Drilling Company and Mr. Tim Simpkins, New Fairfield
Sanitarian, have consulted me about a proposed well on the
property adjacent to mine on Hopewell Drive in Putnam Lake..
Mr. Sal Lima is now the owner of ,record and while the
majority of the parcel is in Connecticut, a tiny portion is
in New York.

property that is in New York, within 50 feet of my septic
system and within 5 feet of my .sideline and 5 feet of the
road. In Mr. Boyd's words : he wishes to "sneak it on" and
will attempt to make a deal with N.Y. and CT. authorities.
This proposed well is not about water. There is another well
on the property and the State of Connecticut refused to allow
the proposed septic to be used with the existing well.
Mr. Lima is not a victimized party .since he is not the
original owner and has purchased the lot in the past year
with full knowledge of its drawbacks and weaknesses.
The property is listed as .226 of an acre. It doesn't meet
the usual criteria for lot size. As you are probably aware
this Ball Pond area has had its share of publicity for septic
failures on small parcels.
Although there was an illusion of a house on the property,
the record shows that it had been abandoned, condemned and
torn down. Mr, LaVelle, (New Fairfield town attorney)
advised the Zoning Board of Appeals that this property is not
eligible as a rebuild.
As to the question of hardship, it would seem that Mr. Liana
has created his own hardships.
Mr. Simpkins is treating and has treated this case as a hot
potato.
The criteria established by the Board of Health is for the
safety of the public. Dbelieve that to approve this well in
N.Y. by a variance of the established restrictions would be
wrong.

The development of a nonconforming lot is controlled by
Section 2.3 of�the new zoning ordinance. Mr. Lima should apply
for a zoning permit in accordance with Section 2.3 rather than
for a variance.
The minutes of the Public Hearing of October 25, 1990
indicate that Mr. Lima's attorney.called the attention of the
Board to Section 2.4.4 of the zoning ordinance. That section
permits an existing building or structure which is legally
nonconforming to be rebuilt if it "is damaged or destroyed by
fire, explosion, vandalism, act.of. God or the public enemy -"

The zoning ordinance allows ordinary repair and
maintenance, and allows replacement of an existing use which is
suddenly destroyed by an event outside the property owner's
reasonable control. This lot did not contain a nonconforming
use in lawful existence on the effective date of the zoning
ordinance as provided by Section 2.4.2. Mr. Lima has no basis
to claim a variance of either set backs or minimum lot size.

Dear Mr. Gerow:
Reference is made to a November, 12, 1987 letter to me from
then. First. Selectman Reedy. The letter, a copy of which -is
attached,, refers. to a house on Hopewell Drive v.,hich is
= - • apparent•ly- falling down.., . Acco:rd.ipg. to st-atements received f rom
neighbors (copies of which are also attac;,ea), the house is
owned by Daniel ,William Dugay and Veronica.Dugay, has*-been
vacant and, unattended for at least 17 years, and has become a
health and fire hazard. Mrs. Reedy as' 's for my advise- "as'to
the procedure for the removal of this house from the property.'
Section 29 -393 of the General Statutes sets forth the
procedure for removal of structures that are dangerous or in
disrepair. The statute provides in pertinent part;
On receipt of information from the local fire marshal or
from any other authentic source that any building in-his
jurisdiction, due to lack of exit facilities, fire,
deterioration, catastrophe or other cause, F is in such
condition as to be a hazard to any person or persons, the
building inspector shall immediately make an inspection by:.,_- -: ='
himself or by his assistant, and may make orders'. -for
additional exit facilities or the repair or aLe)ration of
the building if the same is susceptible to repair or both or
for the removal of such buildinc or my ;portion thereof if�'
anal such order is in t' e in . rests —of" public

As this statute makes clear, the building inspector is required
to immediately inspect any house which is hazardous, upon
receipt of such information from "any authentic source." The
building inspector is empowered to order any necessary repairs, j
and, upon a determination that. 'removal of the building
"necessary in the interests of public. safety°, he may order .such k
removal.
Thus_ the first t.eg_._is to have Mr. Bjelko and the Town's
fire narshal immediately inspect the house. Their- "�inairigs
shall--- dictate -.- the -- additional_,_action, if any, that must be' .taken
to remedy the situation. rote that. Section .29 -393 permit "s- .a_;`M - "�:"_•_�- -°-
building inspector to enter onto the property between 9:00-a;m - - -
and 5:00 p.m. to perform this inspection.

PERMIT TO CONSTRUCT A WATER WELL
This permit to construct one water well as set forth above is granted under the provisions
of Subpart 5 -2 of Part 5 of the New York Statd'Sanitary Code, and provided that within
thirty (30) days of the completion of water well construction, the applicant shall:
1. Pump the well until the water is clear.
2. Disinfect the well in accordance with the requirements of the Putnam County Health
Department attached to this permit.
3. Submit a Well Completion Report on a form provided by the Putnam County Health Department.
During all well drilling operations, the applicant shall take appropriate action to assure that
any and all water or waste products from such well drilling operations be contained on this
property and in such a manner as not to degrade or otherwise contaminate surface or groundwater.

This Department is in receipt of a application to construct a water well
submitted by Boyd Well Drillers for Salvatore Lima. Hopewell Road. Town of
Patterson. TM 425.57-1 -51.
A survey of lots 9309 thru 9313. dated May 31. 1973. has been submitted to this
Department. This survey shows the septic tank 60 feet and the 3bscrption
trenches approximately 80 feet from the proposed well location on Mr. Lima's
property.
During our discussion on July 12. 1991 you stated that the septic system on your
property was relocated to the front of the house near the existing walk.

in the New Fairfield Health Department or Putnam County Health Department.
The location of your septic system is critical to the review process. It is
requested that a portion of your septic system be excavated, i.e.. the septic
tank and the end of the absorption trenches nearest the proposed well to
determine the exact location.
It is understood you will be on vacation until August 6. If the above request is
not performed before August 21 the review process will proceed using the location
of the septic system shown on the survey on file in this Department.

As to the question of hardship, it would seem that Mr. Lima,
has created his own hardships.

wrong.

Mr. Morris, of your office, Mr. Boyd of the Boyd Well -
Drilling Company and Mr. Tim Simpkins, New Fairfield
Sanitarian, have consulted me about a proposed well on the
property adjacent to mine on Hopewell Drive in Putnam Lake.
Mr. Sal Lima is now the owner of record and while the
majority of the parcel is in Connecticut, a tiny portion is
in New York.
The. proposed well is to be installed on the. port Lon. of..the.
property- that" is in New_ York, within '50 feet of` my sept> c
.system and within 5 feet of my sideline and 5 feet of the
road. In Mr. Boyd's words : he wishes to "sneak it on" and
will attempt to make a deal with N.Y. and CT. authorities.
This proposed well is not about water. There is another well
on the property and the State of Connecticut refused to allow
the proposed septic to be used with the existing well. .
Mr. Lima is not 'a victimized party since he is not the
original owner and has- Durchased -the lot'in, the past, year'
wlth.ful1 knowledge-'of its drawbacks and weaknesses.
The property is listed as 226 of'an acre. It doesn't meet
the usual criteria for lot size. As you are probably aware
this Ball Fond area has had its share of publicity for septic
failures on small parcels.

Dear Mr. Simpkins:
As per our telephone conversation on August 13, 1991 the application for a well
permit for the above captioned lot cannot be granted for the following reasons:
.1. The proposed well location is approximately 72 feet from the existing SSDS
on LaBanca's property to the north. New York State Sanitary Code requires a
100.foot separation distance.
2. The existing well on Lima's property is approximately 100 feet from the
existing SSDS on LaBanca's property. The" relocation 'of the well will
decrease the separation distance to 72 feet.
It appears that if the proposed well is located in Connecticut to the extreme
north west of the property Connecticut's required separation distance of 75 feetr
between well and SSDS can be met by relocating the proposed SSDS 6 -feet to the
south. This would also eliminate any conflict with New York State Sanitary Code
requirements and allow all facilities to be located in the State of Connecticut
under one approval authority..
