Dear Mr. Mirakaj:
I have received and reviewed the plans for the proposed addition to the above - mentioned residence.
The proposal for the addition has been approved as per plans bearing the approval stamp from this
Department dated September 22, 2003 . The addition is approved with the following conditions.
1. The total number of bedrooms must remain at two without prior approval by this

2. The area of the existing sewage disposal system, and its expansion area, must be
maintained.
3. All plumbing fixtures must be updated with water saving devices, i.e., new low
flush toilets, restrictors for shower heads and faucets, etc.
Any other permits or variances required are the responsibility of the applicant and the jurisdiction of
the Town of Patterson.

WHEREAS, Viktore Mirakaj has made application to the Patterson Zoning Board of Appeals for
a variance of the side yard setback requirement as set forth in Chapter 154 of the Patterson Town Code to
construct a 2nd story addition, 22' x 27' to the existing dwelling, and
WHEREAS, Chapter 154 of the Patterson Town Code requires a 10 foot side yard setback within
the APL -5 Zoning District and the Applicant only has existing 1.5 feet; variance requested for 8.5 feet,
and
WHEREAS, the proposed action constitutes a Type II action under 6 NYCRR Part 617, and
therefore, requires no further review under the State Environmental Quality Review Act (SEQRA), and
WHEREAS, a public hearing was held at the Patterson Town Hall, 1142 Route 311, Patterson,
New York on June 18, 2003, and a site walk on June 25, 2003 and the public hearing continued on July 16,
2003 to consider the application; and

WHEREAS, the Patterson Zoning Board of Appeals has given careful consideration to the facts
presented in the application and at the public hearings and finds that:
1. the proposed application will not produce an undesirable change in the character of the
neighborhood or the nearby properties and it will not have an adverse effect or impact on the
physical or environmental conditions in the neighborhood;
2. the benefit sought by the applicant cannot be achieved by any other practical or feasible means;
3. the variance requested is not substantial;
4: the difficulty is not self - created and failure to grant would cause considerable hardship on the
Applicant;
NOW, THEREFORE BE IT RESOLVED, that the Patterson Zoning Board of Appeals hereby
grants the application of Viktore Mirakaj a variance of 8.5 feet for the side yard setback requirement as
set forth in Chapter 154 of the Patterson Town Code.
AND BE IT FURTHER RESOLVED, that the variance granted herein is subject to the following
special conditions:
1. The oil tank on the on the north side of the house must be relocated it is
encroaching on the adjacent property.
2. The shed in the rear of the property must be relocated to comply with the
rear and side yard setbacks in that zone.
