Signature: v PERMIT TO CONSTRUCT A WATER WELL This permit to construct one water well as set forth above, is granted under provisions of Article 10 of the Putnam County Sanitary Code and Subpart 5 -2 of Part 5 of the New York State Sanitary Code and provided that within thirty (30) days of the completion of water well construction, the applicant or their designated representative shall: 1) Pump the well until the water is clear. 2) Disinfect the well in accordance with the requirements of the Putnam County Health Department. 3) Submit a Well Completion Report on a form provided by the Putnam County Health Department. During all well drilling operations, the applicant and/or well driller shall take appropriate action to assure that any and all water and waste products from such well drilling operations be contained on this property and in such a manner as not to degrade or otherwise contaminate surface or groundwater. Nichols Jr., P.E. last revised September 24, 2004 Dear Mr. Darnell: The Town of Patterson Building Department is in receipt of the above - mentioned plan showing changes to the proposed grading and construction at the site. Wyndham Homes had previously submitted a plan for the development of this site prepared by Terry Bergendorf Collins, LS dated April- 2,.2004..whirh on.May.20,,2,0Q4.l issued a memo with a findings. that the Plan, as submitted, did not exhibit any significant deviation from the approved subdivision w plat and construction plans. On June 23, 2004 I met with you on the site to discuss the difficulty that you were having in accessing the location proposed for installation of the well. During that meeting I found that the house and grading plan had not been constructed as was shown on the plans submitted to the Town. Specifically, the site plan submitted to the Building Department showed the finished floor elevation at 679' or approximately two feet below the road surface at 680'. The basement floor elevation at 669' was one foot higher than the eastern (rear) finished grade elevation of 668' shown on the plans. What had actually been constructed at the site was that fill had been brought in to the rear of the foundation and had been graded to about 2' below the finished floor elevation, or roughly 7' higher than shown on the plans. Further, the height of the foundation would place the finished floor elevation much lower than the level of the road (perhaps 6' to 8 "). To avoid any erosion of the embankment we discussed at the site that the slope of the fill section should be softened and immediately seeded and mulched. Should any rills develop, they should be immediately repaired and a erosion control blanket be installed. Finally; you were informed, as was the Building Inspector the following day, that a plan should be submitted showing corrected topography and the changes to grading of the lot. Oct 14 04 12:07p TOWN OF PRTTERSO 845 -878 -2019 p.3 The latest plan that you have now submitted still does not show grading as it currently exists at the site or how you plan to permanently stabilize the embankment to the east of the house. I will not recommend to the Building Inspector that the stop work order on the house be lifted until such time as plans which accurately reflect any existing and proposed site improvements have been submitted. On October 13,'2004',-1 requested; by letter, that the Town of Patterson allow the grading of the fill in the SSTS area. It was also clearly noted that 7 ft. test holes must be excavated in the fill pad. On October 26, 2004, Harry Nichols requested that Mr. Gene Reed, Senior Engineering Aide, witness the deep test holes in the fill pad. Mr. Reed noted that only one 7 ft. test hole was excavated, and the fill depth was 4 feet in the 7 ft. hole. Two additional shallow holes were excavated and the fill depth of two feet was recorded in both holes. Mr. Reed also noted that the fill pad size was not adequate. On October 27, 2004, during a site inspection I requested 7 ft. deep test holes be excavated as stipulated in the letter of October 13, 2004. The following deep test hole data was recorded; test hole( #1), ledge at 5 feet, 2 feet of fill, test hole (# 2), ledge at 5 feet, 2 feet of fill, test hole (#3) ledge at 5.5 feet, 3 feet of fill, test hole ( #4) 7 ft. depth, 5 feet of fill. Due to the fact that the fill depth exceeds 2 feet and the depth to ledge is less than 7 feet, I am requesting guidance on how to proceed with this project. The house is not located as per approved plans. 2. The SSTS cannot be constructed according to the approved plan because of the existing house location. 3. The raised SSTS is proposed with trenches 38 feet upgrade of the foundation. Current codes require a minimum of 50 feet. 4. The raised proposed grading is showing off the property. 5. Trenches are not shown with 2 feet of solid pipe. 6. A retaining wall is shown 12 feet from a trench. The minimum distance with 2 feet of fill is 16 feet. 7. An equal distribution expansion area has not been provided. 8. Grading is not shown parallel to the trenches. 9. Grading is shown approximately 5 feet deep in the road R.O.W. 10. Minimum distance from the D -box to the driveway is 10 feet. 11. Pump chamber is proposed within 10 feet of the house foundation. 12. Expansion trenches do not scale to the noted lengths. Please be advised that this Department will require additional deep test holes in the fill pad to verify depth to ledge or 7 feet, whichever comes first. Please also be advised that the deep test holes are to be excavated in the presence of a Health Department representative, i.e., a machine must be on site. The Health Department representative will direct the machine operator where to excavate the deep test holes. 3. The proposed plan must be revised to meet the outstanding comments noted on the stop work request dated 9/21/04. 4. As previously explained, house erroneously located in field. 2. SSTS could be constructed essentially according to the plan based on the following responses. 3. The general slope and flow path of the SSTS is south, left to right when - facing-the-structure. However, the-NYS- Dept: -•of- Health- 1996- regulations - recommend that an impermeable barrier such as clay should be considered to prevent short circuiting when. absorption facilities must be located close to foundation drains. We are proposing such a barrier. 4. The raised grades at the site frontage and within the R.O.W. of Apple Hill Road are based on the required two (2) feet of fill in the SSTS area and the elevated existing finished grades of the roadway. 5. Trenches shown with two (2) feet of solid PVC. 6. Driveway can be shifted four (4) feet north or clay barrier installed between SSTS and proposed wall. However, maximum height of wall along driveway is only two (2) feet. 7. Enclosed is sketch of equal distribution expansion area. 8. Due to short length of trenches, grading differential can be accommodated by permitted variable. 9. Grading in R.O.W. must meet new road grades. 10. D -box located minimum 10' from driveway. 11. Pump chamber located minimum 10' from foundation. 12. Expansion trenches in most instances scale longer than noted. The Board hereby determines that the lands shown on the plat are not suitable or otherwise practical for the location of adequate recreational facilities in the neighborhood and the relationship of the property to the Town's recreational objectives expressed in the overall plan. The Board therefore finds that a recreation fee for each newly created lot, in such amount as the Town Board shall have established on the date that the final subdivision plat is presented for signature by the authorized Planning Board representatives, shall be paid to the Town Clerk prior to signature of the plat; 3. In the event the signed plat expires prior to filling or is subsequently submitted to the Planning Board for modification, any difference between. the recreation fee paid and the recreation fee in effect at the time the plat is again presented for signature by the authorized - Planning Board representatives shall bepaid to the Town.Clerk prior to signature of the plat. F GENERAL CONDITIONS: 1. Submission of a final subdivision map in proper form, bearing original signatures of the owner(s) and the professional who has prepared and sealed the plan; 2. Submission of a bond or other surety in the amount approved by the Town Board, in accordance with Section 138 -14, and in a form deemed acceptable by the Town Attorney, which guarantees the completion of required improvements shown on the final subdivision map, or the completion of all required improvements as shown.on the final plat and associated construction drawings. "Substantially completed" shall mean the completion of all road improvements required by Town standards and specifications, as shown in the subdivision plat and any accompanying construction plans, including drainage, grading, seeding and erosion control measures, up to but not including the finish course of asphalt, for that portion of the subdivision for which building permits are desired. The minimum length of road which may be substantially improved shall be one thousand (1,000) feet. 8. In the event that any of the material submitted in relation to this application is inaccurate or misleading, or the owners of the project do not have the legal right to develop or use the property where and as shown on the material submitted to this Board, then any approvals herein granted are found null and void. 9. Submission of approvals from all other agencies for which a determination is needed for this subdivision. 10. As a condition or the issuance of a wetland/watercourse permit for an individual lot, the issuing agency may require that the applicant construct or install permanent identification to delineate the wetlands buffer, excluding any area that will be disturbed, which permanent identification may include construction of a stone wall. 4. A conservation easement will be created for the regulated wetland areas on the site and held by a land trust or the Town of Patterson. This conservation easement shall be referenced in each property deed. 5. The Applicant shall address the issues identified in the Dufresne -Henry memorandum dated September 6, 2001. 6. A note shall be placed in each deed which states "For as long as any portion of the property described in this deed is subject to regulation by the Town of Patterson by any regulations governing the permitted activities that may occur in wetlands and/or watercourses, there shall be no construction, grading, filling, excavating, clearing or other regulated activity within a wetland area as defined and regulated by the Patterson Town Code, including a 100 foot control area surrounding the wetland area without having first secured the necessary permission and permit required pursuant to the Patterson Town Code. "Substantially completed" shall mean the completion of all road improvements required by Town standards and specifications, as shown in the subdivision plat and any accompanying construction plans, including drainage, grading, seeding and erosion control measures, up to but not including the finish course of asphalt, for that portion of the subdivision for which building permits are desired. The minimum length of toad which may be substantially improved shall be one thousand (1,000) feet. 8. In the event that any of the material submitted in relation to this application is inaccurate or misleading, or the owners of the project do not have the legal right to develop or use the property where and as shown on the material submitted to this Board, then any approvals herein granted are found null and void. 9. As a condition or the issuance of a wetland/watercourse permit for an individual lot, the issuing agency may require that the applicant construct or install permanent identification to delineate the wetlands buffer, excluding any area that will be disturbed, which permanent identification may include construction of a stone wall. 4. A conservation easement will be created for the regulated wetland areas on the site and held by a land trust or the Town of Patterson. This conservation easement shall be referenced in each property deed. 5. The Applicant shall address the issues identified in the Dufresne -Henry memorandum dated September 6, 2001. . 6. A note shall be placed in each deed which states "For as long as any portion of the property described in this deed is subject to regulation by the Town of Patterson by any regulations governing the permitted activities that may occur in wetlands and/or watercourses, there shall be no construction, grading, filling, excavating, clearing or other regulated activity within a wetland area as defined and regulated by the Patterson Town Code, including a 100 foot control area surrounding the wetland area without having first secured the necessary permission and permit required pursuant to the Patterson Town Code.'This restriction shall bind the Grantees, their successors and Assigns and shall be expressly set forth in all subsequent Deeds to this property". 7. The Town of Patterson Environmental Conservation Inspector shall be notified two full days prior to any disturbance in a wetland area or the adjacent control zone. .8. Orange construction fence shall be installed at the boundary of the wetland control area prior to any disturbance occurring within 500 feet of that area of the boundary. 9 The Project Owner shall post permanent tags or markers along the boundary of the wetland buffer line, which identifies the area as "Regulated Wetland area ". 10. The Applicant shall evaluate in good faith the feasibility of reversing the area proposed for the septic system on Lot #24 with the house location. 11. The Environmental Conservation Inspector shall review and approve the wetland plantings for the Water Quality Basins.
