Director Review of the above captioned file indicates that several documents exist to clarify the Department's actions relative to this property as follows: 1. 11 -4 -85 Letter Tutoni to Wilson 2. 12 -11 -85 letter Karell to Wilson 3. 1 -24 -86 letter Bruen to Karell 4. 1 -29 -86 letter karell to Bruen 5. 6 -1 -86 letter Barker to Simmons 6. 6 -4 -86 letter Simmons to barker 7. 6 =10 -86 Wilson to Karell As I now recall, Milt Wilson refused to run soil, percolation tests for us to witness, see. item 13 in my letter ,dated December 11, 1985 and the third comment on page 2 of my letter to David Bruen dated January 29, 1986.. We believe that the soil rates are higher than Mr. ' -- Wil "son has ' ind'icated' on - Wig- plans-;, This property contains only 9500 square feet.orless than 1/4 acre. In addition, if the 15 feet well to property line distance was the only problem, we would have approved this at 5 feet from the property line. A review of the files indicates that was not the case. This matter never appeared before the Board of Health. A request was made by Mr. Barker to Dr. Simmons, in his letter dated June 1, 1986. Dr. Simmons response is attached and basically advises Barker that more information was necessary on the plans, specifically but not only, our witnessing of soil percolation tests. It should be noted that Mrs. Lobraico's appearance before the Board of Health on November 30, 1987 was for another parcel of land in Patterson on Canton and Barnard. The application submitted for the above noted has been reviewed by this Division and has been rejected.for the following inadequacies:' a. Less than the required 100 1.separation from well and sewage disposal system b. Design criteria.used does not provide the necessary area needed for sewage disposal; e.g., 2 bedroom residence designed on'8 -10 min. soil equates to 666 square ft. of absorption area, including the required expansion. Plan submitted shows maximum area totals 522 square ft. with proposed requests from code regarding place- ment of proposed well. It is suggested that the applicant investigate the possibility of acquiring more land so that a substantial sewage disposal system can be developed with the proper separations from the proposed well. Apparently' Mr. Barker purchased a lot in Putnam Lake at Addison .and Lake.Port on the verbal approval that Health approval would be given. The verbal approval was reportedly given by Mr. Tutoni. This occurred three to four months ago, and yet the Health approval has not been issued. There are three additional lots now in process where various questions have been raised on both. sides of. the issue regarding • -ap•pr- oval- °•a-n--d- -a-1-so-involv-ing. a J "var- i•an•ce4 o•f .•He- a- l- t- h—D•epar -tment regulations in some.cases. The purpose of this communication ,is to express my concerns about the process and the apparent lack of action in these situations by the Health Department. Deouty- Commissioner Reference is made to your inquiry dated January 27, 1986 relative to approval.of plans for a sewage disposal system and well water supply proposed to serve a parcel of land owned by George Barker and Maureen Lobraico in Putnam Lake, Town of Patterson. Please be advised as follows relative to this matter: 1. I have discussed this matter with Mr. Tutoni who has indicated that he did not grant verbal approval of this project at any time. 2.. Plans for sewage systems and wells on two lots of similar size adjacent to 'tIi'is '-pafcdl---have'-lieen ' submitted ' to this Department for - approva' recently. One was approved last stunner and the second was disapproved on November 19, 1985. A third lot in the area is the subject of an application for approval of plans, however, this lot is considerably larger and will most likely be approved upon receipt of revised plans from the design engineer. 3. Mr. Barker's application has been the subject of several office and telephone conferences and field visits with Mr. Wilson, the Barker's engineer. The original application was received in this office August 26, 1985, reviewed by Mr. Tutoni, and rejected by letter from Mr. Tutoni, dated November 4, 1985 after consultation with the writer, based upon inadequate area provided for sewage disposal. Apparently Mr, Barker purchased a lot in Putnam Lake at Addison and Lakeport on the verbal approval that Health approval would be given. The verbal approval was reportedly given by Mr. Tutoni< This occurred three to four months ago, 'and yet the Health approval has not been issued. There are three additional lots now in process where various .-q.ue-sti-orrs •iya-ve•-been raised on both -- si °d•e-s -of ---th•e--- i ssu,e- regard-i ng- approval and also involving a "variance" of Health Department regulations in some cases. The purpose of this communication the process and the apparent lack by the Health Department, is to express my concerns about of action in these situations I would appreciate your investigating the matter and providing this office with an overview of these cases. M.D. „_ ... _ - • • Deputy Commissioner DEPARTMENT OF HEALTH Division Of Environmental Health Services January 29, 1986 I RE: Proposed Construction Permit Barker - Addison Road/Lakeport Drive (T) Patterson TM #55 -3 -7 Dear Mr. Bruen: Reference is made to your inquiry dated January 27, 1986 relative to approval of plans for a sewage disposal system and well water supply proposed to serve a parcel of land owned by George 'Barker and Maureen Lobraico in Putnam Lake, Town of Patterson. Please be advised as follows relative to this matter: 1. I have discussed this matter with Mr. Tutoni who has indicated that he did not grant verbal approval of this project at any time. 2. Plans. for sewage systems and wells on two lots of similar size adjacent -to -this parcel-have been submitted to­ this Department, f or approval recently. . One was .approved last summer and the second was disapproved on November 19, 1985. A third lot in the area is the subject of an application for approval of plans, however, this lot is considerably larger and will most likely be approved upon receipt of revised plans fran the design engineer. 3. Mr. 'Barker's application has been the subject of several office and telephone conferences and field visits with Mr. Wilson, the Barker's engineer. The original application was received in this office August 26, 1985, reviewed by Mr. Tutoni, and rejected by letter from Mr. Tutoni, dated November 4, 1985 after consultation with the writer,'based upon inadequate area provided for sewage disposal. Two subsequent revisions and a conference with Mr. Wilson, in my office on November 25, 1985, resulted in a second rejection, from the writer in a letter dated December 11, 1985, for similar reasons. - continued - TWO. David Bruen - 2 - January 29, 1986 Mr. Wilson was advised during the aforementioned conference and the December 11, 1985 correspondence that a variance from the required separation distance between a well and sewage system of 100 feet would be considered pending: - submission of plans for the well and sewage system with all appropriate details. - submission of house plans for a bona fide two- bedroom house. (The plan submitted contains space that, could be converted to additional bedrooms in the future.) the Department witnessing a.soil percolation test on the property. (It should be noted that soil on two adjacent lots exhibited much high soil percolation rates.) - submission of a variance request to Mr. Jones, President of the Board of Health. Copies of the aforementioned correspondence are attached. Revised materials or a variance request have not been received in this office to date. JK :mk enc.
