The proposal for the addition has been approved as per plans bearing the approval stamp from the Department dated October 9, 2008. The addition is approved with the following conditions: 1. The total number of bedrooms must remain at two without prior approval by this Department. 2. The area of the existing sewage disposal system, and its expansion area, must be maintained. 3. All plumbing fixtures must be updated with water saving devices, i.e., new low flush toilets, restrictors for shower heads . and faucets etc. 4. The approval is for the proposed changes only. This approval does not validate any construction shown as existing that has not obtained proper approvals. Public Health Director On April 20, 1992 the Board of Health considered your request for a variance from the provisions of Article III of the Putnam County Sanitary Code and Standards of the Putnam County Department of Health as set forth in your letter dated March 1.6, 1992 and the attached plan. Review of this request by the Board indicated as follows: 1. The addition has been reduced in size from 833 square feet to 450 square feet. 2. The addition is for two bedrooms. 3. The existing well to subsurface sewage disposal system (SSDS) separation distance will not be improved, but remain at approximately 40 feet. 4. Information regarding the existing SSDS is not available to verify that it is designed to serve a two bedroom house. 5. Area does not exist on this property to install a well in compliance with todays standards which require a 100 ft. separation distance. s 1 s Based upon the above, specifically in light of the fact that the well to SSDS separation distance is not being improved and that the major criteria for the Board's rejection of this application in the past was the inadequate well to SSDS separation distance of only 40 feet, the Board did not feel that this proposal differs substantially from the previously rejected proposal and therefore, voted unanimously not to grant a new hearing on this application. Public Health Director You are hereby advised that your request for a. variance from the provisions of Article III of the Putnam County Sanitary Code and the standards of the Putnam County Health Department relative to the provision of adequate sewage disposal and water supply facilities to serve this property has been considered by the Putnam County Board of Health on September 16, 1991 and denied for i:he following reasons: 1. The "old" well is capped and no longer used. The owners have no idea of when it last functioned. c.) The wells and septic tanks of the neighbors that are on four (4) sides of the Rea home are located about the following distances tfrom the Rea home water well; d,) The existing legal septic holding tank is located in Parcel C -2651 about 14'± from the property line at 5haron Road. This is downhill from the existing well and location of the proposed addition. e.) The existing legal 100'± deep well is located in Parcel C -2552 about 10'± from the property line, downhill from the proposed addition. f.) The disconnected well is located .in Parcel. This precludes any possible contamination of the drinking water. (no scale indicated) These plans indicate a one (1) story high addition with an 8' -0" high ceiling and a 4' -0" high crawl space with perimeter footing drains around the entire foundation wall. This addition is to be approx. 17-0" wide by 49' -6' long. There is no second floor propoeedl i'leaee see the enclosed drawing which locates the owners existing legal well location and existing legal septic system holding tank location. The owner has gone to great-effort to measure the distances from the corner of his existing home where the proposed addition will occur to all of the neighl;,oring homes; wells and septic holding tanks. These measurements are indicated on the enclosed drawing _._._.. and.clearly.showthat no neighbors well is within 100' of the existing legal. septic system holding tank location of Mr. and Mrs. R-- ea. Please not that the existing legal septic system is on the 5OUTH side of the property (down hill side) and the proposed addition is located on the NORTH side of the property (uphill side) with an elevation increase of about 10 % ±. To the best of my knowledge, sewage from the existing holding tank and septic cannot run uphill to the location of the proposed addition and can not pose any potential health hazard. This proposed addition is designed to: Be cost effective and affordable to my clients. Provide two (2) bedrooms and a pool /game room for two (2) growing girls and their parents who require privacy, storage and spaces of their own. Be one (1) story high. Mr. Paegelow summarized his letter dated September 16, 1991 and June 28, 1991. No adjacent property owners were present. John Karell indicated that the existing well is approximately 40 feet from the subsurface sewage disposal system serving the house and that sufficient area exists to drill a new well ± 75 feet from the existing septic system. Mr. Paegelow indicated that his clients cannot afford a new well. In addition Mr. Karell indicated that the Department considers the addition to.be three bedrooms, the present house has two bedrooms. Discussion followed. Dan Doyle made a motion to grant the variance, Sara McGlinchy seconded the motion. In favor, zero, opposed all members present. See attached letter from Sara McGlinchy, President of the Board of Health dated September 18, 1991. Mr. Paegelow asked what was his clients recourse in light of -the denial of the variance request. He was advised that an Article 78 proceeding was his client's recourse. Preliminary Variance Discussion D. See. _letter dated June 5, 1991. rhich .sets .forth_ the variances requested. - Mr; "K"arell -advised-the-Board- that'-'he is concerned regarding" t:he" grading" in the area of the north property line adjacent to the ends of the trenches that sufficient fill is not provided extending 10 feet beyond the ends of the trenches. Mr. Karell suggested a wall on the property line but the engineer prefers to place the wall 5 feet within, which will provide fill only 5 feet beyond the ends of the trenches. Mr. Karell noted that the proposal is for a three bedroom house and that he discussed with the engineer decreasing the number of bedrooms to two, which will reduce the required size of the septic system, and will eliminate the problem with the fill and the trench ends. Decreasing the number of bedrooms will not however affect the variances requested. Such review indicates as follows: 1. Both the well and SSDS locations shown on the previously submitted plan were shown in error. The presently reported well and SSDS locations provide a separation distance between these facilities of 45 feet. Todays standards require a 100 feet separation distance. 2. An area does not exist on the property to provide expansion area for the existing septic, 100 feet from the existing well. 3. The existing house contains two bedrooms. 4. The proposed addition provides for 2 bedrooms and a pool /game room. The Department considers the pool /game room to be a third bedroom. 5. No information has been provided as to the size or makeup of the existing SSDS. Based upon the above, since the sewage disposal system and well do not meet todays standards, most significantly, the separation distance between the well and SSDS are inadequate, this proposal to expand the dwelling cannot be approved. While it is realized that the configuration of the property will not allow installation of a well and SSDS meeting todays standards, the Department will consider approval of an addition on this property provided the following is accomplished: ' P -2- 1. Reduce the addition,to two bedrooms by eliminating the third room WO-11 2. Install new SSDS area or relocate the well to provide a minimum well to SSDS separation distance of 75 feet. Padovanl, M.T. (ASCP) and was found to be of a satisfactory sanitary quality when the sample was taken. There are currently two (2) bedrooms and with the requested variance to allow an addition there will still be two (2) bedrooms. They will just be bigger and in a different location. 3.) We request a Variance, of Article III of the Putnam County Sanitary Code, and a waver from a provision of this Article, in accordance with Section 75.6 of 10 NYCRR Part 75, because a financial hardship has already been created for the Rea family due to the delays of this waiver To continue living in their existing home with their daughters, Mr. and Mrs. Flea will have to enlarge the bedrooms. This of course means that construction will be, required. It has been determined .that not only is more room needed for sleeping, but also more room will be required for storage, eating and recreation. Mr. and Mrs. Rea have taken a second mortgage on their existing home to pay for this relocation of rooms and addition of adequate sized bedrooms. This second mortgage is for $30,000.00 and is all the bank would allow against their existing home as it is. This is not something that can now be given back. With their joint family income making abilities and the added financial responsibilities of repaying this new second mortgage, this family has stretched its financiall potential to its financial limits. The estimated cost for single family housing construction in this area is currently running between $85.00 and $115.00 /square foot depending on construction complexity and contractor greed. The Rea proposed addition is about 17'x 50' = 850 s.f. and could cost between $72,250 and $97,750 IF it was built by a contractor. Mr. Rea with the help of his friends will be the general contractor with a budget price of about $30,000 for construction. This is all they can afford. The monies available for having the 'American Dream" of a private home of adequate size built by others are severely limited by financial considerations and the only way the Ilea family can afford to accomplish this is for the family to do the construction themselves. Any monies taken away from this extremely tight budget could stop this project before it was completed, thus adding further to an already strained situation. Adding the cost of drilling another well could take 15% of all the construction budget and adding another septic field could cost even more monies. Materials increase in cost as everyone wafts, and the always increasing costs can only further diminish this families financial abilities. The building Inspector of Patterson, N.Y., Mr. John Calbo has advised me that he will issue a Certificate of Occupancy (C. of O.) for this construction when it is completed as per my drawing, for a two (2) bedroom home only. This means that this home could not be sold to anyone else any other way. Director The Board of Health recently has considered and denied several requests for variances for the installation of subsurface sewage disposal systems proposed to serve additions to existing residences. These building additions to dwellings were proposed on very small parcels of land -where existing well to sewage system separation distances and sewage system sizes were considerably less than is required by present day codes and regulations. While it is recognized that these situations are considered to be pre — existing and. non—conforming properties, the Department cannot approve additions to houses - on such- properties- Chien' would further tax the water supply and sewage disposal- facilities and where present day standards cannot be met. In addition, the Board of Health has not granted variances where it is proposed to utilize an existing SSDS or well that cannot be upgraded to present day standards, or at least close to present day standards. You should be aware that the Department will make a decision regarding the approval of sewage and water supply facilities proposed to serve house additions with merely a sketch of the proposed modifications to the house, which sketch may be prepared by the homeowner. In this regard, in several recent instances, it has come to our attention that homeowners were required by a local town official to obtain detailed architectural or engineering plans for the proposed addition, usually in conjunction with a variance application to a zoning or planning board, prior to any contact whatsoever with this Department. In several cases, our approval could not possibly have been granted due to the size of the lot, however, the homeowner had already spent hundreds or thousands of dollars on the house plans, unnecessarily. Mr. Rea with the help of his friends will be the general contractor with a budget price of about $30,000 for construction. This is all they can afford. 5ECOND MORTGAGE TAKEN TO FINANCE HOME ALTERATION Mr. and Mro. Rea have taken a second mortgage on their existing home to pay for this relocation of rooms and addition of adequate sized bedrooms. This second mortgage is for $30,000.00 This is not something that can now.be given back. With their joint family income making abilities and the added financial responsibilities of repaying this new Second mortgage, this family has stretched its financial potential to its financial limits. Large mechanical machines capable of excavating in the winter seasons will not be financially available to this family who must do their own construction work. This project must be a "warm weather" project to be affordable. ® Materials. Materials increase in cost as everyone waits, and the always increasing costs can only further diminish this families financial abilities. Definition of this home. Our intent is to get adequate Sized bedrooms for children and adults, desperately needed storage ability, a dining room and the capability for recreational area that Some lively growing children can grow in with the supervision and involvement of their parents. The building Inspector of Patterson, N.Y., Mr. John Caibo has advised me that he will issue a Certificate of Occupancy (C. of 0.) for this construction when it is completed aS per my drawing, for a two (2) bedroom home only.
