The grass and weeds are all grown by both structures. 2. There are piles of debris in various spots on the property, apparently for future garbage pick -up. 3. There are no shades or curtains over the windows.and there appears to be no furniture inside the main house. The secondary structure windows were covered so I couldn't see inside.. ; 4. Garbage pails are empty and the ones.without covers are full of water. I have pictures of the property confirming some of the above. Based on the above, it appears the property is vacant: Joe P. If it is vacant we will let you know and the .Department will not take any action at this time. If the Department could be notified when the property goes into foreclosure or deeded to the bank, we would then dismiss all .charges at that time: As stated in previous e- mails'the Department's main concern, if the property has been vacated, 7/2/2009 Page 2 of 5 is that there is a mechanism in place to ensure that the next owners are notified of the situation prior to purchasing the property. I am not sure how this can be done, but it will alleviate, a lot of legal and enforcement issues in the future. I also spoke with Mr. Laufer. He, said the property is not yet in foreclosure..However, there is no one occupying the premises at this time. The owners have moved to Yonkers and are trying to sell the property or deed it to the bank that holds the mortgage in order to avoid . foreclosure. Judge Zaidins had no problem granting the adjournment but he was concerned that there may be an ongoing violation. I am assuming this is not the case, as no one is currently occupying the property. Please let me -know how you would like to move forward. Thanks; . Hi Rick, No Notice of Pendency has been filed yet for this property. I did see that there is one mortgage on the property and I have the information on the bank that holds the mortgage. I am assuming this bank would be the one to foreclose on the property, if there is in fact a foreclosure. I have on my calendar that the hearing was rescheduled for tomorrow, July 1 at 2:30. Should I contact Judge Zaidins for another adjournment or do we still want to dismiss the case? I suppose we would want to confirm that the property is in foreclosure before we dismiss. Would you like me to reach out to Mr. Laufer, the attorney representing Mr. Adorno and Mr. Contreras? I don't think.that it makes sense to go after the bank'at this point as the property is vacant. I assume the bank will want to remedy the situation before selling the property. I agree with Joe in that the bank should be made aware of the violation. I will try and get a copy of the Notice of Pendency from tile. Clerk's office so that we can see who is foreclosing on the property. We can then send them a copy of the notice of violation. I am'not sure if the violation will come up,in a title search. I think we should provide the Town with a copy of the notice of violation to keep in their file so that any potential owner will be aware of the situation. - Audrey From,. Even though the septic system is not being ,utilized, the Department still has .outstanding issues with the property, i.e., the structure was remodeled/renovated without our permit. However, being the structure is not occupied and the ownership will probably be transferred because of the alleged. foreclosure,, the question to Audrey (she has been copied on this e- mail), is if a bank, mortgage co., etc., assumes ownership should the Department proceed legal action with the bank so the problem is remedied prior to the resale? On the other side, will the issue come up in the title search and the bank will have to resolve the issue with the Department before transferring ownership; therefore, we can sit back and wait? e. According to John, the property is now vacant and the.power has been turned off. A neighbor saw a moving truck a couple of weeks ago. It appears to be a foreclosure. Based on this, the town is going to dismiss its case and send us a letter to that effect. I assume this means we will be dismissing our case as well. I don't know how to go about it, but before the bank sells this property again, it should be made aware of the illegal structure, otherwise the same problem will reoccur. This garage is right on top of a stream that is part of the Peekskill water supply. As you can see from your records there was never a septic system here and now you have documenta- tion the conversion is a clear violation of Health Dept, and Town code. Please review these documents and follow up with me as to what your action plan is go- ing to be on this violation. Documents Enclosed: 1) Photo from 2005 assessment office showing garage. 2) Photo from July 2007 showing conversion to house. 3) Real Estate ad mentioning 2 houses on one lot, with interior pictures of old garage now a home. 4) Assessment office 2005 record showing garage in picture and floor plan with dimensions. 5) Oct 28, 2005'letter for Acacio D: Carlos the person who did the illegal conversion saying the structure cannot be modified for living space. 6) Notification letter from 6/22/07 saying there is a violation and to contact the Zoning Inspec- tor, this notice was ignored by the owners. 7) Notice of Violation from 7/26/07, which gave 7 days or fines would be imposed. This notice got a response from the owners. "V 4 1 U NEIGHBORHOOD BOUNDARIES AND CHARACTERISTICS: The subject neighborhood is bounded on the north by Route 301, on the south and east by the Taconic State Parkway, and on the west by Peekskill Hollow Road. Tile subject neighborhood consists mainly of single family residences of various styles and sizes, most of which range in size from 800 to 2500 square feet. SITE COMMENTS: The site is typical in size, shape, topography and landscaping for the area. There are no apparent adverse easements, encroachments, special assessments or slide areas. The site is a 7.17 acre site with a brook. Tile front portion of the site (approximately 2 acres), from Seifert Lane to the rear of the house is generally level. The remainder of the site is steep and rocky and for all practical purposes, is unusable. ADDITIONAL FEATURES: There is a 2 story garage as follows: the first level consists of the garage, work area and bathroom. The 2nd level is one finished room that serves as a studio. The garage has electricity and water is supplied from the brook. CONDITION OF THE IMPROVEMENTS: There are no physical or external inadequacies. The subject offers good construction quality apd a average layout with adequate room size, closet and storage space. The subject was found to be in overall average condition. The bathroom and kitchen appears to be original. Functional inadequacy noted as the kitchen lacks adequate cabinet space and has no countertops. ADVERSE ENVIRONMENTAL CONDITIONS: Unless stated otherwise in this report, the value estimate stated is based on the assumption that the property is not negatively affected by the existence of hazardous substances or detrimental conditions. The existence of hazardous substances or detrimental conditions which may or may not be present on the subject property or surrounding properties, was not observed by, or known to the appraiser. After adjustment the sales indicate a value range of $183,500 to $194,500. The greatest weight is given to the mid -range of value. Sale rya was adjusted upward for location as it is located on a main thoroughfare with traffic. Since much of the subject site is unusable due to steepness and ruggedness, no adjustment was made for site size. The subject and all of the comparable sales have sites with acreage and were all considered to be similar in appeal to the subject site, thus no adjustment was deemed necessary for site. Indeed, sales #3 &4 like the subject had brooks on their sites. A positive time adjustment of 8% per annum was made to sales //1 -3 to reflect the rise in property values in the area. Sale //4 was adjusted upward for time at 8% per annum, however, the adjustment was made beginning in 1998, which was when property values in the area began to escalate. Sale 1/4 was sold at the end of 1996, however, it was chosen as a fourth comparable sale as it is located next door to the subject and has a similar site with the same brook. All of the sales were adjusted downward for functional utility to the reflect the inadequate kitchen (lack of cabinet and counter space) of the subject. As the subject site and improvements are unique, there were no sales available identical to the subject in its entirety.
