Re: Private Sewage Disposal
Empire Road, (Ti Patterson
(R.: Minnelli)
Your. preliminary submissioh.forrevhlew for a,proposi
ed sewage disposal on the
above noted parcel near Putnam Lake has been reviewed. -
Well separations necessary to protect the proposed well are not indicated
to meet the requirements of the County Rules and Regulations. In addition, the
area available upon which a sewage system can be de6ighed,is extremeily, small by
County standards, As such, this office had indicated, that we could not grant
approval, and thus it was requested that it be presented to the Board of Health
for discussion kelative to granting of'variances.
This was informally discussed at the October Board of H.ealth.meeting and the
Board-requested---me -to-6ommunicate their -opin ion to you* The Board feels that-in
the Public Health interest, the variances will not be granted because of the
proximity of three sewage systems to the proposed well judged together with the
rock and soil conditions specific to this`lot. In addition, the extreme li-mita-
tions to possible size of a sewage system which could be installed even without
required expansion area weighs against granting of variances.
The Board was advised of the concern of the owners and appreciate the hardship
involvedi but regretfully feel the-concetn for public health must be considered
first*
Very truly yours,
Robert Jo Caddell,, P.E.

Mr. & Mrs. Rosario Minnelli (Contract Vendor) to Mr. John J,
Sullivan (Contract Vendee) - Lots C -3320 thru C -3324, Empire &
Batavia Roads; Putnam Lake, Town of Patterson w/ potential for
purchase of additional lot (C -3286) from Mr. & Mrs, John La
Carrubba
SUGGESTED VARIANCES FOR CONSIDERATION BY THE BOARD OF HEALTH:
1. WELL - Proposed well for the parcels) is to be positioned in the
most advantageous position; however, this is still not in keeping wit
the Code; necessary variances:
a. less than 100' to nearest part of own s.d.s. - 751
b. less than 1001 to neighboring septics - opined locations after
speaking with adjoining owners, and applying good engine ®ring judgeme
I. 611 ft to Siiegrist Se3&i® - (note their own well is closer
than that; and in.addition, there is a small drainage swa,le between
their Septic and the proposed well. Said swale runs alongs the
approximate propertyline)
II. 65+ to Brumerhof Septic - opined not in the direct line of
drainage; further there is a paved road between the tiro.
2. SEPTIC SYSTEM - Proposed area reserved for sanitary disposal syste
is too small to adequately support a system and expansion in accordan
with the requirements of the health code. Necessary variances would
include:
a. -under 5.000 s.f. usable area:. _
expansion - some expansion can be gained by considering
house as a 2J bedroom vice three; and moving some expansion closer to
DiP &etro well. This well was drilled in an area different from that
already approved by the town's building inspector. As such, it seems
unfair to enforce a 100f offset to this well; however, this would
only be used for expansion purposes.
co permit the the fields to be run to'the street line vice the
code specified 101 minimum offset.
d4 less than 50% expansion available.
39 HOUSE - The contract vendee is fully aware of the problems associa ed
With the lot, and is willing to accept their limitations. Presently
his family consists of he, his wife, and two children, with a third
expected shortly. Fully recognizing the limitations of the lot,. he
is willing to construct a house consisting of 2J bedrooms. This
would accommodate a family.of five per present design standards.
a. Variance.for not.a three bedroom dwelling.
ENGINEER'S RECOWENDATIONSs All parties fully recognise the limitati
or e o however, t5y wish to proceed with obtaining approval and
go on with building. I personally feel hard put to explain to all
parties why the health department would deny them their right to buil
I personally feel that with proper precautions, a safe pure well can
be obtained at the location specified; further, after witnessing the
deep holes & percolation tests, I believe the parcel (with the
aheet 2 of 2
additional lot added) is capable of adequately supporting the.systemo
Having iio vested interest in the land l certainly wouldnot risk my
i ®nyin_ this regard unless I felt conGident of the d®signo
I respectfully suggest that Mr. Caddell and the Board review informally
the attached ten scale plan(s), and form some tentative positions -o
I should then like to requestD at the authorization of my clients,
to have this item planed on the agenda for the Boards meeting f,qr.
November. At that timeD both the MihnelliQs and the Sullivans 'should,
! -like-to appear before the Board.
again, Z appreciate your consideration in our regard.

As per my meeting of Thursday, October 10, 1974, and subsequent
telephone calls on Monday, October 14, 1974 to both tars o Minn.0111
(owner), and Mr. Sullivan, contract vendee, on the above matter, and as
relayed to Mrs o Trankina when she Balled on Tuesday,, the Board of
Health will not ,be meeting until this Tuesday night, October 22, 1974;
however, based upon recent developments, there Is no reason for any of
us to be there. Permit me to explai.no
Afro Robert J. Caddell, PoE., Director of tfie Division of Enviroxmental
Health Servioes, and Inlet on this putt ler, - and add tirnal deep holes
were requested where each of the shall ft seepage Pits were proposed,
After n"Iscussi ng this topic with `'po v 1141 nelll ar:d Sullivan, it was
decided to go abiesel with the dii ing of the hales, even though the
results might not Influence tl -te +.oardts deei.s.lon, The Doard, ''ro
Caddell felt, would be opposej. to our placing of the proposed well less
than seventyfive feet from a teighboring, septic field. We have no
alternative what with. the . ge ome try of the Iota . ,
This past Thursday,, a baekhora was rented, and four (4) new deap holes
were dug. The results indicated t1le presence of ledge roc*'.- at 7 1
down thus ruling cut the use of anything but shallow pits, or conventions
and the building
inspector to look at them a the neighbor across the street hadnot drilled
his well where originally v- ooposed; a-ad this has further :reduced the
€ vailaol.e area for septic p 1,irvoses .
In vier of the changed conditions because of the ledge rock its the
area, and the presence of this new well, 6 plans have to be modified,
Mr. JaG.de'll has suggested that, rather than a formal presentation to
the Board thi.e month, that he make an_ Informal presentation to them;
and after that time,, a defined direction would be available with
regard to completing the worm, and a formal presentation rasde to the
Board dlarint; their
yraeo ti.ng, ne -t manta (the third 'Tuesday of the
month, i .e o , tYove?nber 1, 197 'While I am anxious to receive payment
for my servicea in this matter, and certainly realizing the.anxi. ®ty of
all parties conwerned to resolve things 'as soon as possible; I suggest
that this nethod Is the beat available under the circumstances.
If the Foard turns clown the presentation., informally,, there is still the
right to a.ppoar before diem the f'o11ow1n., month, and at that time present
all the continf ency factors, and hume.n- 1.st1c .reasons for approval. It is
my considered ,pinion that this course of action be followed. Therefor,
please donot attend this Tuesday's meeting, and let us wait for the
outcome of the informal dt saussi.on, as chaired by " ,4r. Caddello I
suggest that even if the results are negative,, your ultimate recourse is
to a formal weeting with the Board of Health the following month. I,00kiN
