods of time. This trench maintained its vertical cut for over,90% of its-'length for over one month, a further indication of the'high clay conterit of the soil.. 6. A great deal of .attention has been paid to a wi_del.y held belief that frogs will not live in septic waters. Mr. Romeo states that "this again proved that the water around the junction boxes had to be clean water as the fogs would riot live in septic water," This is: not true. We consulted with Dr. Wayne Frair, Chairman of th King's College Biology Department (Briarcliff, N.. Y,) who informed us of that frogs can.easily live in septic water-. Apparently frogs and turtles are cold - blooded animals (ectotherms) while humans are warm- blooded animals (endotherms). They also have different biological and rlervous.'systems. Consequently, humans harbor, and are infected by, organisms which survive at temperatures in. and about, 98.6' degrees Fahrenheit. Frogs, on the other hand, have lower body temperatures and would be infected by organisms different from those that,infect'.humans. He is familiar with several_ incidents of turtles living in .polluted septic waters and is quite convinced- that: -frogs _cou-ld- 1-ive_ in .dept- r. yaa e . -.ai r -i_ i:� ar g if necessary. Thus, the occurance of frogs in the open septic system has no significance what so ever. 7. . Mr. Romeo mentions that he had the backhoe operator dig'a trench from the last junction box to grade downhill, lie noted that the water flowed out of the system and was absorbed by the ground downhill of the system., 'Pecolation decreases as one moves down through soil layers, Percolation tests are normally run 24 inches below the surface;of the ground since this is the level at which the sewage effluent will be absorbed. The percolataion rate of the top three inches of soil has no bearing on the design of. the system. Therefore, simply beraLrse the top three inches of the soil in the area can absorb water (foes not mean that a septic system will work in the area. Moreover, it should be pointed that much of this area is on the other_ side of the property- line and is not available for the repair of the system. Also, it'should be rioted that there may be a soil horizon occuring.at this point. A soil horizon is the boundary between two different types of soil. The soil down hall of the. septic system may not be the same type of soil in which the system was installed (which has been clearly shown to consist of clay). This is why a minimum of two percolation Nests are required in the septic area. Lastly, it should be noted that 3 Pair. Romeo's contention that the water is not flowing over the ace-of they; ti r'ouncl :is;:riot true: r' mtie water. <2:5� <fl ?owi i for : some distance before it is fully absorbed into .the upper surface aayers of the area B.--The last point which Mr. Romeo brings up concerns the silt found in the trenches. and fields. The origin of the silt is unknown, though it must have entered the system during 'its original construction. or during its subsequent excavation. If it entered after the excavation of the system then it could not have had any effect in causing the system to fail, a position that Mr. Romeo erroneously adopts. If it entered the system during construction, then both the engineer who certified the system and the installer are at fault for not noticing it and removing it prior to placing the system on line. t?:i.ther way, considering that four percolation tests have thus fa.r failed in the septic area, it is doubtful whether the silts in the system caused it to fail. We consider this needless speculation concerning the silts to be a method by which the is:3ue-is being clouded. If the silts entered the system when it was excavated they could not have caused it to fail. If they entered during installation then the contractor and engineer must both bear responsibiliy if the silts. caused the. system to fail. We . have examined Mr. Romeo's conclusions and find ourselves in agreement with the first two. The curtain drain was not- installed to plan by Mr. Stellato, who inust bear sol-Ile responsibility for the system's failure iii,. that he failed to install the system as designed. The second conclusion, tl.iat ;the existing.seepage pits are,ppicking up ground water, as opposed to dispersing septic: water -into the ground, seams to be correct based upon our..visual observations. If .Mr. Romeo is corr.ect R that he ._wa _:.fozoo�i.:.to ..iristal.l. ;a....sy'st*emr Tutoni, who is not a licensed Professional Engineer. and 3.s currently serving a jail sentence for bribery and extortion, then the Department of Environmenal Health should bear responsibility for the installation of the seepage pits. We disagree with the last two conclusions. As, noted, the silts are not the primary cause of failure since 'four percolation tests in the septic area failed completely. It is., the soil of the area, not the silts in the fields, that is causing the system to fail. I'f the silts entered the system after excavation, then they obviously had no effect in causing the system to fail. Point number four is moot in our opinion since percolation tests in the septic area conducted after the digging of the open. curtain drain did not show a significant: improvement in percolation rate. There is very little percolation occuring in the-area, though this does,not excuse Mr. Stellato's failure to install the system the way it was designed. Mr. Romeo has made several suggestions coacerning the repair of the system.. These suggestions are not as dramatic or 4 l,. as expensive as those proposed by our firm. Therefore, any attempt at .effecting repairs has a poor chance in succeeding. If either party disagrees with our.d6ncl.usion we are willing.to demonstrate.in the field that the system was installed improperly.. and that the p�::rc�latio rates are generally over 60`minutes per inch, thereby indicating partial resonsibil.ity, on-the part of both parties. 'We would be willing to demonstrate this lack of percolation. ability in both the existing :peptic area,.the originally proposed septic area which has trees in excess of 10 inces. in caliper, indicating that the area was never'::disturbed, or any other area on the property which the design,engineer m.ay choose. This would permit the pits to function and eliminate outside water from infiltrating into the pits. If the above is done, it should be in addition to replacement - of = the curtain drain at - the..:.l ower_3evel'� with -- the - proper,-- curtain drain I have hadsuggestions made that a fill section should have been designed. I never have - a client spend money needlessly, if I believe a system will function•. If I had designed a fill section originally,.your client would have expended a great deal more money, Which I did not thi.nk.was riecessary. I still believe that I had designed a proper system, and ifa more competent installer had been engaged by your client, we probably never would have had any problems in the first place.
